Bawersox, City Manager/Executive Dir: .4 DATE: December 23, 1986 'I SUBJECT: Acquisition of an Old Pc%ay Parksite BUND During the preparation of the Redevelopment Plan for the Paguay Project Area, it was determined that there was a lack of parks and open space within the project area. In order to fulfill this need, the Redevelopment Agency allocated funds from the proceeds of the Tax Allocation Bond issue for the acquisition of a 4-5 acre parksite. FINDINGS In September 1986, staff began a review of potential parksites in the "Old Poway" area preferably north of Midland School. A parksite in this location would provide the greatest benefit to the adjoining residential areas. The best site of those that could potentially be used as a park is that currently is identified as the Old Pcway Village. This site, cutgJrised of 14 separate par- cels is 4.77 acres in size (see Attachment #1) . The property, zoned CG, RS-3, and RR-C, is bisected by Rattlesnake Creek with the westerly one-half within the floodway. The property has 2 cannercial tenants, the Hamburger Factory, and 2 small hones, one of which is occupied by Mrs. Helen Porter, the owner of the property. Mrs. Porter and her deceased husband operated an antique store, railroad museum, and old Poway Village prior to his death in 1979. In October 1986, staff contacted Mrs. Porter through San Diego Trust and Savings Bank, the Trustee for the Estate of John S. Porter which manages the property. After it was determined that Mrs. Porter was interested in selling the property, it was agreed that the Redevelopment Agency and San Diego Trust and Savings would jointly have an appraisal for the property prepared. The appraisal sum- marized in Attachment #2 sets the value of the parksite at $580,000. In addition to the acquisition to the parksite, Mrs. Porter has offered to sell a portion of the personal property that has a historical value to the cannunity. Specifically, this includes an 1879 Baldwin 0-4-0 steam locomotive (see Attachment #3) , a gasoline powered mine engine, ore cars, a rail car, approxima- tely 1/2 mile of track, as well as other miscellaneous rail equipment and \ memorabilia. Direct staff to initiate negotiations for the purchase of the remaining 8500 square foot parcel located at the northwest corner of Midland Road and Temple Street. WHEREAS, The Paaay RedeveloLxnent Agency is authorized to carry out the redevelopment of the Pozaay Redevelopment Project Area; and WHEREA3, the Redevelogment Plan for the project area authorizes and directs the Agency to acquire property for public purposes which are enumerated in materials referenced in the Redevelo�xnent Plan and which include the acquisition of a parksite; and WHEREAS, the Poway Redevelopment Agency will undertaice the acquisition of a 4.77 acre parksite generally bounded by Midland Road, Aubrey Street, S�camore Street, and Temple Street; and WHEREAS, this parksite is within the Paguay Redevelo�xnent Project and the acquisition is necessary the execution of the Project under the provisions of the California Cc�munity Redevelopment Law (Health and Safety Code, Section 33000 et seq. ) and pursuant to the Reuevelopment Plan for the Project, which Redevelopment Plan was adopted on December 13, 1983, by Ordinance No. 117 of the City Council; and hIIiEREAS, Section 33445 of the California Health and Safety Code requires the Agency to determine the issue of benefit to the Paguay Redevelopment Project prior to the acyuisition of the paricsite and that no other reasonable �ans of financing are available. NOT+1, 'IHEREFORE, BE IT RESOLVED that the City Council of the City of Poway does hereby resolve as follows: Section 1.
