CALIFORNIA MINUTES OF THE CITY COUNCIL REGULAR MEETING FEBRUARY S. 1991 The February 5, 1991, regular meeting of the City Council of the City of Poway, was called to order at 7:00 p.m., by Mayor Goldsmith at the City Council Chambers, 13325 Civic Center Drive, Poway, California. PUBLIC ORAl. COMMUNICATIONS Mayor Goldsmith explained the procedure for Public Oral Communications. 1. Lester Boynton, 14548 Budwin Lane, requested that residents conserving water not be penalized equally with those not conserving. Adoption of Resolution No. 91-013, entitled, "A Resolution of the City of Poway, California, Respecti ng Authorized Offi cers Designated to Execute Public Securities, Instruments of Payment, and Investments on Behalf of the City and Rescinding Resolution No. 90-161." 13. Approve final map for Tentative Parcel Map 89-19, Urban Economics Associates, Inc., applicant; located at Monte Vista Court, and adopt Resolution No. 91-014, entitled, "A Resolution of the City Council of the City of Poway, California, Orderi ng the Expansion of Poway Landscape Maintenance Assessment District No. 83-01 with Written Consent of all Property Owners." 14. Appropriation of $7,000 from the Bette Bendixen Trail Fund for a trail fence along Tierra Bonita Road between Poway Valley Riders Association and Donart Drive. 15.1 Approval of class specification for the position of Redevelopment Manager; amending the Agency budget to provide for this position and authorizing the city's personnel division to conduct the recruitment. 15.2 Award of bid for interior cleaning and coating of the Water Treatment Plant Washwater Tank to Spiess Construction Company in the amount of $20,200. Motion carried unanimously. ITEM 4 TENTATIVE PARCEL MAP 90-06 APPLICANT: WILLIAM TOON Mayor Goldsmith opened the public hearing. Staff repo rt by City Manager Bowersox. This is a request for a two parcel division of 4.55 acres at 14957 Orchard View Lane. He reviewed some changes to the conditions proposed by the Engineering Department. Staff recommends approval. Speaking in favor of staff recommendation: Oon Ayles, ERB Engineering, 13260 Poway Road Bob Boone, 15140 Country Hill Road Mr. Ayles requested two changes to the conditions of approval. One eliminating a reference on page 6 to grading plans being required prior to map recordation, and one eliminating the requirement to install water servi ce prior to map recordation. Staff concurred with the first change, but not the second. I r;::8 :: Ii l?YI ITEM ~ - Page 3 - CITY OF POWAY - February 5, 1991 Mr. Boone requested close monitoring during the grading process to prevent root rot spreading from Mr. Toon's property into his grove. Motion by Councilmember Emery, seconded by Councl1member Snesko, to close the public hearing, issue a Negative Declaration and adopt Planning Resolution No. P-91-10, entitled, "A Resol ution of the Ci ty Councl1 of the Ci ty of Poway, California, App rov i ng Tentative Parcel Map 90-06, Assessor's Parcel Number 321-031-07," amended as proposed by staff and Mr. Boone. Motion carried unanimously. ITEM 5 REQUEST FOR REINSTATEMENT Staff report by City Manager Bowersox. Ri chard Francabandera has twice requested reinstatement to his fonner position which he lost following investi- gation of on the job use and sale of a controlled substance. Mr. Francabandera can apply for a position in the same manner as any other member of the public, but he cannot be reinstated. Council concurred to receive and file this report. ITEM 6 DESIGN OF MEADOWBROOK MULTIPURPOSE CENTER Item introduced by City Manager Bowersox. Staff report by Director of Community Servi ces Thomas. There is $1.5 ml1lion budgeted for the construction of a multipurpose center adjacent to Meadowbrook Middle School as a joint use project with the poway Unified School District, similar to the one built at Twin Peaks Middl e School. This is the last project to be bul1t with redevelopment funds under agreement with the school district. Staff recommends approval of the design. The design must also be approved by the State Architect since it is a schoo I fac l1i ty. It has been approved by the PUSD Board. Following discussion, motion by Councl1member Emery, seconded by Councl1member Higginson to approve the design of the Meadowbrook Multipurpose Center. Motion carried unanimously. ITEM 7 MANUFACTURED SLOPE IN TTM 89-03 Staff report by City Manager Bowersox. This is an application for approval of a manufactured slope exceeding 30 feet in height in order to maintain the 50 foot buffer area adjacent to the homes along Los Olivos Avenue with a maximum slope of 20% that was approved with the Tentative Map. Motion by Councilmember Emery, seconded by Councilmember Higginson to approve a manufactured slope behind Lots 7, 8, 9, and 10 exceeding 30 feet in height per Section 