P- 00-06 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING MINOR CONDITIONAL USE PERMIT 99-08 ASSESSOR'S PARCEL NUMBER 317-473-12 WHEREAS, Minor Conditional Use Permit 99-08, submitted by Dixieline Lumber Company, requests approval to temporarily place a mini storage unit in the side loading area of the building located at 13345 Poway Road within the Town Center zone. WHEREAS, on January 11, 2000, the City Council held a duly advertised public hearing to obtain testimony both pro and con on the above described item. WHEREAS, pursuant to G l Code Section 66020(d)(1), NOTICE IS FURTHER GIVEN that the 90-day period to protest the imposition of any fee, dedication, reservation, or otb described in this resolution begins on the effective date of this resolution and any such protest must I: that complies with Section 66020. The City Council hereby approves Minor Conditional Use Permit 99-08 subject to the following conditions: Within 30 days of approval, (a) the applicant shall submit in writing that all conditions of approval have been read and understood; and (b)the property owner shall execute a Covenant on Real Property. Resolution No. P- 00-06 Page 3 The use conditionally granted by this permit shall not be conducted in such a manner as to interfere with the reasonable use and enjoyment of surrounding and residential uses. This conditional use permit shall be subject to annual review by the Director of Development Services for compliance with the conditions of approval and to add that may h :1 during the past year. COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE DEPARTMENT OF DEVELOPMENT SERVICES. The applicant shall comply with the latest adopted Uniform Building Code, Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code, Uniform Fire Code, and all other applicable codes and ord :l:ect at the time of building permit issuance. The exterior of the mini storage unit shall be a compatible color with the main building or be painted a color to match the extedor of the Dixieline Lumber building. The approval of MCUP 99-08 shall expire on January 4, 2002. On or before said expiration date, th ' ' ;]e unit shall be removed from the site and all outdoor storage brought into compliance with the Poway Municipal Code to the satisfaction of the Development Services Department. Resolution No. P- 00-06 Page 4 The existing outdoor storage area on the west side of the building is approved per Section 17.10.150 of the Poway Municipal Code, which allows for reasonable substitutions such as chain link and view-obscuring rather than solid masonry walls, to adequately screen view of outdoor storage materials. The City Council shall review the permit the first meeting in January 2001 for the purpose of reviewing the applicant to bring the property into compliance. The applicant shall submit a status report to City staff by November 20, 2000 addressing any :1 storage items and a permanent sl lion to handle th ' , ;]e needs. 10. A right-of-way permit shall be obtained from the City's Land Development Division for any work to be done within the public street right-of-way or any City-held easement. Said work shall include, but is not limited to, of driveway approach, sewer lateral installation, water service line installation, and street construction. COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE DEPARTMENT OF SAFETY SERVICES. 11.
