The May 12, 1992, regular meeting of the City Council of the City of Poway,
was called to order at 7:02 p.m. , by Deputy Mayor McIntyre at the City Council
Chambers, 13325 Civic Center Drive, Poway, California.

PROCLAMATION
Deputy Mayor McIntyre read the proclamation proclaiming May 17-23, 1992 as "Buddy
Poppy Week" in the City of Poway and presented it to Bud Gray and Commander Joe
Sanchez of the Poway UfW Post 7907.
PUBLIC ORAL COMMUNICATIONS
Deputy Mayor McIntyre explained the procedure for Public Oral Communications. The
following persons were present wishing to speak:
1 . Cindy Barnes, 14508 Springvale Street, discussed the rules for pets in the
mobile home parks owned by the city. They are not the same and she is unable
to purchase a coach in the Poway Royal Mobile Estates because she owns two
dogs. City Manager Bowersox stated he will report back on May 26, 1992.
-- 2. A. J. Pappas, 13316 Avenida la Valencia, stated his neighbor had been granted
a Conditional Use Permit for a guest house. That has been converted to a
rental unit in violation of the CUP. City Manager Bowersox stated he will
report back on May 26, 1992.

ORDINANCE N0. 359 - SECOND READING
SOLID WASTE. GREEN WASTE & RECYCLABLES COLLECTION
Deputy Mayor McIntyre read the title of Ordinance No. 359, "An Ordinance of the City
of Poway, California, Rescinding Chapter 8.68 of the Poway Municipal Code and
Establishing a New Chapter 8.68 of the Poway Municipal Code Regulating Solid Waste,
Green Waste, and Recyclable Material Collection. "
Staff report by City Manager Bowersox. This is the second reading of the Ordinance
which, among other provisions, requires the current permit holders to provide
collection of recyclable materials from single family residences by September 1,
1992.
Motion by Councilmember Emery, seconded by Councilmember Higginson to waive further
reading, close the public hearing and adopt Ordinance No. 359. Motion carried 4-0
on a roll call vote with Mayor Goldsmith absent.

CONDITIONAL USE PERMIT 92-03
APPLICANT• MICHAEL MORTON/BRIGANTINE RESTAURANT
Deputy Mayor McIntyre opened the public hearing. Staff report by City Manager
Bowersox. This is a request for the Brigantine restaurant to serve alcoholic
beverages, including hard liquor, in the Creekside Plaza at the southeast corner ofi
Midland and Poway Roads. Staff recommends a change in the Resolution to allow
service of alcoholic beverages up to one and one half hours following the hours in
which food is being served.

public hearing and adopt Planning Resolution No. P-92-23, entitled, "A Resolution
of the City Council of the City of Poway, California Approving Conditional Use

carried 4-0 with Mayor Goldsmith absent.

TENTATIVE PARCEL MAP 89-12 TIME EXTENSION
APPLICANT: ERB ENGINEERING FOR FIRST fIDELITY THRIfT AND LOAN
Deputy Mayor McIntyre opened the public hearing. Staff report by City Manager
Bowersox. This is a request for a one year time extension for TPM 89-12 which
subdivides 12.6 acres into four parcels at the eastern terminus of Orchard View
Lane. The applicant has requested a redesign of the access roadway and staff
" recommends approval with some amended conditions.

4-0 with Mayor Goldsmith absent.

Deputy Mayor McIntyre opened the public hearing. Staff report by City Manager
Bowersox. This right of way now lies within Lots 121 and A of Tentative Map 88-04
following the realignment of Pomerado Road and staff recommends approval of its
vacation.

Motion by Cauncilmember Snesko, seconded by Councilmember Higginson, to close the
public hearing and adopt Resolution No. 92-073, entitled, "A Resolution of the City

of Old Pomerado Road, Creek Road, and Pomerado Road at the Southwest Corner of South
Poway Parkway and Pomerado Road Intersection (Vacation 90-01) . " Motion carried 4-0
with Mayor Goldsmith absent.

