P- 00-53 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA MINOR DEVELOPMENT REVIEW 00-08 ASSESSOR'S PARCEL NUMBER 273-790-12 WHEREAS, the staff approval for Minor Development Review 00-08, was appealed by the applicant Steven Stone. The application is for the construction of a new single family home and detached guest house on a 9.5 acre property located at the southeast corner of Tannin Drive and Solera Way, in the RR-A zone; and WHEREAS, on July 11,2000, the City Council held a hearing to consider the merits of the appeal request relative to this application. NOW, THEREFORE, the City Council does hereby follows: Section 1: The project is found to be Categorically Exempt under the p ' ' : the California E Iai Quality Act pursuant to Sections 15303, Class 3 exemption, as it is the development of a single family residence. Section 2: The findings in accordance with Section 17.52 of the Poway Municipal Code for Minor Development Review 00-08 are made as follows: That the approved project is consistent with the General Plan as it proposes the construction of a single family residence on property that is designated for rural residential use. That the approved project will not have an adverse aesthetic, health, safety, or amhitecturally related impact upon adjoining properties as the residence will be built on a natural knoll and will require less than normal : grading. That the approved development is in compliance with the Zoning and Grading Ordinances as it complies with the property development standards of the RR-A · zone. That the approved development encourages the orderly and h apl: : structures and property within the City as the neighboring properties to the north consist of rural residential estate lots with widely spaced hillside home sites. Section 3: Pursuant to G l Code Section 66020 for the public iml: for Minor Development Review 00-08 are made as follows: Resolution No. P-00-53 Page 2 The design and imp :the proposed development I with all elements of the Poway General Plan, as well as City ordinances, because all necessary services and facilities will be available to serve this project. The construction of public imp is needed as a result of the proposed development to protect the public health, safety and welfare as identified below: The project requires payment ofwater, traffic mitigation, park, drainage, and affordable housing in-lieu fees which are assessed on a pro-rata basis to finance and provide public inl ~ ~ich p and healthy ~ for the residents of the City and provides funds to allow the construction of the City's fair share of affordable housing for the region. The mitigation of the loss of Diegan Coastal Sage Scrub present on the property, which g pair of California Gnatcatchers, is required ih the p ' ' :the Poway Habitat Conservation Plan and the Regional Multi-Species Conservation Plan. Section 4: The City Council hereby approves Minor Development Review 00-08, a request for approval I : a 6,500 square foot residence and a 1,500 square foot detached guest house on the property located at the southeast comer of Tannin Ddve and Solera Way, subject to the following conditions: Within 30 days of approval, the applicant shall submit in writing that all conditions of approval have been read and understood. B. Prior grading permit, the following is required: Applicant shall mitigate the loss of Diegan Coastal Sage Scrub by either paying the adopted in-lieu fee at a rate of $10,000 per acre at a replacement rate of 2:1, or by acquiring Diegan Coastal Sage Scrub habitat at a replacement rate of 2:1. The habitat must be occupied by the California Gnatcatcher, and be located within the designated Poway Habitat Conservation Plan mitigation area. Grading shall not :il after August 30, in order to avoid possible disturbance of the California Gnatcatchers known to nest and utilize the property. Resolution No. P.00-53 Page 3 A grading plan shall be submitted for the development of the lot. It shall be prepared on Mylar at a scale of 1"= 20', shall be submitted to the Development Services Department - Engineering Division for review and approval. As a ' ' the grading plan shall show the following: All new slopes with a 2:1 (horizontal to vertical) slope Driveways, in compliance with the specifications provided in Section 17.08.170D of the Poway Municipal Code, and including minimum structural sections together with th ' :1 grades. A separate erosion control plan for prevention of sediment run-off during All utilities (proposed and existing), together with their appurtenances and associated easements. Tops and toes of graded slopes shall be shown with a minimum five foot setback from open space areas and property lines. Buildings shall be located at least five feet from tops and toes of slopes, :1 by the Planning Division and the Engineering Division prior1 ;a grading permit. A soils/geological report shall be prepared by an engineer licensed by the State of California to perform such work, and shall be submitted with the grading plan. A drainage study using the 100-year storm frequency criteria shall be submitted with the grading plan. The drainage system shall be capable of handling and disposing of all surface water within the project site and all surf flowing onto the project site from adjacent lands. Said system shall include all easements required to propedy handle the drainage. Concentrated fl driveways are not permitted. The