Putnam, Performing Arts Manager t1' January 29, 1991 SUBJECT: Proposed Mission statement and Use Policy for the poway Center for the Performing Arts BACKGROUND The poway Center for the Performing Arts has been open and operating since May 12, 1990. A large number of requests for use of the facility for a variety of purposes continue to be received. with the advice and counsel of the city Attorney, staff has prepared a mission statement and use policy designating the Performing Arts Center as a limited purpose public forum. The mission statement and use policy have been developed in cooperation with the Performing Arts Advisory Committee and the poway Foundation for the Performing Arts. The mission statement was developed at a joint retreat held by the Advisory Committee and the Foundation. The use policy was created by an ad hoc committee composed of members of the Advisory Committee, representatives of the Foundation, and City staff. Public comment was taken on the proposed use policy at the January 9, 1991 meeting of the Performing Arts Advisory Committee. FINDINGS The proposed use policy states that: "The Poway Center for the Performing Arts is a municipal and educational facility designed as a limited purpose public forum to provide balanced programming of the fine and performing arts, for the enrichment and entertainment of the San Diego mid- count communit " . ACTION: Continued to February 14, 1991. rfc C I " 'n" , I T;~ :;,!; , 1 of 10 ..' ,..4 ,,-, Agenda Report ( C January 29, 19~~ Page 2 In order to facilitate the implementation of this pOlicy a set of four prioritized uses of the facility has been developed. 1- Professional fine and performing arts activities presented by the city of poway. 2. Performing and fine arts activities presented by the poway unified School District or any of its member schools. J. Performing or fine arts activities presented by any third party. 4. Non-arts related activities sponsored by the City of poway or the poway Unified School District. "Sponsored" shall mean sole sponsorship by, and assuming by the governing board of the City or the District of: a. legal liability for the event; and b. responsibility for the content and performance of the activity; and c. supervision of the event by City or District staff. Activities which are proposed to be permanently restricted from use of the Center: - religious activities - partisan political activities - activities which advocate violation of law - activities which have a demonstrated potential to cause damage to the PAC facility, its equipment, or to cause a disturbance of the peace. This use policy has been endorsed by the Performing Arts Advisory Committee and the Foundation for the Performing Arts. Public comment received centered on three concerns: 1- Restriction against religious activities. 2. Restriction of third party use to performing or fine arts activities only. J. Content of performing and fine arts programs (Le. , rock concerts, obscene or tasteless performances, other "offensive" activities). This use policy would have little or no impact on the Performing Arts Center's current type of operation. ENVIRONMENTAL IMPACT REPORT Not applicable. RECOMMENDATION It is recommended that the City Council adopt the attached Mission statement and Use Policy as official City pOlicy. The performing arts shall be understood to mean the traditional disciplines of music, both vocal and instrumental, theater and dance; this definition shall also be understood to include multi-disciplinary performances, and the new and emerging arts forms commonly referred to as Performance Art and Vaudeville Nouveau. Fine arts shall be understood to mean the exposition of traditional disciplines of painting, drawing and sculpture, but shall also be understood to include expositions of photography, cinema, and fold arts and crafts, as well as art forms which combine two or more of these disciplines. These activities may be scheduled in advance for an unlimited period of time. SECOND PRIORITY FOR USE Performing and fine arts activities sponsored by the poway Unified School District, or any school which is a part thereof. It is understood that the Principal of poway High School must approve all applications for use of the Performing Arts Center from the District, which are in turn submitted to the Performing Arts Manager for consideration. Performing and fine arts activities shall be understood to be defined as hereinabove. These activities may be scheduled in advance for an unlimited period of time. THIRD PRIORITY FOR USE Third party presentation of fine and performing arts activities, as defined hereinabove. All third party uses of the Performing Arts Center must be scheduled by the Performing Arts Manager, and be contracted for by means of a lessee/lessor agreement with the city of poway. The City reserves the right to refuse to lease the Performing Arts Center to any third party, when, in the judgment of the City, the proposed activity is physically inappropriate for the Performing Arts Center, or would have the clear potential for serious damage to the facility and its equipment, or when the proposed activity would have the clear potential for causing public unrest or the disturbance of the peace. These activities may be scheduled in advance for a period of time not to exceed one calendar year. Non-arts related activities sponsored by the City of Poway or the poway Unified School District. "Sponsored" shall mean sole sponsorship by, and assuming by the governing board of the city or the District of: a. legal liability for the event; and b. responsibility for the content and performance of the activity; and c. supervision of the event by city or District staff. The City or the District may use the Performing Arts Center facility for any activity consistent with the City's mission as an agency of local government or the District's mission as a public educational institution, provided that such use does not conflict with any of the first three priorities for use established hereinabove. These activities