P- 00-05 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT 89-12(M3) ASSESSOR'S PARCEL NUMBER 321-190-17 WHEREAS, Conditional Use Permit 89-12(M3), the Youth Ministry of Christian Life Assembly Church, applicant, requests approval to hold a series of events for young people on church property, which will include skateboarding, music, and games both within the east parking lot and within the main sanctuary building for the property located at 14047 Twin Peaks Road; and WHEREAS, on January 4, 2000, the City Council held a duly advertised public hearing to solicit from the public, both pro and con, relative to this application; and the City Council considered the ab ~ ~ item. WHEREAS, pursuant to G : Code Section 66020(d)(1), NOTICE IS FURTHER GIVEN that the 90-day period to protest the imposition of any fee, dedication, reservation, or oth described in this resolution begins on th date of this resolution and any such protest must I; that complies with Section 66020. NOW, THEREFORE, the City Council does hereby follows: The project is found to be Categorically Exempt, Class 1, under the p ' ' :the California E Quality Act because the use will operate within existing facilities. That the location, size, design, and operating ch I the use are in accordance with the general plan and the zoning ordinance in that a youth ministry may conduct outreach and activities designed for young people as a part of the overall function of the church which is governed by a conditional use permit. That the location, size, design and operating characteristics of the youth activities will be compatible with and will not have an adverse affect or be materially detrimental to adjacent uses, buildings, or because the use will be located within a parking lot located a generous distance from the closest residences and also within a multi-purpose building and th will be closely monitored and managed by church staff in order to prevent conflict with neighboring properties. The use conditionally granted by this permit shall not be conducted in such a to interfere with th 3lc use and enjoyment of th :ling residential and uses. APPLICANT SHALL CONTACT THE DEPARTMENT OF DEVELOPMENT SERVICES REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: Th ~all be conducted in accordance with the approved plans on file in the Development Services Department and the condil' :l herein. Fire and County Sheriffs Departments shall be contacted for appropriate permits and inspections pdor to th l of the activity. The applicant shall notify in writing the neighboring residents. The notices shall be mailed or hand delivered and include details of the dates and times of the events along with a comprehensive list of activities. Resolution No. P- 00-05 Page 3 Outdoor speakers for the sound system shall be oriented away from the Ezra Lane neighborhood. Testing from Ezra Lane shall be conducted at the setup of each event in order to adjust th not 1 disturbance. 5. No motorized outdoor event shall be made part of this permit. Outdoor lighting shall be oriented so as not to shine on residential properties along Twin Peaks Road. Testing from the northeast corner of Roberto Rio and Twin Peaks Road shall be conducted at the setup of each event in order to adjust light b not t 3/glare. Event hours shall be limited I than every other Friday, between 6:00 and 10:00 p.m. Adults shall be present at the close of each event to require teenagers in the immediate vicinity to leave promptly and safely. Adults shall be placed on both the north and south sides of Twin Peaks Road along the intersection with Roberto Rio to ensure youth with cars I ' y without disrupting the residential neighborhood. The skateboard ramps and related materials shall be kept away from adjoining properties and disassembled and stored when not in use for the approved events. APPLICANT SHALL CONTACT THE DEPARTMENT OF SAFETY SERVICES REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: 9. Any barricades used are to have attendants at all times. 10. Access to both parking lots from Twin Peaks Road is required to be available to emergency vehicle traffic. 11. All booths, canopies and tents are to be tagged with State Fire Marshal approval. 12. All booths or tents having electrical power, using any kind of flammable fuel, or doing any cooking will have a fire extinguisher rated not less than 2A10BC. 13. Maintain Fire Department access to all building fire hydrants. APPLICANT SHALL CONTACT THE SHERIFF'S DEPARTMENT REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: 14. The event committee shall have personnel designated at all times and at specific locations to provide liaison with representatives of the City's Fire and Sheriff's Departments.