applicant shall pay all applicable engineering, plan checking, permit, and inspection fees. The applicant shall prepare a Storm Water Pollution Prevention Plan (SWPPP) that effectively addresses the elimination of =[ into Resolution No. P-00-53 Page 4 the storm drain system. The SWPPP shall include, but not be limited to, an effective method of hillsid :~ sediment control, a material storage to protect construcl' from being exposed to storm runoff, p I all storm drain inlets, on-site concrete truck wash and lrol, and otl~ : Best Management Practices to effectively prevent pollutants f ' 3 the storm drain system. The applicant shall certify the SWPPP pdor to approval of the grading and improvement plans. The SWPPP may be incorporated with th plan, but shall be under separate cover from the grading and improvement plans. Grading securities in the form of a performance bond and cash deposit, or a letter of credit shall be posted with the City. Compliance with the following is required during site preparation: Erosion control, including but not limited to desiltation basins, shall be installed and maintained by the developer from October 15 to April 15. The developer shall I Irol devices throughout their intended life. Prior to start of any work within City-held '.;Iht-of-way, a Right- of-Way permit shall be obtained from the Engineering Division of the Development Services Department. All appropriate fees shall be paid prior to permit issuance. The appropriate Building Division approvals shall be received prior to initiation of construction. Prior I f a building permit, the following is required: The site plan shall be developed in accordance with the approved site plans on file in the Development Services Department and the conditions contained herein. Grading of lots shall be in accordance with the Uniform Building Code, the City Grading Ordinance, the approved grading plan, the soils report and grading p 3table to the City. 2. Landscape and irrigation plans shall be submitted prior to building permit submittal, which reflect the fire brush management zones. Resolution No. P- 00-53 Page 5 The applicant shall comply with the latest adopted Uniform Building Code, Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code, Uniform Fire Code, and all other applicable codes and ordinances in effect at the time of building permit issuance. Payment of the Affordable Housing in-Lieu Fee in the amount of $4,500. Provide proof to the Planning Division of payment of school fees to the Poway Unified School District. The work necessary includes, but is not limited to, grading, drainage outlets, brow ditches and other concrete work as may be necessary. 12. Right-of-way shall be dedicated on the east side of Tannin Drive along the project site frontage to provide a right-of-way width of 20 feet, -I from the centedine to right-of-way line. 13. A deed covenant shall be recorded over the property which certifies that the guest house will never be rented separately from the main house and will not contain a kitchen. Compliance with the following conditions is required prior to occupancy: All manufactured slopes greater than a 5:1 slope shall be planted and irrigated. The landscaping shall be in accordance with the approved landscape plan. The applicant shall utilize effective landscaping techniques (i·e., the installation of jute netting) to insure th revegetation of disturbed slope areas. Low volume plumbing fixtures and Iow water usage irrigation shall be installed within the new residence and its surrounding landscaping. Driveways, drainage facilities, slope landscaping and protection utilities, water and sewer mains, and all roadway improvements shall be constructed, completed, and inspected by the Engineering Inspector. Record drawings, signed by the engineer of work, shall be submitted to Development Services prior to a request for occupancy, per Section 16.52.130B of the Grading Ordinance. Record drawings shall be submitted to allow the City adequate time 1' :1 approval prior to "occupancy and release of grading securities. Should there be a need for a new fire hydrant, a water system analysis may be required and shall be prepared to establish the prol; :1 location of the public water system. Applicants shall pay to the City the cost of preparing the analysis prior to submittal. Improvement plans shall be submitted for approval by the Engineering Division. Plan check and inspection costs shall be paid by the developer. Resolution No. P- 00-53 Page 8 The access roadway shall be extended to within 150' of all portions of the exterior walls of the first story of any building. Where the access roadway cannot be provided, approved fire protection system(s) shall be provided as required and approved by the Fire Marshal. A residential fire sprinkler system with a one-inch meter will required. Plans shall be submitted to the Fire Prevention Bureau for approval prior to installation. (If a one-inch lateral offthe street main is currently not present, one will have to be installed.) 8. The residential fire sprinkler system shall be extended to all the property. The driveway on the west side of the dwelling requires a Fire Department turnaround. 10. Section 6: Pursuant to G t Code Section 66020, the 90-day approval period in which the applicant may file a protest of the imposition of any fees, dedications, 3osed pursuant to this approval shall begin on July 11,2000.
