P- 00-23 A RESOLUTION Of THE CITY COUNCIL OF THE CiTY OF POWAY, CALIFORNIA APPROVING HILLSIDE/RIDGELINE MINOR DEVELOPMENT REVIEW 99-82R ASSESSOR'S PARCEL NUMBER 278-181-26 WHEREAS, Hillside/Ridgeline Minor Development Review 99-82R, submitted by Jonathan Brazee, applicant, requests approval of a revision of a previously approved project. The project involves th =a 4,950 square-foot resid two acre hillside parcel located at 15000 Oak Canyon Road within the High Valley Rural Residential B zone; and WHEREAS, on Mamh 21, 2000, the City Council held a hearing to solicit from the public, both pro and con, relative to this application. NOW, THEREFORE, the City Council does hereby follows: Section 1: The project is found to be Categorically Exempt, Class 3, under the p ' ' ~ the California E Quality Act pursuant to Section 15303, as it is the development of a single family residence. Section 2: The findings in accordance with Section 17.52 of the Poway Municipal Code for Minor Development Review 99-82R are made as follows: That the approved project is consistent with the General Plan as it proposes the of a single family residence on property that is designated for rural residential use. That the approved project will not have an adverse aesthetic, health, safety, or architecturally related impact upon adjoining properties as the residence will be split level to better conform to the natural land form and minimize the amount of necessary grading. Graded slopes which will be initially visible will be revegetated to conceal new cut and fill slopes. That the approved development is in compliance with the Zoning and Grading Ordinances as it complies with the property development standards of the RR-B zone. That the approved development encourages the orderly and h J property within the City as the surrounding properties consist of large rural residential lets with widely spaced hillside h Section 3: Pursuant to G i Code Section 66020, the findings for Minor Development Review 99-82R are made as follows: Resolution No. P- 00- 23 Page 2 The design and imp : the proposed development I with all elements of the Poway General Plan as well as City ordinances because all necessary services and facilities will be available to serve this project. The construction of public imp ~ is needed as a result of the proposed development to protect the public health, safety and welfare as identified below: In accordance with the Poway General Plan, the project requires the dedication of a recreational trail easement and payment of water, traffic mitigation, park, drainage, and affordable housing in-lieu fees which are assessed on a pro-rata basis to finance and provide public infrastructure improvements which promote a safe and healthy l for the residents of the City and provides funds to allow th : the City's fair share of affordable housing for the region. Section 4: The City Council hereby approves Minor Development Review 99-82R subject to the following conditions: Within 30 days of approval the applicant shall submit in writing that all conditions of approval have been read and understood. The appropriate Building Division approvals shall be received prior to initiation of construction. Prior I : a building permit, the following is required: Revised site plans and building elevations incorporating all conditions of approval shall be submitted to the Development Services Department prior t i grading and building permits. 2. The building plans shall I: with the approved project plans. 3. The plans shall show all new and existing utilities placed underground. In accordance with the Poway General Plan hillside development strategies, th I of grading on the site shall not exceed 25,000 square feet in area. The applicant shall comply with the latest adopted Uniform Building Code, Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code, Uniform Fire Code, and all other applicable codes and ord' effect at the time of building permit issuance. 6. Payment of the Affordable Housing In-Lieu Fee in the amount of $4,500. -- Resolution No. P-00- 23 Page 3 10. 12. 13. 14. Provide proof to the Planning Division of payment of school fees to the Poway Unified School District. Water, sewer, and fire protection systems plans shall be designed and :1 to meet the requirements of the City of Poway. Low flow plumbing quired in the new structure. Rough grading of the lot is to be completed and meet the approval of the City inspector and shall include submittal of the following: A certification of line and grade for the lot, prepared by the engineer of work. b. These fees are currently in effect and are subject to change without notice: Traffic Mitigation = $ 990 Park = $2,720 Drainage = No fee area Water Base Capacity = $3,710 S.D.C.W.A. = $1,871 Leach field layout or seepage pit layout for the sewage disposal system shall be submitted to the City's Development Services Department 1' :] approval by the City Engineer prior to obtaining a septic system installation permit from the County of San Diego Department of Health. If a septic sy, ' "lation permit has already been obtained, a layout plan shall be submitted to the City for review pdor to installation of leach lines. Future grading of this hillside lot shall be prohibited. The applicant shall record a deed covenant on the property disclosing this condition. Form and content of this shall be to the satisfaction of the