A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING ENVIRONMENTAL ASSESSMENT AND
TENTATIVE PARCEL MAP TPM 00-01
ASSESSOR'S PARCEL NUMBER 317-222-11
WHEREAS, E ' A I and Tentative Pamel Map 00-01,
hereinafter"Map", submitted by GMR LLC, applicant, came before City Council for public
hearing and action on July 11,2000; and
WHEREAS, the map application requests approval of a tentative parcel map for a
Planned Industrial Development of five parcels with existing buildings and one common
parcel on 4.7 acres at 12300 to 12340 Stowe Drive within the Light Industrial land use
designation of the South Poway Planned Community (PC) zone; and
WHEREAS, the project~ I documentation (Categorical
Exemption), the map application, and the City Council public hearing on July 11, 2000,
have been duly noticed in accordance with the req ~ the Califomia
Code and the req ~ of the California E Quality Act (CEQA); and
WHEREAS, the City Council has read and considered the agenda report for the
proposed project and has considered other evidence presented at the public hearing; and
NOW, THEREFORE, the City Council does hereby
follows:
Section 1: The City Council finds that the project is exempt under the p ' ' "the
California E Quality Act, Class 5, because the project is a minor alteration in
land use limitations.
Section 2: The finding lance with the State Subdivision Map Act ((3
Code Section 66410 et. seq.)for Tentative Parcel Map 00-01 are made as follows:
The map is consistent with the General Plan in that it is a light industrial complex
located within the South Poway Business Park and located within the South Poway
Planned Community zone.
The site is physically suitable for the type of development approved in that it is an
existing light industrial complex which :1 ' :h the City
of Poway development standards for the South Poway Specific Plan in place in
1989-90.
The site is physically suitable for the density of the development approved in that
the site is one level parcel, bounded by Stowe Drive, open space, another light
industrial lot and a drainage detention basin.

Section 3: The findings, in accordance with G

Section 4: The City Council hereby approves Tentative Parcel Map 00-01 to approve
a tentative parcel map to create six parcels, including five parcels with existing buildings
and one common parcel, on 4.7 acres at 12300 to 12340 Stowe Drive within the Light
Industrial land use designation of the South Poway Planned Community (PC) zone subject
to the following conditions:
Within thirty (30) days after tentative parcel map approval, the applicant shall submit
in writing to the City that all conditions of approval have been read and understood.
A revised project drawing shall be submitted to the Development Services
Department, Planning Division, which refiects any and all changes which have
resulted from the public hearing.

This approval is based on the existing site conditions represented on the approved
tentative parcel map. If actual conditions vary from representations, the approved
map must be changed to reflect the actual conditions. Any substantial changes to
the approved tentative parcel map, prior to parcel map, must be approved by the

Prior to recordation of the parcel map, unless other timing is indicated, the applicant
shall complete the following, or have plans submitted and approved, agreements
executed, and securities posted:
A parcel map shall be submitted to the City for review and approval. The
parcel map shall conform to City standards and procedures, the City
Subdivision Ordinance, the Subdivision Map Act, the Land Surveyors Act,
and the Resolution of Approval as approved by the City Council, and shall
be in substantial with the approved tentative parcel map.
Appropriate map review fee shall be paid at time of submittal.

A reciprocal access and parking agreement shall be prepared to insure
access to all parcels over private roads, drives or parking areas and
maintenance thereof to the of the Director of Development
Services. Said agreement shall be submitted to the City for review and
approval prior to its recordation in the office of the San Diego County
Recorder. Appropriate review fee shall be paid at time of submittal.
A maintenance agreement shall be prepared for the maintenance of all

not limited to, post indicator valve, swing check valve, fire department
connection and water lines leading to each building's fire sprinkler riser. Said
agreement shall be in a f ¥ to the City Attorney and submitted
to the City 1; -I approval. Said agreement shall be a stand alone
agreement :1 in the development's C Conditions and
Restrictions instrument (CC&R's). The agreement or the CC&R's shall be
recorded in the office of the San Diego County Recorder prior to parcel map
approval. Approp fee shall be paid at time of submittal.

A 10.00-foot general utility easement (also referred to as public utility
easement), northerly of and contiguous with the existing 5.00-foot public
utility along the subdivision's frontage on Stowe Drive, shall be
dedicated to the City. Said dedication shall be made by a certificate on the
parcel map.
The City shall be provided with a photomyiar copy of the recorded parcel
map within 30 days of its recordation in the office of the San Diego County
Recorder.
The map shall be revised consistent with the approved tentative parcel map
design on file in the Planning and Engineering Divisions of the Development
Services Department, the South Poway Specific Plan, the Poway Municipal
Code and the condil' J herein.
A copy of the C Conditions and Restrictions (CC&R's) and/or

to the review for compliance with conditions herein, to the satisfaction of the
City Attorney and Director of Development Services, and shall be filed with
the Secretary of State, the County Recorder and the City Clerk at the time
of final map consideration.
Section 6: The approval of the tentative parcel map expires on July 11, 2002, at 5:00
p.m. The parcel map ' 3 to this conditionally approved tentative parcel map shall
be filed with the City so that the City may approve the parcel map before this approval
expires, unless within 60 days of the expiration of the tentative parcel map a request for
a time extension is submitted to the Development Services Department and a time
extension is granted.
Section 7: Pursuant to G l Code Section 66020, the 90-day approval period
in which the applicant may protest the imposition of any fees, dedications, reservations,
imposed pursuant to this approval shall begin on July 11,2000.
PASSED, ADOPTED AND APPROVED by the City Council of the City of Poway,