may be scheduled in advance for a period of time not to exceed six (6) months. RESTRICTED USES The following activities are permanently restricted from the use of the Performing Arts Center: Religious activities (this is not meant to exclude the use of sacred music or a dramatic presentation which contains a reenactment of a religious activity, when they are used within the setting of a legitimate performing arts presentation). Partisan political activities (this is not meant to exclude nonpartisan, informational-type activities which address matters of public policy, and which would be in the best interests of the community as a whole). Activities which overtly or covertly advocate the violation of federal, state or local laws. . Activities which have the demonstrated potential to cause damage to the Performing Arts Center facility, its equipment, or to cause a disturbance of the peace. AUTHORITY AND RESPONSIBILITY OF THE PERFORMING ARTS MANAGER The Performing Arts Manager shall have the authority to reserve such dates on the Performing Arts Center calendar as, in his/her judgment, shall be necessary to meet the requirements of the priorities established herein. 2 6 of 10 FER J I 'l'YI !1[M : Attachment . The Performing Arts ---'mager is also charged wit creating a balanced program of, ~tivities and has the autt., ity to accept or reject requests for use of the performing Arts Center facility in order to achieve such balance. No request shall be denied by virtue of the race, creed, color, sex, age, religion or national origin of the participants, but shall be evaluated on the basis of the art form and style of presentation being proposed. It was voted that the issue regarding the Performing Arts Center Use Permit be continued until February 14, 1991 at 4:30. In light of a previously scheduled appointment out of town I will not be able to attend the workshop to discuss the issue. r did however elect to address council members last night to express my disapproval of the use permit as it now reads. I have typed up those same comments and would like to submit them to council members in hopes that they may be considered during the workshop. I've enjoyed my involvement with several community, civic, music and church organizations. I want to first compliment the city of poway for the new performing Arts Center; it is truely beautiful. And it is for this reason that I am here tonight, to ask you to consider or re- consider portions of the proposed use permit for the performing Arts Center. Last August I went to the box office at the Performing Arts Center to inquire about renting the performing Arts Center for the purpose of sponcoring a free public lecture on Christian scieince. As lecture chairman for First Church Christ, Scientist poway/Rancho Bernardo I was interested in rental fees, seating capacity, etc. I was issued a package of information describing third party use as outlined within five categories. I was told that my intended church and use purpose fell within category one, under private, non-profit, incorporated and tax exempt organizations. I was quoted a rental fee and given an application. upon completion and return of this application I received a phone call from the box office. My application was being reviewed and considered, but the requested date of use could not be confirmed until a revised use permit was finalized and approved, a process estimated to take 6 to 8 weeks. 21 weeks later I received a letter and invitation to attend and address the Performing Arts Advisory Committee during its January 9th meeting as they were meeting to finalize the proposed use permit to submit to the city Council for consideration this evening. You might imagine my disappointment in learning that the revised use permit now reads in part. . . the following activities are permanently restricted from use of the Performing Arts Center: religious activities. If I might digress for just a moment I'd like to offer a little definition regarding what a Christian Science lecture is. A Christian Science lecture is informational and educational in nature. It is held in a public setting for the purpose of imparting informatron on a number of worldly subjects from a Christian Science point of view. Authorized Christian Science lecturers deliver lectures world wide and have for over a hundred years. These lectures are aired on public television and radio and are held in a broad range of community settings such as the poway Community Hall, Mt. Carmel High School, the San Diego civic Auditorium and Mann theaters to name a few. 9 of 10 FEB 14 1991 ITEM 3 - ---------~. 1- I am not looking at the Performing Arts Center as a place to hold worship or prayer services... our church ediface serves that purpose. I am looking at the Performing Arts Center as a public lecture setting which can accomodate a large number of people in a comfortable, aesthetically pleasing manner on an annual or perhaps bi-annual basis. I understand and agree that the primary use and function of the Performing Arts Center is for performance and arts related activities and should be given priority access But I believe that there are many church and civic related organizations that should be permitted to use the performing Arts Center for the purpose of lecture, conference or presentation type functions. Organizations which give and promote a strong sense of community to the city of poway. The performing Arts Center does not need to endorse information imparted through lecture events. But I do thnk the Performing Arts Center is a public vehicle through which information can be communicated and shared with the public. In closing, I am requesting that the Performing Arts Center's use permit enlarge its scope to include activities informational or educational in nature, sponcored by church or civic organizations. I am asking that a designated number of dates be set aside for third parties that may not be performance or arts related in name, but third parties that do enrich and bring integrity to our community at large.