RECONSIDERATION
Councilmember Emery stated he had abstained from voting on this Tentative Parcel Map
when it was originally presented because of the proximity of his home to this
property and needed to abstain from the time extension. Motion by Councilmember
Emery, seconded by Councilmember Higginson to reconsider time extension for
Tentative Parcel Map 88-12 Time Extension. Motion carried 4-0 with Mayor Goldsmith
absent.
Motion by Councilmember Snesko, seconded by Councilmember Higginson to close the

REWARD SYSTEM FOR CERTAIN CRIMES
Staff report by City Manager Bowersox. Councilmember Snesko requested rewards be
established for certain crimes at the May 5, 1992 meeting. The only program
currently operating in the County is Crime Stoppers Tip Line.
Councilmember Snesko stated he believes there is a need to send a message in the car
bombing incident that we will not tolerate hate crimes in our community and made a
motion that the City Council authorize a reward of E5,000 for the arrest and
conviction of the perpetrator of hate crimes with the reward money being recovered
from the convicted person. There was no second or discussion. Council received and
filed the report.

STRATEGIC VISION STATEMENT FOR THE
POWAY CENTER fOR THE PERFORMING ARTS
Deputy Mayor McIntyre stated she had pulled this item from the Consent Calendar.
She had served with Councilmember Emery on the ad-hoc committee that prepared this
vision statement and feels some critical language was omitted from the second point.
She requested the words, "within available resources" be added to read: "Providing
- balanced high quality programming, within available resources. . . "
Motion by Deputy Mayor McIntyre, seconded by Councilmember Emery to adopt the
Strategic Vision Statement for the Poway Center for the Performing Arts, as amended.
Motion carried 4-0 with Mayor Goldsmith absent.

REGIONAL GROWTH MANAGEMENT STRATEGY
Deputy Mayor McIntyre stated she had pulled this item from the Consent Calendar.
She presented several suggested additions to the Resolution Rejecting the Regional
Growth Management Strategy.
Motion by Councilmember Snesko, seconded by Councilmember Higginson to adopt
Resolution No. 92-074, entitled, "A Resolution of the City Council of the City of
Poway, Rejecting the Regional Growth Management Strategy, " as amended by Deputy
Mayor McIntyre. Motion carried 4-0 with Mayor Goldsmith absent.

STATUS OF PENDING LEGISLATION
Deputy Mayor McIntyre stated she had pulled this item from the Consent Calendar
since she wishes to vote on staff recommendation on Item 1 (AB 3476) and Item 8 (ACA

Motion by Councilmember Emery, seconded by Councilmember Higginson to approve
positions on pending legislation, as follows : Oppose AB 3476, amendments to the

Brown Act; Oppose AB 3213, allocations of Cigarette Tax Fund; Oppose SB 1711,
revisions to Community Redevelopment Law; Oppose AB 2473, reform of the fee
structure administered by the State Water Resources Control Board; Oppose AB 3060,
changes to the composition and functions of Local Agency Formation Commissions;
Oppose SCA 41, earmarking all increases in Vehicle License Fees for county mental
health and social service programs; Oppose AB 3700, revising Community Redevelopment
Law pertaining to project area committee formation and low and moderate income
housing development; support ACA 1, which will allow counties to impose sales tax
on real property; support AB 3689 which requires state agencies to develop an
integrated waste management program; support AB 3251 requiring proof of workers'
compensation insurance when applying for or renewing a business license; support
SB 1668, extending deadlines for submittal of integrated waste management plans.
Motion carried 4-0 with the exception of AB 3476 and ACA 1 with Deputy Mayor
McIntyre voting "no" on those two items.

CITY MANAGER ITEMS
City Manager Bowersox announced that AB 2707 passed out of committee on unanimous
vote last week. This is the legislation written by Assemblywoman Tricia Hunter that
will make it easier for us to meet our low and moderate income housing goals.

