P-00-66 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING ENVIRONMENTAL ASSESSMENT AND TENTATIVE PARCEL MAP TPM 00-02 ASSESSOR'S PARCEL NUMBER 323-480-05 WHEREAS, Tentative Parcel Map 00-02, hereinafter "Map", submitted by C.W. Scdpps Poway, LLC, Owner, a proposal 1 ' :lividual parcels for six office buildings and parcel on the 3.32 acre property located on the northeast corner of the intersection of Danielson Street and Scripps Poway Parkway within the South Poway Planned Community Zone came before City Council for public hearing and action on August 29, 2000; and WHEREAS, the City Council has read and considered the agenda report for the proposed project and has considered other evidence presented at the public hearing; and NOW, THEREFORE, the City Council does hereby follows: Section 1: The City Council finds that the proposed project is categorically exempt from the California E Iai Quality Act (CEQA) pursuant to Section 15332, Class 32 Exemption, meaning that the project is determined not to have a significant adverse effect on th I in accordance with CEQA, as the project ' I with the South Poway Specific Plan, the light industrial land use designation and the Poway General Plan. The site also is less than f' size and surrounded by urban uses. Section 2: The finding Jance with the State Subdivision Map Act (G Code Section 66410 et. seq.) for Tentative Parcel Map 00-02 are made as follows: The Map is consistent with the General Plan in that it is the subdivision of an approved office complex on a property designated for industrial park development located within the South Poway Planned Community zone. The site is physically suitable for the type of development in that the design of the approved office complex project is in lh the South Poway Specific Plan Development Standards. The site is physically suitable for the density of the development approved in that the site is a level parcel. The design of the parcel map is not likely to cause substantial Iai damage and avoidable injury to humans and wildlife or their habitat in that it the site has been graded and ' :led by existing development. Access to the site will be provided in accordance with City standards and to ensure adeq .;lency access. ~4: The City Council hereby approves Tentative Parcel Map 00-02 to create individual parcels, for each of the six office buildings pi parcel as shown on the tentative parcel map dated January 31, 2000, on the 3.32 acre property located on the northeast corner of the int I Danielson Street and Scripps Poway Parkway subject to the following conditions: Within thirty (30) days after tentative parcel map approval, the applicant shall submit in writing to the City that all conditions of approval have been read and understood. A revised project drawing shall be submitted to the Development Services Department, Planning Division, which reflects any and all changes which have resulted from the public hearing. This approval is based on the existing site conditions represented on the approved tentative parcel map and approved Development Review 99-18. Prior to recordation of the parcel map, unless other timing is indicated, the applicant shall complete the following, or have plans submitted and approved, agreements executed, and securities posted: A parcel map shall be submitted to the City for review and approval. The parcel map shall conform to City standards and procedures, the City Subdivision Ordinance, the Subdivision Map Act, the Land Surveyors Act, and the Resolution of Approval as approved by the City Council, and shall be in substantial with the approved tentative parcel map. Appropriate map review fee shall be paid at time of submittal. All property corners shall be led. If property corners are not set prior to parcel map approval, appropriate lation security shall be submitted to the City. 3. Parcels 2 to 7 shall be provided with · , ' Parcel 1 for the following: Access for ingress and egress from Danielson Street to each respective parcel. The applicant shall dedicate to the City the following easements: E for public water and sewer lines, if alignment and locations are known prior to Parcel Map approval. The City shall be provided with a photomylar copy of the recorded parcel map within 30 days of its recordation in the office of the San Diego County Recorder. The map shall be revised consistent with the approved tentative parcel map design on file in the Planning and Engineering Divisions of the Development Services Department, the South Poway Specific Plan, the Poway Municipal Code and the condit' ' -1 herein. A copy of the Covenants, Conditions and Restrictions (CC&R's) and/or Articles of l :the Property Owners ,~ 3all be subject to the review for compliance with conditions herein, to the sal ' the City Attorney and Director of Development Services, and shall be filed with the Secretary of State, the County Recorder and the City Clerk at the time of final map consideration. The property to be subdivided has been allocated 9 sewer equivalent dwelling units (EDUs) per the approval of City of Poway Tentative Tract Map 87-13, Unit 2. A portion of the sewer fees, in the amount of $8,713.00 has been paid. Within 30 days after tentative parcel map approval, the subdivider shall