ABSTRACT
The Water Shortage Contingency Plan is an amendment to the Urban
Water Management Plan for the City of Poway adopted by the City
Council on January 15, 1991. Per State law, the Contingency Plan
must be filed to augment the Urban Water Management Plan. It is
recommended that the City Council adopt by resolution, the Water
Shortage Contingency Plan.
BACRGROUND
California State Assembly Bill 11X, which amends sections of the
State Water Code relating to water conservation, was passed in
September 1991. It requires all urban water suppliers to prepare
and adopt a Water Shortage Contingency Plan. The Act requires that
copies of the Plan be filed with the State Department of Water
Resources in order to be eligible to receive drought assistance in
any form.
FINDING
The Water Shortage Contingency Plan, Exhibitl,is required to insure
that each water agency serving over 3 , 000 water customers is
prepared for potential future water shortages. With the adoption
of the plan, the City will be eligible for State drought
assistance.

ENVIRONMENTAL REVIEIP
City Council action to adopt the resolution approving the Water
Shortage Contingency Plan is not subject to the statutory
requirements of the CEQA (Division 13 (commencing with Section
21000) of the Public Resources Code) .
FISCAL IMPACT
There are no anticipated fiscal impacts with the adoption of the
Water Contingency Plan. However, Section 10656 of the Water Code
requires that a Plan be submitted in order to be eligible for State
drought assistance.
RECOMMENDATION
It is recommended that the City Council approve the subject
resolution, exhibit 2 , adopting the Water Shortage Contingency
Plan.

AN ORDINANCE OF 'THE CITY COUNCIL OF THE CITY OF POWAY,
CALIFORNIA REPLACING CHAPTER 8 .94 TO THE POWAY
MUNICIPAL CODE ENTITLED, "WATER CONSERVATION PLAN"
WHEREAS, on October 27, 1987, the CityMCouncil°�.°�of �°Poway
adopted a water conservation program by Ordinance No. 243 ; and
WHEREAS, the City Council finds that there exists a potential
shortage of the general water supply, limited capacity in the San
Diego County water Authority distribution facilities, and the
potential for major failure of the supply and distribution
facilities of the Metropolitan Water District of Southern
California, the San Diego County Water Authority and the City. The
City Council further finds it is necessary to adopt and enforce a
water conservation plan to reduce, under certain circumstances, the
quantities of domestic water used by the citizens of the City for
the purpose of conserving the water supplies of the City for the
benefit of the citizens and properties within the City; and
WHEREAS, the City Council finds that the general welfare
requires that the water resources available to the City be put to
the maximum beneficial use, and that the waste or unreasonable use,
or unreasonable method of use of water be prevented and the
conservation of such water is to be encouraged in the interests of
the people of the City of Poway and for the public welfare.
NOW, THEREFORE, BE IT ORDAINED, that pursuant to Section 375
et seq of the California Water Code, that Chapter 8 . 94 of the Poway
Municipal Code be repealed and replaced as follows:

8 . 94 . 010 Findinas A water conservation plan will reduce the
quantities of water used by the inhabitants of the City of Poway
and such a program is necessary based on any of the following
findings:
A. There is general water supply shortage.
B. San Diego County Water Authority distribution
facilities are inadequate.

C. The prospect of a major failure of the supply and
flistribution facilities of the Metropolitan Water
District of Southern CaliPornia, the San Diego County
Water Authority, as well as the City, exists at the
present time.
D. The conditions prevailing in the San Diego County area
require that the water resources ava'iiable ^be°put 'to'�the'
maximum beneficial use to the extent in which they are
capable, and that the waste or unreasonable use, or
unreasonable method of use of water be prevented and the
conservation of such water is to be extended and
encouraged for benefit of the public welfare.
8 .94 . 020 . Definitions.
1. "Active park and school ground areas" means those
areas designated by public agencies and private
schools for specific sporting and recreational
activities and areas traditionally used for
active play or recreation where turf is an
-- integral part of the activity. All other turf areas
shall be considered ornamental.
2 . "Water Used for Agriculture" means water billed at the
aqricultural or agricultural\domestic user rate for
1989-90 .
3 . "Conservation offset" shall mean a program or policy
, adopted by resolution of the City Council which
provides for the implementation of proven conservation
techniques which, when installed, will result in a
reduction equal to demand of the proposed use.
Calculation of demand and saving shall be performed or
verified by the City Manager, based upon drought
conditions.
4 . "Devices" shall mean any method utilized to conserve
potable or reclaimed water supplies or to offset
existing potable or reclaimed water supplies.
5. "Fire Protection" means actions for prevention or
suppression of fires as directed by the Fire Marshal
or Fire Prevention officer with jurisdiction over the
local area involved.

