It is recommended that the City Council find that Trident Homes of California, Inc. and Shea Homes Limited Partnership have complied with the terms of the Development Agreement for the development of Rolling Hills Estates within the South Poway Community Plan Area. ENVIRONMENTAL REVIEW . This item is not subject to CEQA review. FISCAL IMPACT None. ADDITIONAL PUBLIC NOTIFICATION AND CORRESPONDENCE Copies of this report have been sent to Trident Homes of California, Inc. and Shea Homes Limited Partnership. RECOMMENDATION It is recommended that the City Council find that Trident Homes of California, Inc. and Shea Homes Limited Partnership have demonstrated good faith compliance with the terms of the Development Agreement entered into on May 14, 1991. Bowersox, City Man~ Warren H Shafer, Director of Redevelopment service~ Kris Gridley, Redevelopment Coordinator ~ December 17, 1996 Annual Review of Development Agreement with Trident Homes of California, Inc. and Shea Homes Limited Partnership DATE: SUBJECT: BACKGROUND On May 14, 1991, the City of Poway entered into a Development Agreement with McMillin Equity Partners II to provide for the development of Rolling Hills Estates within the South Poway Community Plan Area. The requisite periodic review of compl iance under the Development Agreement must take place prior to the calendar year-end each year thereafter. On September 20, 1994 the City Council approved the transfer of this Development Agreement from McMillin Equity Partners II to Trident Homes of California, Inc. and on October 22, 1996, the City Council approved the transfer of a portion of the property governed by the Development Agreement to Shea Homes Limi ted Partnership. FINDINGS Attached are two letters, one from Trident Homes of California, Inc. and the other from Shea Homes Limi ted Partnershi p. These I etters accurately descri be the progress that has been made on the subject development to date. Staff has determi ned that the work accompli shed under the Development Agreement is in compliance with the provisions of the South Poway Community Plan and the Development Agreement. Dear Ms, Gridley: In October 1996 Trident Homes of California sold a portion of its Poway 135 (Rolling Hills Estates) property to Shea Homes, Trident has maintained ownership of the Commercial Lot located at the southwest comer of Scripps Poway Parkway and Pomerado Road. With respect to progress made during the 1996 calendar year, the Unit 1 Final Map for Rolling Hills Estates was recorded on October 17, 1996 and development of the Commercial Lot began on October 21, 1996. Development is in process with completion tentative scheduled for the Julyl August 1997 time period. At this time, Trident Homes has no immediate plans for building on the Commercial Lot. California 92131 {619} 549-3156 FAX (619) 549-0112 November 23, 1996 RE: Annual Review of Development Agreement for Rolling Hills Estates Dear Ms, Gridley: Per your request, this letter is written to summarize the status of the residential property of the Rolling Hills development for the City's annual review of Development Agreements, Earlier this year, grading and improvement plans for Unit 1 were processed and approved. On October 15, the Unit I final map was approved by City Council, and was recorded on October 17, The Unit I "pre-development" fees were paid and improvement performance bonds have been posted, Shea Homes purchased the residential lots of Units I and 2 on October 18, Assignment, Delegation, and Assumption documents have been executed for the Owner Participation Agreement, Development Agreement, and Standard Agreement for Construction of Public Improvements. Grading operations for Unit I commenced in late October and we expect the site to be substantially complete by early fall, 1997, Shea Homes will be submitting the Development Review application in December, and we anticipate a City Council hearing in February, 1997. We expect to process plans for Unit 2 in early 1998 and are planning for the Unit 2 final map to be approved in Spring, 1998.