pay an additional $1,857.50. Then, prior to building permit issuance, another additional $10,570.50 sewer fee shall be paid. 12. E= Resolution No. p-00-66 Page 5 The above number of sewer EDU's is th ' ' : reserved for the subdivision, based on a total building area of 53,840 square feet. Additional sewer EDU's for building areas beyond this total building area shall be charged accordingly. There is no reduction in the allocated EDU's. A agreement shall be prepared for the maintenance of all landscape, hard scape, slope areas and fire protection systems including, but not limited to, post ind swing check valve, fire department :1 water lines leading to each building's fire sprinkler dser. Said agreement shall be in a t' '7 to the City Attorney and submitted to the City 1' :1 approval. Said agreement shall be a stand alone agreement or incorporated in the development's C Conditions and Restrictions l (CC&R's). The agreement or the CC&R's shall be recorded in the office of the San Diego County Recorder prior to parcel map approval. Approp ' fee shall be paid at time of submittal. 13. Prior to issuance of grading permit for Development Review 99-18 the following requirements shall be completed to the sal ' I the City Engineer: 1. The following imp lall be constructed: Public water main lines. Onsite potable water main lines shall be :1 for fire hydrant/s installation as required by the City Fire Marshal. The size and location of the water main lines shall be that as established by a water system analysis prepared by an engineering firm designated and approved by the City. The applicant/developer shall pay to the City the cost of preparing the analysis prior to submittal of improvement plans. b= Onsite sewer main. Minimum size shall be 8" in diameter and : -1 to City standards and sF for public sewer mains. Improvements shall be :t in accordance with City adopted standards and specifications, the latest adopted edition of the Standard Specifications for Public Works C and its corresponding San Diego supplements, the current San Diego Regional Standard Drawings and the South Poway Specific Plan. Resolution No. p-00-66 Page 6 Each parcel in the subdivision shall be designed to provide individual water (one for d :1 one 1' :1) and lines. The subdivider shall submit plans for the abovementioned improvements to the Development Services Department 1' :1 approval. The subdivider shall execute an agreement for the construction of public imp herein referred as "Agreement", to insure that all improvement req ' ~all be completed. However the Agreement may be waived by the Director of Development $ the City Engineer if the subdivider elects to complete the public imp prior to pamel map approval. A warranty bond shall be posted with the City prior to acceptance of the improvements. If an Agreement ' :1, imp 3all be completed within two years from date of approval of said Agreement or prior to building permit issuance, which first. Completion time may be extended with the approval of the City Council. All new and existing electrical/ :ion/CATV utilities within the boundaries of the subdivision shall be installed underground prior to installation of )s, gutters, sidewalks and surfacing of the streets or parking lot. The subdivider is responsible for complying with the req ~this condition, and shall make th 3/arrangements with each of the serving utilities. The I' :1 sizes of all utility boxes and vaults within street rights-of- way and the City's general utility easement shall be shown on the improvement plans. Said utility box(es) shall be set back a ' ' ~ 15 feet from the curb and shall I: :1 to th ~ the Director of Development Services. A right-of-way permit shall be obtained from the Engineering Division of the Development Services Department for any work to be done in public street rights-of-way or City-held easements. Prior to approval of the improvement plans, the following shall be met: Execution of a "Standard Agreement for the Construction of Public Improvements" (Agreement) and posting of performance, payment, and ~' :ion securities. However the Agreement may be waived by the Director of Development S the City Engineer if the subdivider elects to complete the public impprior to parcel map approval. A warranty bond shall be posted with the City prior to acceptance of the imp b. Payment of improvement plan checking and inspection fees. 11. Prior to start work in public street rights-of-way or City-held easements, a right-of-way permit shall be obtained from the Engineering Division of the Development Services Department. Section 5: The approval of the tentative parcel map expires on August 29, 2002, at 5:00 p.m. The parcel map ;I to this conditionally approved tentative parcel map shall be filed with the City so that the City may approve the parcel map before this approval expires, unless within 60 days of the expiration of the tentative parcel map a request for a time extension is submitted to the Development Services Department and a time extension is granted. Section 6: Pursuant to G l Code Section 66020, the 90-day approval period in which the applicant may protest the imposition of any fees, dedications, reservations, imposed pursuant to this approval shall begin on August 29, 2000.