6. "Greywater" means household wastewater other than
toilet water, i.e. , water from the laundry, shower,
• tub, bathroom, and kitchen sinks. Its use is
presently prohibited by tha San Diego County
Department of Aealth Services. The exception
mentioned for greywater depends solely upon
approval of such use by the San Diego County
Department of Health Services according to issued
rules and regulations. ° '
7. "Micro irrigation systems/equipment" means low
pressure, low.volume methods of water application.
These devices , include drip emitters, T-tape,
microsprayers, O-jets, mini-sprinklers, twirlers', and
spaghetti tubing. Pop-up sprinklers are not
considered low-volume, low pressure irrigation
systems/equipment.
8 . "Potable Water" means water delivered by the City
which meets drinking water standards or raw water
delivered by the AUTHORITY.
9. "Reclaimed Water" means water which, as a result of
treatment of wastewater, is suitable for a direct
beneficial use or controlled use that would not
otherwise occur.
10. "Recreational and Ornamental Lakes and Ponds" means
bodies of water which are not swimming pools or water
storage reservoirs for potable water or irrigation ;
purposes.
8 . 94 . 030 Water Uses Prohibited. No water customer of the
City of Poway shall knowingly make, cause, use or permit the use of i
water from the City for residential, commercial, industrial,
agricultural, governmental or any other purpose, in a manner
contrary to any provision of this Chapter, or in an amount in
excess of that use permitted by the conservation stagas hereinafter
designated, which are in effect pursuant to action taken by the
City Manager or his designate in accordance with the provisions of
this Chapter.
8 94 040 Determination and Declaration of Water Conditions
The City Manager or designated representative, shall from time-to-
time based upon all available data, determine and declare that the
City's water supply is in one of the seven designated conservation i
stages as set in section, post a notice thereof at the City Hall I
prior to the effective date of declaration, and cause notice of
said declaration to be published in a newspaper of qeneral j
circulation in the City within 20 days of said posting.

8 .94 .050 Exceotions. The City Manager or designated
representative, is authorized to make minor and limited exceptions
to the prwisions of this ordinance to prevent undue hardship or
unreasonable restrictions, provided that water shall not be wasted
or used unreasonably and the purpose of this ordinance can be
accomplished.
8 .94 . 060. Duration of Declaration. Effective immediately,
upon the declaration and posting of a deszgnatnd -�conservation
stage, the water conservation measures provided for herein for that
stage shall apply to all City domestic water service, until the
declaration is terminated, or a different stage is declared. Such
declaration shall not apply to the use of reclaimed water or
groundwater from private wells. The City Manager' s declaration
shall be of no further force or effect unless, within seven days of
such declaration and posting, the City Council shall ratify said
declaration in public session, without public hearing. .
8 .94 . 070. Conservation Staaes .
STAGE i. When the City's water supply has been declared to
be in a Stage I condition, customers are asked to use water wisely
and to practice water conservation measures �so that water is not
wasted. Residents, business owners, and operators are encouraged
to not waste water and to observe the following water conservation
practices:
A. Check indoor toilets for leaks and/or repairs and repair
immediately.
B. Limit shower time and install water saving showerheads.
C. Run only fully loaded dishwashers and washing machines .
D. Installation of pool/spa covers is recommended.
E. Wash vehicles with hand-held hose with positive shutoff
nozzle and bucket only.
F. Check irrigation/�prinkler system for leaks and repairs
as soon as possible to ensure that water does not run off
to the street or adjacent property.
G. Reset irrigation clocks by season--water once a week in
winter, no more than three times a week in summer.
H. Agricultural facilities should use drip irrigation and
microsprinklers for perennial crops.

J. Use brooms to clean outdoor paved areas rather than
hosing down with water. .
K. Car washes should use water recirculating pumps and check
for leaks in system.
L. Hotels and other lodging facilities shall:
a. Check plumbing for leaks

showerheads.
STAGE II. When the City Manager has declared that the City' s
water supply is in a Stage II condition, the following
restrictions shall apply:
A. City-wide domestic water consumption shall be reduced by
up to lo�.
B. � Irrigation is not permitted during rain.
C. Lawn watering and landscape irrigation is allowed only
between 6: 00 p. m. and 10:00 a. m. and only when
necessary.
D. There shall be no washing down of driveways, parking
lots, and other paved surfaces, except for compelling
public health and saEety reasons and then using a hose
with positive shutoff nozzle or high pressure, low volume
cleaning system. '
E. Washing of vehicles will be permitted only while using a
bucket or while using a hand-held hose with a positive
shutoff nozzle, or at a commercial car wash or high
volume, low volume car wash service.
F. Adding water to maintain the approved level of water in
swimming pools shall be done only when necessary. A pool ,
cover shall be installed on all single-family residential ;
pools . I
G. Construction meters used for irrigation shall only be i
used between 6: 00 p. m. and 10: 00 a. m.
H. Agricultural customers and commercial nurseries shall use ,'
water only when necessary.
I. Plumbing and irrigation system leaks shall be promptly
repaired.

