SUBJECT: Detachment from Landscape Maintenance District 86-
1: APN 275-240-46, Jerry and Patrice Simonsen,
Owner
ABSTRACT
The subject parcel, APN 275-240-46, was annexed into Landscape
Maintenance District 86-1 on September 24 , 1991. Staff recommends
that Council adopt the attached resolution for detachment of APN
275-240-46 from Landscape Maintenance District 86-1.
BACRGROIIND
On February 25, 1992 , City Council approved Resolution No. 92-039
which excludes the annexation of single-family residences into
Landscape Maintenance Districts. Council requested that staff de-
annex any existing single-family residences that are affected by
the new policy.
FINDINGS
The subject parcel contains a single-family residence which is not
associated with any subdivision.
FISCAL IMPACT
Loss of revenue will be insignificant to the district.

Standard distribution. The owners of the property have consented
to detach from Landscape Maintenance District 86-1 (Consent to
Detach Form, Attachment 2) .
RECOMMENDATION
It is recommended that the City Council of the City of Poway adopt
the resolution for detachment of APN 275-240-46 from Landscape
Maintenance District 86-1.

RESOLUTION NO. 92-
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
DETACHING ASSESSOR PARCEL NO. 275-240-46
FROM LANDSCAPE MAINTENANCE DISTRICT 86-1
RESCINDING RESOLUTION NO. 91-104
WHEREAS, the City Council of the City of Poway desires to
decrease Poway Landscape Maintenance District 86-1 as shown in
Exhibit "A" pursuant to the Landscape and Lighting Act of 1972 ;
and
WHEREAS, the record owner of all the real property within
said district area has given written consent to detach from Poway
Landscape Maintenance District 86-1 according to the California
Streets and Highway Code, Section 22609.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Poway does hereby resolve as follows:
1. The foregoing recitals are true and correct, and the
City Council so finds and determines.
2 . All of that certain territory shown in Exhibit "A" ,
attached hereto, is hereby detached from Poway
- Landscape Maintenance District 86-1, rescinding
Resolution No. 91-104 .
PASSED, ADOPTED, and APPROVED by the City Council of the
City of Poway, California, at a regular meeting this 16th day o£
June, 1992 .
