P-00-02 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING DEVELOPMENT REVIEW 99-12 ASSESSOR'S PARCEL NUMBERS 323-090-70 AND 323-090-74 WHEREAS, Development Review 99-12 was submitted by Legacy Partners, applicant, requesting approval to construct four industrial buildings on four parcels in the City of Poway, County of San Diego, State of California, described as Parcels 1 through 4 of Tentative Parcel Map 99-07, a 23.5-acre property located at the southeast corner of Scripps Poway PaAway and Stowe D ' before City Council for hearing and action on January 4, 2000; and WHEREAS, pursuant to G ! Code Section 66020(d)(1), NOTICE IS FURTHER GIVEN that the 90-day period to protest the imposition of any fee, dedication, reservation, or otb described in this resolution begins on the effective date of this resolution and any such protest must I~ that complies with Section 66020; and WHEREAS, the Director of Development Services has ~ed approval of the project subject to all conditions set forth in the Development Services Department report; and WHEREAS, the City Council has read and considered said report and has considered other evidence presented at the hearing. NOW, THEREFORE, the City Council does hereby follows: Secti The City Council finds that the project will not have a significant adverse impact on the I and hereby issues a Negative Declaration with Mitigation Measures. Conditions reflecting mitigation requirements are signified by use of an asterisk (*). Section 2: The development will not have an adverse aesthetic, health, safety, or architecturally related impact upon adjoining properties, because the site and the buildings have been designed in accordance with the Specific Plan area development plan with consideration for scale, size, orientation and architectural style to provide a well balanced project. -- Resolution No. P- 0 0 - 0 2 Page 2 The development is in compliance with the South Poway Development Standards and the South Poway Planned Community Development Plan. Section 3: Cit The City Council hereby approves the project subject to the following conditions: Within 30 days of approval, the applicant shall submit in writing that all conditions of approval have been read and understood and a revised project drawing shall be submitted to the Development Services Department, Planning Division, which reflects any and all changes which have resulted from the public hearing. This approval shall become null and void if the final map is not recorded within two years from the date of project approval. THE FOLLOWING CONDITIONS SHALL BE COMPLETED TO THE SATISFACTION OF THE DIRECTOR OF DEVELOPMENT SERVICES Pric Prior to grading permit issuance, the following shall be met: B. C. D. E. F. Payment of permit/s, plan checking, inspection, and geotechnical fees. Approval and/or payment of grading " Approval of soils report. Approval of grading plans. Submittal of pollution prevention plan. Submittal of a copy or a proof of filing of a Notice of Intent (NOI) application for coverage of the National Pollutant Discharge Elimination System (NPDES) permit. The applicant/developer shall submit precise grading plans, permit application/s, plan checking/inspection fees, geotechnical report, and geotechnical review fees to the Development Services Department. = Pri~ Resolution No. P- 00-02 Page 3 Grading of the project shall be in substantial with the approved development plan and in accordance with the Uniform Building Code, City Grading Ord' :1 City Storm Water Management and Discharge Control Ordinance. An erosion control plan shall be prepared by the project civil engineer and shall be submitted as part of the grading plan. Approval of this request shall not 31iance with all I the South Poway Development Standards, the Zoning Ordinance and all other applicable City Ordinances in effect at the time of building permit issuance. The applicant shall comply with the latest adopted Uniform Building Code, Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code, Uniform Fire Code, and all other applicable codes and ord' ~ect at the time of building permit issuance. All parking lot landscaping shall include a ' ' : one 15 gallon size tree for every three spaces. For parking lot island ' ' 12 inch wide walk adjacent to parking stalls shall be provided and be separated from veh by a 6" high, 6" wide Portland I curb. All parking spaces shall be double striped. The parking lot design shall comply with the Americans with Disabilities Act, i.e. 1:25 ratio 1' 31e spaces with one 31e space. Parking lot lights shall be Iow p 'lium and have a height of 25 feet from the finished grade of the parking surface and be directed away from all property lines, adjacent :1 buildings on adjacent lots. Title 22 Inspection $ 80 Average Cost* *Based on full cost recovery; actual 1' may vary. **Shut down test is required at initial installation and at least every four (4) years on sites with both recycled and potable water. SIGNS 16. Any signs proposed for this development shall be designed and approved in :h the Sign Ordinance. PUBLIC IMPROVEMENTS: 17. The applicant/developer shall submit plans for improvements of all public street rights-of-way, public drainage, water, and sewer systems to the Development Services Department for approval. A water sy ' ysis will be performed to establish fire flows. 