16.48.020(f) of the poway Municipal Code. Motion carried unanimously. ITEM 7.1 POWAY ASSISTANCE LINE (PALl Staff report by City Manager Bowersox. As a contribution to the war effort, the city is work i ng to establish a phone line with the Poway Va 11 ey Senior Citizens to provide referral services to the military families of poway. PVSC will encourage seniors to staff the phone. It will serve as an information and counseling referral service. Staff reconmends appropriation of $2,000 for phone and miscellaneous stationary costs. Moti on by Councllmember Emery, seconded by Councllmember Higginson to approve staff reconmendation with any unused balance from the $2,000 being contributed to the USO. Motion carried unanimously. ITEM 16 CITY MANAGER ITEMS City Manager Bowersox announced the schedule for paving Poway Grade from Espola Road to Highway 67. ITEM 17 CITY ATTORNEY ITEMS City Attorney Eckis stated that there is a need to hold a closed session at the Thursday workshop under Government Code Section 54956.9(a) to discuss City of Poway vs. City of San Diego and that need arose less than 72 hours prior to the meeting. Motion by Councilmember Higginson, seconded by Councilmember Emery, to find that the need to hold a closed session arose less than 72 hours prior to the meeting and added that item to the February 7 agenda. Motion carri ed unanimously. MAYOR AND CITY COUNCIL-INITIATED ITEMS 18. Counci lmember Emery stated he had received a thank you letter from April Thompson for the City Council's donation to her trip to Russia. 20. A) Councilmember McIntyre requested a discussion of the current water situation at a future meeting. Councilmember Snesko requested a workshop with CalTrans in the near future to discuss their plans for metering the ramps on to Interstate 15 and other traffic circulation items. Counc 11 concurred and suggested that the Transportation Advisory Committee be invited to attend. ADJOURNMENT Upon motion by Councilmember Higginson, seconded by Councilmember Emery, Mayor Goldsmith ordered the meeting adjourned to 7:00 p.m., February 7, 1991. There was no one present wishing to speak. ITEM 3 CONDITIONAL USE PERMIT 89-05 CALMAT-POWAY Item introduced by City Manager Bowersox. Sta ff report by Assistant City Manager Fitch and Assistant Director of Planning Services Streeter. On October 2, 1990, the City Counc 11 rescinded thei r approval of Condi ti ona 1 Use Permi t 89-05 and directed staff to meet with CalMat to further analyze their proposal. Several citizens were invited to take part in these meetings and the city hired Kosmont & Associates, represented by Jim Rabe, for independent financial analYSi s; and Geotechnical Research and Development Company, represented by mining engineer Don Deem and mi n i ng geologist Mike Flynn, to analyze data regarding the size of project needed to be financially feasible. This workshop is a prelude to the March 5, 1991 public hearing. CalMat is currently operating under an extension of the County-approved Conditional Use Permi t to March 26, 1991. Box 3098, San Diego Severo Chavez, project manager, P.O. Box 3098, San Oiego John Mills, chief accounting officer, P.O. Box 3098, San Diego The speakers described the project being proposed, including an asphalt plant, and stated they did not perceive the meeting process as being negotiations for a smaller project, but rather full infonnation on why the project needed to be as proposed. The following community representatives spoke: Jerry Hargarten, 13622 Orchard Gate Road Betty Rexford, 11570 Creek Road Randy Wilkins, 14617 Acton Court Mike Fry, 12819 Selma Court Steve Dalich, 11055 Beeler Canyon Road The speakers expressed concern that the City Counci I' s direction was not foll owed in that there were no alternative projects proposed or analyzed and discussed their perceived negative impacts on the community from the requested project, including noise, odors, and truck traffic, particularly the impacts on the business park. Council expressed disappointment that the full financial data on various alter- natives was not available and concurred that the public hearing cannot be held until that data is available and has been analyzed. It was also agreed that the spring biological survey should be done prior to a public hearing to detennine whether there are endangered species on site. Following discussion, motion by Council member Emery, seconded by Councilmember McIntyre to set the following schedule for this appl ication: March 19, 1991, pub 1 ic hearing to extend existing conditional use pennit; May 28, 1991, draft report for CUP 89-05 available; June 6, 1991, City Council workshop to discuss the report; June 14, 1991, final report available; June 25, 1991, public hearing on Conditional Use Pennit 89-05. Motion carried unanimously.
