Neighborhood Access Issues
BACKGROUND:
On September 8, 1992 residents of York Avenue addressed the City Council
regarding a recently installed gate blocking access to Scots Way at the south
end. Council directed staff to facilitate a neighborhood meeting and develop
costs for improving Yark Avenue under the neighborhoad loan program.
On Wednesday, October 14, 1992, City staff inet with residences on York Avenue
and Edgemoor Street to discuss the access issues that have risen with
installation of the steel gate. Staff develaped costs to improve York Avenue
and w9den Edgemoor Street to a 20 foot private asphalt road. The cast estimate
to improve Edgemoor Street is E50,000.00 and the cost estimate to improve
Yor.k Avenue is �110,000.00. . Approximately 30 residents attended the meeting.
The neighborhood raised the following issues: access to the south, emergency
access, through traffic problems, speeding, maintenance of road, payment of the
improvements and prescriptive easements. Additional meetings are recomnended
with the neighborhood.
FINDINGS:
During the public meeting the residents living on York Avenue and Edgemoor
Street raised several concerns. Their concerns include the following:
1. Closure of York Avenue to the south.
2. Emergency access to the neighbarhood.
3. Through traffic problems.
4. Maintenance af road.
5. Payment of the improvements.

As a result of the discussion, all the residents agreed that a fire lane
should be established on Edgemoor Street, (see Attachment ql). The residents
expressed concern that when anyane parks on Edgemoor Street, it prohibits access
for emergency vehicles. Staff concurred with their concerns. The road is
only 17 feet wide, and if a car parks on Edgemoor Street west of Sycamore
Avenue emergency vehicles cannot access the north end of York Avenue.
Staff therefore recomnends instalting a fire access lane designation along
the narrow section of Edgemoor Street (see Attachment #1) which would eli-
minate this potentiai safety hazard.
The neighborhood expressed concerns regarding the right to install a steel
gate across York Avenue. This issue appears to be a private legal dispute.
Residents north of the gate may pursue the issue of a prescriptive easement.
Furthermare, the day after the meeting the City received a petition from the
residents who live south af the steel gate on York Avenue (see attachment N2).
The petition states that the undersigned are in support of leaving the steel •
gate in place on York Avenue. Comnents fram some of the residents at the public
meeting suggested that biockage on York Avenue has occured in a manner that
dates back 8 to 10 years. However, the road did appear to be open several
months since January or February. Staff feels that this is a private
matter and should be resolved between the private parties involved.
In addition to the issue of the gate there was a wide variety of opinions on
opening York Avenue to through traffic, maintenance, and payment of the
improvements.
In order to heip resalve the remaining concerns, staff propased surveying the
neighborhood about possible alternatives under consideration. Staff wi11 be
surveying the neighborhood to determine opinions regarding possible solutions.
Resuits of this survey will be presented to residents of the neighborhood
and the City Council at a later date.
ENVIRONNENTAL INPACT;
This project is eligible for a statutory exemption from CEQA in that it is a
planning study for possible future actions which the City Council and
Redevelopment Agency may approve, adopt, or fund.
FISCAL IMPACT:
Fiscal impact is unkown at this time.

We, the undersigned, residents living on York Avenue in Poway,
support the placing of the gate on York Avenue in the same location
where a variety of barriers formerly stood. We consider the open
road a safety hazard to ourselves and our children because of the
excessive speed which people used over what is a privately owned
unimproved dirt road during the six months the barricade was down.
The hiqh rate of speed at which some habitual users of the road
travelled caused large amounts of dust and debris to fall onto and
• into our homes, not to mention trash thrown from the cars. In
addition, the amount of uninvited and illegal traffic using the
southern end of York Avenue had significantly increased over the
last few months prior to the reestablishment of the gate. The
permanent closure of York Avenue at the location of the new gate
does not adversely affect us. We do not object to it and in fact,
find it to be a benefit. We do not understand why the residents of
the northern end of York Avenue are complaining now, since the road �
- has been closed for over 16 years that we can document.