CITY ATTORNEY ITEMS
A. Assistant City Attorney Smith stated that the City Attorney had notified the
City Council that their action of May 5, 1992, adopting a Resolution
commencing eminent domain proceedings for the property at 13536 Poway Road was
null and void since it required a four-fifths vote. Since this action was
taken at a public hearing, any reconsideration must be done at another public
hearing.
Motion by Councilmember Emery, seconded by Councilmember Higginson to set a
public hearing for June 9, 1992 to reconsider the Resolution of Necessity.
Deputy Mayor McIntyre stated she would support the reconsideration in order
to move the process along. Motion carried 3-1 with Councilmember Snesko
voting "no. "
B. Since the City Attorney was not present, the discussion of alternative means
of resolution of the dispute over whether the library use is prohibited in the
Longs Drug Store will take place on June 9, 1992.
MAYOR AND CITY COUNCIL-INITIATED ITEMS
24A. Councilmember Emery asked that political signs strapped to trees in the public
right of way be relocated.
246. Councilmember Emery stated the graffiti needs to be removed from the old Post
Office at Hilleary and Midland Roads

24C. Councilmember Emery stated he has noticed that some of the more remote areas
of South Poway are "party spots" on weekends and suggested more Sheriff
patrols.
24D. Councilmember Emery stated neither he is nor his alternate can attend the MTDB
meeting this week and staff will attend and present his positions on certain
issues.
26. Councilmember Higginson requested monthly status reports of the Poway Road
west end. improvements in order to answer questions from the public.
27. Deputy Mayor McIntyre commended staff for their working with Mike Morton and
the Brigantine Restaurant in such a cooperative manner. He was very
complimentary of the city and the staff.
28. Councilmember Snesko stated he had attended the ADAPT meeting and they will
be requesting all cities and school districts send letters to Sea World
protesting their providing free beer and selling candy and children's clothing
with beer logas.

Deputy Mayor McIntyre adjourned the meeting at 7:50 p.m. , in memory of Daphne Eckis,
mother of City Attorney Steve Eckis, who died yesterday.

VACATING OPEN SPACE EASEMENT (VAC 92-01)
Deputy Mayor McIntyre read the title df Ordlnance No. 356, "An Ordinance of the
City of Poway, Catfifornia, Vacating the Open Space Easement in Lots 5, 6 and 7
of City of Poway Tract No. 4278, Map No. 11326 (VAC 92-01)." City Manager
Bowersox stated that the owners of the property, Errol and Pauline Yeager, have
compteted the remedial grading required as a condition of final adoption of the
ordinance. The open space exchange proposed by this action, however, does not
release the owners oP the responsibility to correct the zoning, land development
and buiiding code violations existing on the property. The City Attorney' s
office is pursuing resolution oP the violation issues. StaPf recortmends adop-
tion of this ordinance.

Deputy Mayor McIntyre opened the public hearing. Staff report by City Manager
Bowersox. This is a request to expand the parking 1ot and add two detached
modular buildings to the Christian Life Assembly church iocated at 14047 Twin
Peaks Road. The parking lot expansion wiil provide an additional 30 spaces and
the modular buildings will provide addit9onal classroam space. Staff recortmends
approval .

ESTABLISHING SPEED LIMIT ON CARRIAGE ROAD
Mayor Goldsmith opened the public hearing and read the tttle of Ordinance No.
360, "An Ordinance oP the City of Poway, California, Establishing Speed Limits
� on Carriage Road Between Poway Road and Oak Knoll Road." C1ty Manager Bowersox
stated that the the Traffic Safety Cortmittee has reviewed the existing 35 m.p.h.
speed limit on Carriage Road from Poway Road to Oak �Kno11 Road and is recom-
mending that it be reduced to 30 m.p.h.

Motion by Councilmember Emery, seconded by Councilmember Snesko, to waive
further reading of Ordinance No. 360 and continue the publlc hearing to June 9,
1992, for second reading. Motion carried unanimously.

