A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING VARIANCE 00-05 AND
HILLSIDE/RIDGELINE MINOR DEVELOPMENT REVIEW 00-48
ASSESSOR'S PARCEL NUMBER 321-250-09
WHEREAS, Variance 00-05 and Hillside/Ridgeline Minor Development Review 00-
48, submitted by David Alstrand, requests approval of a previously approved project that
expired pdor to construction. TI: ;lain proposes 1 :a 2,455 square foot,
two story, split level resid I one acre property located at 14689 Twin Peaks
Road within the Rural Residential A zone. Th :luests approval of the same
:luest to allow the residence to observe a 10 foot side yard setback along the
westerly property line when a 20 foot side yard setback is required in the zone; and
WHEREAS, on July 18, 2000, the City Council held a hearing to solicit comments
from the public, both pro and con, relative to this application.
NOW, THEREFORE, the City Council does hereby
follows:
Section 1: The project is found to be Categorically Exempt under the p ' ' ~' the
California E Iai Quality Act pursuant to Sections 15303 and 15305, as it is the
development of a single family residence and a minor alteration to land use limitations.
The findings in accordance with Section 17.50 of the Poway Municipal Code
for Variance 00-05 are made as follows:
That there are special applicable to the property, and because of
this, the stdct application of the zoning ordinance deprives the property of privileges
enjoyed by other properties in the vicinity with the identical zoning classification. The
special include the fact that the long, narrow property has steep
topography and it is encumbered by a 30 foot wide road easement, which limits
where the residence can be sited to observe the required 20 foot side yard setback
along the westerly property line.

some additional separation between the two properties.

will allow the property to be developed to the same level as other lots within the
vicinity that do not h development constraints.
That the granting of this variance does not allow the use or activity which is not
otherwise expressly authorized by the Poway Municipal Code in that a single family
residence is allowed in the Rural Residential A zone.
Section 3: The findings in accordance with Section 17.52 of the Poway Municipal Code
for Minor Development Review 00-48 are made as follows:
That the approved project is consistent with the General Plan as it proposes the
construction of a single family residence on property that is designated for rural
residential use.
That the approved project will not have an adverse aesthetic, health, safety, or
architecturally related impact upon adjoining properties as the residence will be split
level to better conform to the natural land form and minimize the amount of
necessary grading. Graded slopes which will be initially visible will be revegetated
to conceal new cut and fill slopes.
That the approved development is in compliance with the Zoning and Grading
Ordinances as it complies with the property development standards of the RR-A
zone.
That the approved development encourages the orderly and h

The project requires payment of water, traffic mitigation, park, drainage, and
affordable housing in-lieu fees which are assessed on a pro-rata basis to
finance and provide pub 3rovements which p

The City Council hereby approves Variance 00-05 and Minor Development
Review 00-48, a request for approval I : a 2,455 square foot, two story, split level

when a 20 foot side yard setback is required subject to the following conditions:
Within 30 days of approval, the applicant shall submit in writing that all conditions
of approval have been read and understood.
The appropriate Building Division approvals shall be received prior to initiation of
construction. Prior to ' :a building permit, the following is required:
Revised site plans and building elevations incorporating all conditions of
approval shall be submitted to the Development Services Department.
2. The building plans shall

3. The plans shall show all new and existing utilities placed underground.
The applicant shall comply with the latest adopted Uniform Building Code,
Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code,
Uniform Fire Code, and all other applicable codes and ordinances in effect
at the time of building permit issuance.
Payment of the Affordable Housing In-Lieu Fee in the amount of $3,955
(Based on a 2,455 square foot residence).
Provide proof to the Planning Division of payment of school fees to the
Poway Unified School District.

Future grading of this hillside lot shall be prohibited. The applicant shall
record a deed covenant on the property disclosing this condition. Form and
content of this shall be to the satisfaction of the Director of
Development Services. A copy of the recorded document shall be provided
to the Development Services Department prior to grading permit issuance.
The average building height of the residence shall not exceed 35 feet.
The proposed location of the required water tank for fire fighting shall be
reviewed and approved by the Planning Division. The color of the tank shall
be earthtone and shall blend with the surrounding natural l.

Driveways, drainage facilities, slope landscaping and protection
utilities, water and sewer mains, and all roadway imp ~ shall be
constructed, completed, and inspected by the Engineering Inspector.
A private road and maintenance agreement, in a form
satisfactory to the City Attorney, for the private roads from the subject
property to the nearest publicly · ~ · -I road, shall be executed by the
owner. Said agreement is to comply with Ordinance No. 280, Poway
Municipal Code Section 12.20.060. If such an agreement exists, the
applicant shall provide a copy to the City Engineer.
Damage to the existing private roads caused by activities from
this project shall be repaired to the sal' ~ ! the City Engineer.
Record drawings, signed by the engineer of work, shall be submitted to
Development Services prior to a request for occupancy, per Section
16.52.130B of the Grading Ordinance. Record drawings shall be submitted
to allow the City adequate time 1' d approval prior to
: occupancy and release of grading securities.

Municipal Code Section 12,20.120 and Ordinance No. 280 standards for

This dwelling is being built on a parcel size of one acre and is beyond 500
feet from the nearest fire hydrant. The dwelling will have to have
standby water for fireflghting and a residential sprinkler system. Contact the
Fire Prevention Bureau for details.

2002, at 5:00 p.m., unless a building permit has been issued and construction in reliance

prior to building permit issuance and/or the residence is not constructed, no more time