J. A customer shall not allow water to leave the property by

water supply is in a Stage III condition, in addition to all
previous restrictions, the following restrictions shall`apply:
A. City-wide domestic water consumption shall be reduced by

B. Golf courses shall not irrigate roughs with potable water
no more than twice a week, on Tuesdays and Saturdays
only. '
C. Turf areas not actively used. in nonresident'ial
establishments shall be watered no more than twice a
week, on Tuesdays and Saturdays.
D. Operation of ornamental fountains or similar structures
is prohibited (unless water is recycled) .
STAGE IV. When the City Manager has determined that the
� City' s water supply is in a Stage IV condition, in addition to
all previous restrictions, the Pollowing restrictions shall
apply:
A. City-wide potable water consumption shall be reduced by
20-29� .
B. Irrigation of landscaping will not be permitted more than
twice a week and only if necessary.
C. Potable water used for agriculture and construction shall
be reduced by 20�.
D. New water meters shall not be used unless a water
conservation offset is obtained, no net gain in water
usage is demonstrated or a water conservation offset fee
is paid.
STAGE v. When the City Manager has declared that the City' s
water supply is in a Stage V condition, in addition to all
previous restrictions, the following restrictions shall apply:

A. City-wide potable water consumption shall be cut by 30-

B. Watering of nonactive turf or ground cover areas may be
done using a hand-held hose with a positive shutoff or
micro systems/equipment during irrigation time periods or
with a sprinkler system once a week, on Mondays for odd
addressed properties or on Wednesdays for even addressed
properties.
C. Golf courses shall irrigate fairways and roughs once a
week, on Fridays.
D. Potable water used for construction shall be reduced by
30�.
E. Home reverse osmosis water treatment units and water
' softeners which discharge water, shall be turned off or
disconnected.
F. Emptying and refilling of swimming pools is prohibited
unless approved by the Director of Public Services for
health and safety reasons.
STAGE VI. When the City Manager has declared that the City
water supply is in a Stage VI condition, in addition to all
previous restrictions, the fflllowing restrictions shall apply:
A. City-wide potable water consumption shall be cut by 40-

B. Outside irrigation of trees, shrubs, and other plants is
allowed only between 6: 00 p. m. and 10: 00 a. m. and only
by hand-held hose with a positive shutoff nozzle, bucket,
or micro-irrigation systems/equipment. I�

turf and groundcover for fire protection purposes and �
erosion control, or once every two weeks for areas where
trees and shrubs are integrated in turf or groundcover i

STAGE vi=. When the City water supply has been declared to be
in a Stage VII condition, the City Manager shall effect such
cutbacks as necessary, to maintain adequate water supplies for
public health, saPety, welfare, and to comply with any
declared requlatory agency requirements. In addition to all
previous restrictions, the following restrictions shall apply:
A. City-wide potable water consumption shaT•1 be cut by '5'o$
or more, as required.
B. No buildinq permits which require new or expanded water
service will be issued except to pratect the public's
health, safety and welfare or which meets City Council
adopted conservation offset requirements.
C. Water meters shall not be issued except to protect the
public's health, safety and welfare.
D. Vehicles may not be washed unless necessary for health
reasons.
E. outdoor irrigation or watering is prohibited.
F. Potable water shall be reduced by 50� or more for
agricultural or construction purposes, as determined
necessary by the City Manager.
G. Sale oP water to customers outside the City limits will
be discontinued.
8 .94 . 080 Penaltv. Any person, corporation, or association
violating any provision of this ordinance, shall be guilty of a
misdemeanor punishable in accordance with Chapter 1. 08 of this
Code, provided, however, compliance may be further sought through
injunctive relief in the Superior Court.

A RESOLIITION OF THS CITY COIINCIL
OF THE CITY OF P01PAY� CALIFORNIA
ADOPTIN(i ITS WATBR BHORTAQE CONTINGENCY PLAN
WHEREAS, the California Legislature enacted Assembly Bill S1X
during the 19921 Extraordinary Session of the California
Legislature (an act to amend California Water Code Sections 10620,
10621, 10631, and 10652, and to add Section 10656 to the California
Water Code, relating to water) ; and
WHEREAS, AB 11X mandates that every urban water supplier providing
water to more than 3, 000 customers or supplying more than 3, 000
acre-feet of water annually to develop a Water Shortage Contingency
Plan; and
WHEREAS, AB 11X mandates that said Plan be filed with the
California Department of Water Resources; and
WHEREAS, the City of Poway is a supplier of water to more than
3 , 000 customers, and has therefore, prepared and circulated for
public review a Draft Water Shortage Contingency Plan, in
compliance with the requirements of AB 11X, and properly noticed
public hearing regarding said Draft Plan was held by the City
Council of the City of Poway on February 4, 1992, and a Final Water
Shortage Contingency Plan prepared;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Poway, California approves and adopts the "Water Shortaqe
Contingency Plan" ; and
BE IT FURTHER RESOLVED that the City Manager of the City of Poway
is authorized and directed to file this Plan with the California
Department of Water Resources.