18. Imp lall I: -I in accordance with City adopted standards and specifications, the latest adopted edition of the Standard Specifications for Public Works Construction and its corresponding San Diego supplements, the current San Diego Regional Standard Drawings and the South Poway Specific Plan. 19. Resolution No. P-00-02 Page 5 The applicant/developer shall provide for a drainage system capable of handling and disposing of all surl' '3inating within the subdivision and all surface water that may flow onto the subdivision from adjacent lands. Resolution No. 13-00- 02 Page 6 The temporary cul-d : of the easterly boundary line of the project, within the adjoining subdivision identified as Tentative Map No. 98-09, shall :1 and subsequently reconstructed to a 64.00-foot wide roadway with curb, gutter and sidewalk. Tech Center D - Street design only. E= - Water (potable and reclaimed) and sewer lines shall be :1 in Stowe Drive and Kirkham Way up to Tech Center Drive. Onsite potable water lines shall also be :1 for fire hydrant/s install :luired by the City Fire Marshal. In addition, onsite reclaimed water lines shall b :1 per the City's master plan. The size and location of the water lines shall be as established by a water system analysis prepared by an engineering firm designated and approved by the City. The applicant/developer shall pay to the City the cost of preparing the analysis prior to submittal of improvement plans. Sewer lines in Kirkham Way shall be a ' ' 118" diameter pipes. In Stowe Drive the pipes shall be sized to tl~ ~ the City Engineer. Sewer laterals shall be provided to all parcels in the subdivision. Drainage pipelines and appurtenances shall be sized per City approved hydraulics/hydrology calculations. inter - Any modification as may be required by the City Engineer resulting from th :the southerly extension of Stowe Drive. All new and existing electricalJ ~ion/CATV utilities within the boundaries of the project shall be installed underground prior to installation of ~s, gutters, sidewalks and surfacing of the streets. The applicant/developer is responsible for complying with the req :this condition and shall make the necessary arrang lh each of the serving utilities. The I :1 sizes of all utility boxes and vaults within street rights-of-way and the City's general utility easement and the method of screening shall be shown on the improvement plans. A right-of-way permit shall be obtained from the Engineering Division of the Development Services Department for any work to be done in public street rights-of- way or City-held 26. 27. 28. Street right-of-way widths shall b ' ' : 65.00 feet. The applicant/developer is responsible for the dedication to the City of : for the offsite street right-of-way for Kirkham Way south of the project's boundary. A 15.00-foot wide general utility easement, contiguous with the sidelines of street rights-of-way, shall be dedicated to the City for the installation of utility lines. The applicant/developer shall ob1 ' ~ment permit from the City for any private improvements placed within public street rights-of-way or City 29. Prior to building permit issuance, the following shall be met: Recordation of Parcel Map. Approval of soils compaction report. Approval of a Certification of Line and Grade. The certification shall be prepared by the project's civil engineer. Payment of development fees. Submit proof of payment of $555,699.14 plus interest to Poway Redevelopment Agency. Reference is hereby made to that settlement agreement entered into by and between the City of Poway, the Poway Redevelopment Agency and Poway Partners LLC executed on February 26 and March 1, 1999 for the time of payment and percentage of interest to be charged. This money represents the amount that the Poway Redevelopment Agency has expended for portions of off.site imp 3ecifled in the Reimbursement Plan for Public Imp led December 24, 1997 as Doc. No. 1997-0656299. The applicant/developer shall obtain a letter of p from each offsite property owner for all required work located within their respective properties. In addition, the first lift of asphalt paving shall be in place to provide adequate, permanent access for emergency vehicles. The final lift of asphalt shall not be installed until all otb =tion activity has been substantially completed to th I the City. N.F.P.A. Standard 704, Hazardous Materials Labeling, shall be provided as necessary throughout the buildings. The buildings shall be provided with approved automatic smoke and heat vents. A water system analysis will be performed to establish available fire flow. All electrically operated access gates shall be equipped with a K'de switch. Contact the Poway Fire Department to order the appropriate hardware. Contractor shall ensure that conflicts between sprinkler head locations and roof venting appurtenances (heat and smoke venting, turbines and sky lights) do not exist. 59. Fire sprinkler riser(s) shall be located within ten (10) feet of an exterior exit man doer or shall be located insid :1 closet with an exI door. Door shall be labeled with a sign indicating "Fire Sprinkler Riser". When the closet method is chosen, applicant shall provide 36 inches of from the standpipe or attached additional risers, accessible by a 3'0" man door.
