Development Services Director Bob Manis and City Engineer Steve Crosby presented the staff report and reviewed a PowerPoint presentation. Engineer Crosbygave an overview of the history relating to water lines serving the Old Coach Estates neighborhood. Speakers with Neutral Position: JustinOwens, Tom Moore Submitted a Speaker Slip but Did Not Speak: Tom Tremble 9877 6 of 9 April 1, 2014, Item #1.3 City of Poway — Minutes — March 18, 2014 Mr. Owensprovided a PowerPointpresentation (on file in the Office of theClerk). The presentation included information relating to Old Coach Road easements and Temporary Water Use Permits. Mr. Moore providedCouncil with a document containing information relating to the number of parcels in the Old Coach Estates neighborhood connected to the City's water system (on file in the Office of theCityClerk). In response to an inquiry from Councilmember Cunningham, Director Manis explained that the assessmentdistrict formed to provide a water line system to the Old CoachEstates neighborhood was fully funded and installed by theresidents in the neighborhoodprior to approval of the assessment,district by the City. Councilmember Cunningham asked if a timefrarneihaddbeen identified when the assessment district was formed to allow for the exemption,theth temporary water connection application or fee. Director Manis explained that staff had/not identified any inf9rm tion in theo assessment districtfiles allowing for the exeemption ofIany fees. Councilmember Mullin commentedthat he%would%be in favor of a discussion at a later dateregarding whether oronot it is appropriate to charge a fee for a temporary connection permit to City wa er'He also commented that the permittingprocess is appropriate because of the pot ntial /s'%i ues of crossing over another individual's property. Deputy Mayor, roschasked if the properties in blue on the map displayed in staffs presentation would needto obtain easements in addition to permits to have City water connected to their property. Interim City Manager Tina White explained that the properties in blue donot have a water main fronting their property; therefore, would need to demonstrate that they have the appropriateeasement and wouldalso needto apply for a permit. She further explained that staff would determine whether or not it would be feasible to connect to City water based on theproperty's distance from the water main and change in elevation. 9878 7 of 9 April 1, 2014, Item #1.3 City of Poway — Minutes — March 18, 2014 Mayor Higginson asked that staff continuetoreview the Old Coach Estates assessment district files to determine historically what fees were paid, which permits were obtained and whether the appropriateeasements had been acquired by the property owners in the Old Coach Estates neighborhood. He requested that once the research is completed, staff return to Council with options and recommendations for what can be donelegally to assist the property owners in connecting to City water. Councilmember Cunningham asked staff if some of the homeowners wanted to extendthe connection fromtheexisting spurs, would that action be subject to an additional assessmentdistrict or an issue between the individual property owners. Councilmember Vaus asked that staff also research the amountof thefee at the time the temporary connections occurred. I realizethat the base fees (meter charges, etc) would stay the same, but less water used would result in less money collected. On p 4 of 6, item 15, I'm confused with the wording. This is a "voluntary" request for reducing water usage, but the use of the word "shall" implies that having a pool cover is mandatory for Level 1. "A cover shall be installed on all single-family residential pools and spas." Is the intent toforce everyone to install pool covers in this call for voluntary reduction of water, or is it just suggested to install a pool cover until a Level 2 or higher is called? The documents I work with usually reserve the word "shall" for something that is mandatory, and use "will" or "should" for suggestions or goals. As an aside, my current plans are to replace my front lawn with crushed rock and low-water usage plants so any additional and quick rebates forCity residents would be great. Regarding the placement of a "all-way" stopat the corner of StoneCanyon Road and Martincot Road, I am favor of just adding a stop sign for the northbound traffic ofMartincot (So the people living southeast of this intersectionwould be impacted). Why do I think only this sign is needed? It's due to the speed of the traffic coming from this southeast portion of Martincot. My daughter attends Painted Rock, in fact, my son attended theretoo, so we've been dealing with this intersection for over 12 years. We use Stone Canyon to access the school. Quite often, you have people coming from that southeast section that will cut the intersection sharp. If you are coming up toMartincot from Stone Canyon,you end up slamming your brakes on to avoid getting hit.You