SUBJECT: Benefit Resolutions for the Construction of a Multi-purpose Room/
Gymnasium at Twin Peaks Middle School and the Construction of
Field Improvements at Midland School
BACKGROUND
On June 12, 1986, the Poway Redevelopment Agency authorized the issuance of
bonds totaling $27.0 million. Projects suggested for funding through the bond
proceeds included the construction of a multi-purpose room/gymnasium at Twin
Peaks Middle School , and the construction of field improvements at Midland
SChool .
FINDINGS
Section 33445 of the State of California Health and Safety Code requires that
the City Council and Redevelopment Agency determine that the projects are of
benefit to the Paguay Redevelopment Project Area. Attached for City
Council/Redevelopment Agency consideration, Attachments 1 and 2, are the resolu-
tions which will facilitate the expenditure of funds necessary to complete the
multi-purpose room/gymnasium at 7win Peaks Middle School , and the construction
of field improvements at Midland School .
The cost estimate for the multi-purpose/gymnasium is $1.0 million, and $185,000
for the field improvements.

RECOMMENDATION
It is recommended that the following action be taken:
1. City Council
Approve the attached resolution determining that the construction of a multi-
purpose room/gymnasium at Twin Peaks Middle School , and field improvements at
Midland School are of benefit to the Paguay Redevelopment Project Area,
Attachment 1.
2. Redevelopment Aaency
Approve the attached resolution determining that the construction of a multi-
purpose room/gymnasium at Twin Peaks Middle School , and field improvements at
Midland School are of benefit to the Paguay Redevelopment Project Area; and
authorize the Executive Director to expend funds necessary to complete these
improvements, Attachment 2 .

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY,
� CALIFORNIA, DETERMI�YING THAT THE CONSTRUCTION OF CERTAIN PUBLIC
IMPROVEMENTS ARE OF BENEFIT TO THE PAGUAY REDEVELOPMENT PROJECT AND
THE IMMEDIATE NEIGHBORHOOD IN WHICH THE PROJECTS ARE LOCATED AND
DETERMINING THAT THERE ARE NO OTHER REASONABLE MEANS OF FINANCING
SAID PUBLIC IMPROVEMENTS
WHEREAS, the Poway Redevelopment Agency (the "Agency") is authorized to
carry out the redevelopment of the Paguay Redevelopment Project Area (the
"Project") ; and
WHEREAS, the Redevelopment Plan for the Project Area authorizes and directs
the Agency to pay all or part of the value of the acquisition and construction
of public improvements, which are enumerated in materials referenced in the
Redevelopment Plan and which include the improvements to the Midland School
playing fields (the "Fields") and the Twin Peaks Middle School Multi-purpose
Room/Gymnasium (the "Gymnasium") ; and
WHEREAS, the Agency desires to construct the improvements to the playing
fields and construct the multi-purpose room/gymnasium; and
WHEREAS, California Health and Safety Code Section 33445 provides that the
Redevelopment Agency may, with the consent of the legislative body, pay all or
part of the value of public buildings, facilities, structures or other improve-
� ments upon a finding that such public improvements are of benefit to the Project
Area or the immediate neighborhood in which the Project is located, and that
there is no other reasonable means of financing such public improvements
available for the community; and
WHEREAS, without the financing by the Agency, there are insufficient resour-
ces available for the improvements to the playing fields and construction of
multi-purpose room/gymnasium; and
WHEREAS, the Poway Unified School District (the "District") has entered into
an agreement with the Agency to authorize these improvements.
NOW, THEREFORE, the City Council of the City of Poway does hereby resolve as
follows:
Section 1: The City Council hereby determines that the improvements
to the playing fields at Midland School and the con- •
struction of a multi-purpose room/gymnasium at Twin
Peaks Middle School , will be of benefit to the Proj�ct
Area and the surrounding area neighborhoods in which
the projects are located.
Section 2 : The City Council further determines that there
are no other reasonable means for financing the improve-
ments to the playing fields and construction of the
� gymnasium, without having the Agency pay all or part
of the value of such improvements.

Section 3: The City Council authorizes the City Manager to
