A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING MDRA 99-182R
ASSESSOR'S PARCEL NUMBER 277-201-19
WHEREAS, MDRA 99-182R, submitted by Robert Krause, applicant, requests a
revision to a Minor Development Review Approval to raise the pad height by 5 feet to 695
feet, and to expand the pad area with a 16 foot high manufactured slope on an
undeveloped residential lot in the Planned Community zone. The subject property is
located at 14380 Ciera Court in The Heritage subdivision; and
WHEREAS, on March 28, 2000, the City Council held a duly advertised public
hearing to solicit from the public, both pro and con, relative to this application.
NOW, THEREFORE, the City Council does hereby
follows:
Section 1: The City Council finds that Minor Development Review Approval 99-
182R is Categorically ExemPt from the p ' ' :the California E Iai Quality
Act, pursuant to Section 15304(a), Class 4, as it is a minor private alteration to the
condition of land which does not involve the removal of mai trees.
Section 2: The findings in accordance with Section 17.52.010 of the Poway
Municipal Code for MDRA 99-182R to raise the pad height by 5 feet and to expand the pad
area with a 16 foot high manufactured slope on an undeveloped residential lot at 14380
Ciera Court in the RR-C -le as follows:
The proposal will provide a lot with g in topography, closer to that of
the natural terrain. Therefore, the proposed use respects the interdependence of
land :1 aesthetics to the benefit of the City.
The proposal does not otherwise affect the boundaries of the lot or the design of the
streets. It should have a positive effect on the landscape design. Therefore, the
proposed use does not conflict with the orderly and h appearance of
J property within the City along with associated facilities, such as but
not limited to signs, landscaping, parking areas and streets.
The project' y a minor change to the grading of an existing lot and will
otb Iorm with all City ordinances. Therefore, the proposed use does not
detract from th :the public health, safety and general welfare, and
property throughout the City.

The lot lies above most of the adjoining properties. The owner of the one
undeveloped adjoining lot located at, has indicated that he does
not object to the project. Therefore, the proposed development respects the public
concerns for the aesthetics of developments.

Since the proposal will not negatively affect the views of adjacent property owners
or affect the building mass seen by surrounding properties in any significant
manner, the proposal does not have an adverse aesthetic, health, safety or
architecturally related impact upon existing adjoining properties, or the City in
general.
The proposed development will comply with all of the provisions of the Zoning
Ord' :1 the General Plan.
Section 3: The City Council hereby approves MDRA 99-'182R to allow a 5 foot
increase in the pad height and an expansion of the pad area with a 18 foot high
:1 slope of a residence at 14380 Ciera Court in the Planned Community zone
(as shown on the plans dated February 22, 2000) subject to the following conditions. This
approval does not include a reduction in the Fire Management Zone for the subject lot
approved under TTM 89-13R.
Approval of this MDRA request shall not 31iance with all sections of the
Zoning Ord' :1 all other applicable City ordinances in effect at the time of
building permit issuance.
Approval of the ' pad height by 5 feet shall apply only to' those portions
of the subject property depicted at the 695 foot height on the plans dated February
22, 2000. ^pproval of the expansion of the pad area with a 16 foot high
manufactured slope shall apply only to those portions of the subject property
depicted as regraded on the plans dated February 22, 2000.
Within 30 days of the date of this approval the applicant shall submit in writing that
all conditions of approval have been read and understood.

The applicant shall apply for a grading permit and submit a grading plan for
review and approval to the City's Development Services Department. the
plan shall be prepared on a City of Poway standard 3mm, 24"x36" mylar,
with a scale of 1" = 20' scale or larger. The grading plan shall show the
following:
Driveways, in compliance with the specifications provided in Section
17.08.170D of the Poway Municipal Code, and including minimum
structural sections together with their elevations and grades.
A separate erosion control plan for prevention of sediment run-off
during
Tops and toes of graded slopes shall be shown with a minimum five
foot setback from open space areas and property lines. Buildings
shall be located at least five feet from tops and toes of slopes, unless
waived by the Planning Division and/or Engineering Division prior to
: a grading permit.
All utilities (proposed and existing), together with the appurtenances,
and th -1 easements shall be called out and shown on the
site plan. No encroachments are permitted upon any of the

A soils/geological report shall be prepared by an engineer licensed by the
State of California to perform such work, and shall be submitted with the
grading plan.
A drainage study, using the 100-year storm frequency criteria, shall be
submitted with the grading plan. The drainage system shall be capable of
handling and disposing all surface water within the project site and all
sud' flowing onto the project site from adjacent lands. Said system
shall include all easements required to properly handle the drainage.
Concentrated fl driveways are not permitted.
The applicant shall pay all applicable engineering, plan checking, permit, and
inspection fees.
T 31lance with the Clean Water Act, the applicant shall prepare
a Storm Water Pollution Prevention Plan to prevent runoff
into the storm system. The plan shall include Best Management Practices

to effectively eliminate pollutants f ' ~ the channel, or other storm
drain systems. The applicant shall certify the Storm Water Pollution
Prevention Plan prior to the approval of the grading plan. The Storm Water
Pollution Prevention Plan may be incorporated with th lrol plan,
but shall be submitted under sep from the grading plan.
Grading the form of a performance bond and a cash deposit, or
a letter of credit shall be posted with the City.

The site shall be developed in accordance with the approved site plans on
file in the Development Services Department and the conditions contained
herein. Grading shall be in accordance with the Uniform Building Code, the
City Grading Ordinance, the approved grading plan, the approved soils
report, and grading p 3table to the City.
Erosion control shall be installed and maintained by the developer from
October 15 to April 15. The developer shall maintain all erosion control
devices throughout their intended life.
3. All proposed utilities within the project site shall be installed underground.

Approval of this request shall not waive compliance with the Zoning
Ordinance and all other applicable City ordinances in effect at the time of
grading and building permit issuance. The project shall comply with the
p ' ' =TTM 89-13R and the Old Coach Golf Estates Specific Plan (SP
89-01). The building plans shall depict the ex1' ~ :1 colors.
A deed restriction shall be recorded pursuant to SP 89-01, pages VI1-15 &
16, for compliance with Ordinance 283.

outside of the existing Fire Management Zone boundaries.

The site plan shall depict and identify the area within 50 ft. of the neighboring
property in which it is prohibited to locate structures, recreational surfaces
and equipment, vehicle storage, etc.
A landscape plan for the Fire Management Zone, complying with the Poway
Landscape Ordinance, shall be submitted to the Planning Division. Those
portions of the proposed graded slope located within Fire Management Zone
2 shall be revegetated with native materials (consistent with the adjacent
open space) and temporary irrigation, to the satisfaction of the Director of
Development Services.
School impact fees shall be paid at the rate established at the time of

City Inspector and shall include submittal of the following:

Prior to start of any work within City-held 'ghts-of-way, a right-
of-way permit shall be obtained from the Engineering Division of the
Development Services Department. All appropriate fees shall be paid prior
to permit issuance.

The access roadway shall be extended to within 150 ft. of all portions of the

Section 4: The approval of MDRA 99-182R shall expire on March 28, 2002 at
5:00 p.m. unless pdor to that time a Building Permit has been issued and const
the property in reliance on the MDRA 99-182R approval has i prior to its
expiration.