DRAFT ENVIRONMENTAL IMPACT REPORT FOR THE
PROPOSED AMENDMENTS TO THE PAGUAY REDEVELOPMENT PLAN
Mayor Goldsmith opened the public hearing. Staff report by City Manager
Bowersox. Th1s public hearing is betng held to gather input regarding the con-
tents of the Environmental Impact Report being prepared in con,junction with the
propased amendments to the Paguay Redevelopment Plan. During the Initial Study,
staff has identifled potential impacts in the areas of earth and geology, air
quality, water and hydrology, plant and animai life, noise, land use, natural
resources, risk of upset, population, housing, traffic and circulation, public
services, utilities/energy, aesthetics/light and glare, and cultural resources.
City Manager Bowersox stated there is a revision to Page 1-2, Surtmary of
Findings, Section 1.3, to read "(The EIR prepared for the original Redevelopment
Plan w111 be referenced in this EIR.)" Staff recomnends receiving public input
and proceeding with the preparation of the Environmental Impact Report.

Motion by Councilmember Emery, secanded by Councilmember Higginson, to close the
public hearing, and approve staff recortmendation as amended. Motion carried
unanimously.

PRELIMINARY PLAN FOR THE PROPOSED AMENDMENTS
TO THE PAGUAY REDEVELOPMENT PLAN
Staff report by City Manager Bowersox. In order to comnence the amendment pro-
-- cess to the Paguay Redeveiopment Plan, it is necessary to adopt a resolution
confirming the existing boundaries of the Paguay Redevelopment Project Area and
approving the Preliminary P1an. Staff recomnends approval .

Resolution No. 92-076 entitled, "A Resolution of the City Council of the City of

LEFT TURNS AT POWAY ROAD AND OAK KNOLL ROAD
Introduction by City Manager Bowersox. Staff report by Engineering Services
Directar Weston. The Traffic Safety Cortmittee has reviewed the signal operation
at the intersection of Poway Road and Oak Kno11 Road. The existing five phase
signal allows permissive left turns from Oak Knoll Road to Poway Road which pro-
vides less waiting time for Poway Road traffic. The committee has requested the
installation of "Left Turn Yieid" slgns to eliminate any confusion for motorists
regarding through traffic right-of-way. Staff recomnends the Counc9l receive
and file the report.
Councilmember Snesko stated that he has observed eastbound aPternoon traPfic
backed up on Poway Road at the Carriage Road intersection.
City Manager Bowersox stated that staff will review the traffic signal synchro-
nization on Poway Road.

POWAY ROYAL MOBILEHOME PARK SWIMMING POOLS
Staff report by City Manager Bowersox. At the Apr11 21, 1992 City Councii
meeting, Mr. David Rinaldo asked about the closure of the swimning paols at
Paway Royal Estates mobilehome park and requested the Council provide passes to
the City' s swimming pool at the Cortmunity Park for the park residents. Staff
has prepared a report indicating a completion date of June 15th, or earlier.
Staff recomnends report be received and filed.
Council concurred to receive and file the report.

bids documents, and caps on increases in annual assessments.

Following discussion, motion by Councilmember Higginson, seconded by
Councilmember Snesko, to adopt Resolution No. 92-077 entitled, "A Resolution of

for Fiscal Year 1992-93," as amended to delete the assessment for North City
Parkway (SR 56) west of Pomerado Road to the City Limits from the Engineer's
Report, and setting the public hearing for June 16, 1992. Motion carried 4-0
with Councilmember McIntyre abstaining.
Mayor Goldsmith requested that staff provide the materials reviewed by the
- Landscape Maintenance Advisory Committee, including budgets, request for propo-
sals, and contracts prior to the June i6, 1992 public hearings.