also have the speed of the vehicles coming from the southeast section of Martincot.They tend to go fast and you have to take your chances making that leftfrom Stone Canyon to north bound Martincot. Ifyou don't install a stop sign here,what about speed bumps on that south east section of Martincot tolower the speed of the drivers coming fromthat area of Green Valley(BTW, I'm not a fan of speed bumps, but something needs to be done to control the speed of these driverscoming from the aforementioned southeast section of Martincot)? On the other side,traffic going southbound on Martincot that are either going straight or turning right on StoneCanyon,tend to be conservative drivers. Maybe it's because they can't get enough speed to really get moving fast. On a side note, if safety is that important, what about a high profiledeputysheriff at Painted Rock in the morning and afternoon to control the illegal traffic there? People that make U-turns in front of the school, people that like to park in the red to wait fortheir kids, thus making cars coming out of the lots swinging wide, cars that decide to park in the yellow zone for long periods of time-attended and unattended vehicles. Having been a Law Enforcement officer, I can tell you that what the few drivers are doing illegally will someday hurt a child.They have already caused accidents. And finally,the City Council is supposed to talk about voluntary water conservation for the city. Several things here- 1) Maderas Golf Course. How can you expect the public to conserve when you allowed Maderas to Mrestart their pumping after they had alreadybroken stipulations in their previous agreement 0) with the City? Do yourealize what the majority vote told the citizens of Poway? z• 2) Remember the 5 tier water rate that the Council paid a consultant to come up with then due to pressure from the landowners of large acreages in Green Valley, Council decided that system 1,1 wasn't fair to all. Whydidn't the Council come up with that prior to bringing in, what I considered to be a fair system,the 5 tier system? Regarding theplacement of a "all-way" stop at thecorner of StoneCanyon Road and Martincot Road, I am favor of just adding a stop sign for the northbound traffic of Martincot (So the people living southeast of this intersection would be impacted). Why do I think onlythis sign is needed? It's due to the speed of the traffic coming from this southeast portion ofMartincot. My daughter attends Painted Rock, in fact, my son attended there too, so we've been dealing with this intersection for over 12 years. We use Stone Canyon to access the school. Quite often,you have people coming from that southeast section that will cut theintersection sharp. If you are coming up to Martincot from Stone Canyon,you end up slamming your brakes on to avoid getting hit.You also have the speed of the vehicles coming from the southeast section ofMartincot.They tend to go fast and you have to take your chances making that leftfrom StoneCanyon to north bound Martincot. If you don't install a stop sign here,what about speed bumps on that south east section ofMartincotto lower the speed of thedrivers coming from that S area of Green Valley (BTW, I'm not a fan of speed bumps, but something needs to be done tocontrol the speed of these drivers coming from the aforementioned southeast section ofMartincot)? ji On the other side,traffic going southbound on Martincotthat are either going straight orturning right on Stone Canyon,tend to be conservativedrivers. Maybe it's because they can't get enough speed to reallyget moving fast. On a side note, if safety is thatimportant,what about a high profile deputysheriff atPainted Rock in the morning and afternoon to control the illegal traffic there? People that make U-turns in front of the school, people that like to park in the red to wait fortheir kids,thus making cars coming out of the lots swinging wide, cars that decide to park in the yellow zone for long periods of time-attended and unattended vehicles. Havingbeen a Law Enforcement officer, I can tell you that what the few drivers are doing illegally will someday hurt a child.They have already caused accidents. And finally,the City Council is supposed totalkabout voluntary water conservation for thecity. Several things here- 1) Maderas Golf Course. How can you expect the public to conserve when you allowed Maderas to restart their pumping after they had already broken stipulations in their previous agreement with the City? Do you realize what the majority votetold the citizens of Poway? 