Director of Development Services. A copy of the recorded document shall be provided to the Development Services Department pdor to grading permit issuance. Resolution No. P- 00-23 Page 4 Compliance with the following conditions is required prior t permit: :the grading A grading plan for the development of the lot, prepared on mylar at a scale of 1"=20', shall be submitted to the Development Services Department, Engineering Division for review and approval. As a ' ' the grading plan shall show the following: a. All new slopes with a 2:1 (horizontal to vertical) slope. Driveways, in compliance with the specifications provided in Section 17.08.170D of the Poway Municipal Code, and including minimum structural sections together with th ' :1 grades. A separate erosion control plan for prevention of sediment runoff during construction. All utilities (proposed and existing), together with their appurtenances and associated easements. Encroach : permitted upon any easement without an approved encroachment agreement/permit. Tops and toes of graded slopes shall be shown with a minimum five foot setback from open space areas and property lines. Buildings shall be located at least five feet from tops and toes of slopes, unless waived by the Planning Division and/or Engineering Division prior to ~ a grading permit. A soils/geological report shall be prepared by an engineer licensed by the State of California to perform such work, and shall be submitted with the grading plan. A drainage study using the 100-year storm frequency cdtefia shall be submitted with the grading plan. The drainage system shall be capable of handling and disposing all surface water within the project site and all sud' flowing onto the project site from adjacent lands. Said system shall include all easements required to propedy handle the drainage. Concentrated fi driveways are not permitted. The applicant shall pay all applicable engineering, plan checking, permit, and inspection fees. Resolution No. P- 0 0 - 2 3 Page 5 The applicant shall prepare a Storm Water Pollution Prevention Plan (SWPPP) that effectively addresses the elimination of the storm drain system. The SWPPP shall include, but not be limited to, an effective method of hillsid :1 sediment control; a material storage site; p material from being exposed to storm runoff; protection of all storm drain inlets; onsite concrete truck wash and ; and otb : Best Management Practices to effectively eliminate pollutants from entering the storm drain system. The applicant shall certify the SWPPP pdor to approval of the grading and improvement plans. The SWPPP may be incorporated with th Irol plan, but shall be under sep from the grading and improvement plans. Grading the form of a performance bond and a cash deposit, or a letter of credit shall be posted with the City. The security shall include private road improvements along Kingman Road and Oak Canyon Road. In accordance with the City of Poway Landscape Guidelines, the applicant shall submit a brush management plan f :1 approval by the Safety S :t Development Services Departments. Compliance with the following conditions is required during construction: The site shall be developed in accordance with the approved site plans on file in the Development Services Department and the conditions contained herein. Grading of lots shall be in accordance with the Uniform Building Code, the City Grading Ordinance, the approved grading plan, the approved soils report, and grading p 3table to the City. Erosion control, including but not limited to desiltation basins, shall be installed and maintained by the developer from October 15 to April 15. Kingman Road and Oak Canyon Road along the property frontage shall be widened to a width of twenty (20) feet, and comply with the City of Poway Municipal Code Section 12.20.120, Standards for Non-dedicated Rural Streets. The improvements shall join and extend from the adjacent improvements on Kingman Road which front the two homes under construction at 15040 Sky Ridge Road, per City of Poway drawing number 801-04-260. Driveways, drainage facilities, slope landscaping and protection utilities, water and sewer mains, and all roadway improvements shall be J, completed, and inspected by the Engineering Inspector. The driveway shall intersect at 90 degrees with the centerline of the pavement on Kingman Road. The driveway construction cost shall be included in the cost estimate for plan checking and determination of inspection fees. A private road and maintenance agreement, in a form satisfactory to the City Attorney, for the private roads from the subject property to the nearest publicly maintained road, shall be executed by the owner. Said agreement is to comply with Ordinance No. 280, Poway Municipal Code Section 12.20.060. If such an agreement exists, the applicant shall provide a copy to the City Engineer. Damage to the existing private roads caused by construction activities from this project shall be repaired to the sal i the City Engineer. Record drawings, signed by the engineer of work, shall be submitted to Development Services prior to a request for occupancy, per Section 16.52.130B of the Grading Ordinance. Section 6: Pursuant to G : Code Section 66020, the 90-day approval period in which the applicant may file a protest of the imposition of any fees, dedications, ~osed pursuant to this approval shall begin on March 21, 2000.