Archibald. The proposed annuai assessments per unit are as follows: LMD 86-1,
Zone A (residential ) $261.02, Zone B (Church of the Latter Day Saints) $0 as
the church will be maintaining the improvements; LMD 86-2, Zone A (residential )
$186.16, Zone B (Sycamore Creek) $217.48 which reflects an increase in main-
tenance and first year payback on a three-year loan from assessment reserves for
revenue shortfall during FY 92-93; LMD 86-3, Zane A (residentiat ) $163.00, Zone
B (cortmercial ) $33.66; and LMD 87-1 (South Poway Business Park) $671.70 per net
acre. Staff recartmends approval .

RECYCLING CENTER IMPROVEMENTS
POWAY HIGH SCHOOL MUSIC BOOSTERS
Staff report by City Manager Bowersox. At the February 25, 1992 meeting, the
Council directed staff to prepare a plan for financing the improvements required
as a condition of operating the Poway High School Music Booster's Garden Road
site as a permanent recycling center. Staff has met with the Music Boosters,
IMS Recycling, and the property awners to discuss the necessary improvements,
including a sound attenuation wal1 , onsite parking, modificatians for ingress
and egress for traffic f1ow, and a screening wall . Staff recomnends
appropriatian of $4,000 from the Recycling Tonnage Grant funds to be used to
offset the costs of fees and permits associated with the improvements.
Motion by Councilmember Emery, seconded by Councilmember Snesko to approve staff
recortmendation. Motion carried unanimousiy.

ANNUAL FOURTH Of JULY CELEBRATION
Staff report by City Manager Bowersox. The 4th of July Cortmittee has requested
financial asslstance for an annual celebration to be held at Lake Poway along
with a fireworks display staged at Poway High Schooi stadium. Staff recortmends
approval of the expenditure of $5,800 to provide City staffing in setting up
Lake Poway, renting equipment and providing shuttie service. Approximately
$2,100 can be financed by the Transit Deveiopment Act Funds, with the balance of
$3,700 from the General Fund.
Motion by Councilmember Emery, seconded by Councilmember Higginson to approve
staff recortmendation. Motion carried unanimously.
Mayor Goldsmith requested information regarding the City purchasing a tram which
could be used as shuttle service to support cortmunity events.

INTERPRETATION OF DEFINITION OF HOSPITAL
Introduction by City Manager Bowersox. Staff report by Director of Planning
Services Wright-Quastler. During the 1991 Generai P1an update process, the
Palomar/POmerado Health System requested several amendments regarding the
Pomerado Hospital site. The hospital is located in the OS zone, which is sub-
ject to the provisions of Proposition FF, adopted in November, 1988. The hospi-
tal district is requesting the Councit review a proposed definition of a
Hospital Campus to determine if it reflects an intensification of uses over
those permitted within the Zoning Ordinance definition of a hospital which was
in place in November, 1988. StaPf recortmends that the Council find that the
proposed dePinition for a Hospital Campus is not an intensification of uses.
Speaking in favor of staff recortmendation:
Jack R. Mitchell , 13894 Putney Road, representing Palomar/Pomerada Hospitai
District, stated the district is seeking direction from the Council for
ptanning future services.
Upon query by Council , Director of Planning Services Wright-Quastler stated that
this would be the first step in the general ptan amendment process of creating
- the Haspital Campus land use designation. In order to designate Pomerado
Hospital as a Hospital Campus, a general plan amendment would be necessary. The
development standards such as, parking, building design, and compatibility,
would then be developed for the new zoning designation.
Motlon by Councilmember Snesko, seconded by Councilmember Higginson to appove
staff recortmendation. Motion carried 4-1, with Councilmember Emery voting "no."

30. Councilmember Emery requested Councit concurrence to schedule an appointment
to the Redevelopment and Housing Advisory Cortmittee. Council cancurred.
31. Mayar Goldsmith requested that the Stowe Drive speed lim9t signs be changed
to reflect the new speed limit of 45 mph.
34. Councilmember Snesko d9d not discuss his item regarding the Western Lumber
site.