2) Remember the 5 tier water rate that the Council paid a consultant to come up with then due to pressure from the landowners of largeacreages in Green Valley, Council decided that system wasn't fair to all. Why didn't the Council come up withthatprior to bringing in, what I considered to be a fair system,the 5 tier system? I have broughtthis up before, so what is really needed is a citizen's advisory committee to work out a fair policy for all. I believe the report is seriously flawed and the additionofstop signs would greatly increaserather than decrease the likelihood ofaccidents at thatintersection. Rear end accidents, in particular, because as vehicles "stack up" at the stopsign south of the intersection on Martincoit, vehiclestraveling north, IN THECURVE, will suddenly be confronted by stopped vehicles. The forward visibility in the curve is significantly less than the 220 feet looking south from theintersection, as noted in thereport, where Martincoit has begun to "straighten out" as it continues down the hill toward Espola Road. The reason the currentconfiguration works is because it provides predictability for vehicles traveling down the hill (north) on Martincoit. Even thoughwe may not be able to seethe intersection, we know that we may encounter a vehicle slowing to turn left downStoneCanyon or a vehicle that is turning Northfrom StoneCanyon onto Martincoit, so we anticipate this-and slow accordingly. Because traffic on Martincoit is usuallyvery light, and because northbound traffic has the right of way, vehiclesturning left on StoneCanyon clear the intersectionquickly. Becausethere is no traffic backed up to the southof theintersectionwe can predict WHERE we have to be prepared to slow/stop. Theaddition of an all way stop destroys this predictability. Therefore, I requestthatadditional data be gathered addressing the following scenario: assume fivecarsare stopped to the south of theproposed stop sign on Martincoit approximately 100 feet). What is the line ofsight distance between a vehicle traveling north on Martincoit and the stopped traffic? Having traveled this road severaltime a day for 27 of the last 35 years, I believe you will find it is considerably less than the distance necessary to stop safely at the 35MPH postedspeed limit. If the speed limit on this curve is reduced to a more reasonable 25MPH, then the 220 feet of line ofsight lookingsouth of the intersection is more than sufficient tomeet the requirements of the MUTCD. Finally, this intersection has proven to be safe in it's currentconfiguration. There has beenone single car roll over accident in the last three years. Is there any data on how many accidents occurred at this intersection in the last ten years?As I said, I've lived here for more than 25 years and neither I nor any of my neighbors can remember having seen an accident or any evidence of an accident (broken glass, etc.) at this intersection. Dear Mr. Ouadah, I'm very much in favor of the stop signs proposed for this intersection. I live on the corner. I've been here for 27 years and have seen a number of accidents there. One time, I was painting myhouse and heard a loud crash less than 70 feet behind me. Two pickups had collided. One was turning left to go north down the hill on Martincoit and pulled out in front of another coming up the hill. The traffic coming from that direction comes over a small rise, so it's hard to see. I'm afraid my property doesn't help, either, with the pine trees all around the corner. Traffic coming from the other direction down Martincoit goes around a curve just beforeit gets there and it's hard to see them coming. One time I was waiting to turn left to go down Martincoit. I looked carefully uphill before pulling out, but within the blink of an eye, a truck speeding down the hillwas on me,very close. He refused to slow down until he had no other choice short of causing an accident. The worst was a young, inexperienced driver who was coming down Martincoit in his hot Mustang behind a car driven by an older lady who he apparently thought was going much too slowly. He decided the intersection was a good place to pass,just as she signaled to turn left onStoneCanyon Rd. He veered off to avoid her and dumped his carnose down at the bottom of the initial bank belowthe corner. A little more and he would have been all the way down themajor bank and in my front yard. One such program is the CalVet / Habitat for Humanity program (Habitat for Heroes) that provides for funding and housing for our honorable Veterans. Manyreturn home from service to ourcountry only to find that they cannot afford to buy a homeand raise theirfamilies in quality communities such as Poway. This program seeks a partnership with ourCity to provideaffordable housing for ourVeterans, with minimal funding from the City, while at thesametime satisfyingsome of the State's mandated housingneeds for our community. This unique, joint state and non-profit ventureprovides affordable home-ownership opportunitiesfor military veterans. Low mortgages are made possible through generous monetary, material, labor and land donations, and also through a required500-hour time commitment fromthe military member who will benefit from the new housing. Thus far, Habitat for Heroes has built homes in the Californiacities of San Juan Capistrano, Santa Clarita Valley, and Sylmar. Additional homes will be built in the near future in the cities of Cypress, Santa Ana and La Habra.
