P- 0~69 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING A ONE YEAR TIME EXTENSION FOR TENTATIVE PARCEL MAP 96-01(TE-2) AND RESCINDING RESOLUTION NUMBER P-99-51 ASSESSOR'S PARCEL NUMBER 278-240-15 WHEREAS, on May 21, 1996, the City Council approved TPM 96-01, a proposal to subdivide a 7.6 acre property into three parcels, located 450 feet east of the intersection of Eastvale Road and Canyon Pass, in the RR-B (High Valley) zone; and WHEREAS, a request for a one year time extension of the approval of Tentative Parcel Map 96-01 was approved by the City Council on July 20, 1999; and WHEREAS, a request for a one year time extension of the approval of Tentative Parcel Map 96-01, was submitted by Jerry and Linda Strauss; and WHEREAS, on August 29, 2000, the City Council held a hearing on the above- referenced item; and WHEREAS, the City Council has read and considered the Agenda Report for the proposed project and has considered other evidence presented at the Public Hearing; NOW, THEREFORE, the City Council does hereby follows: Section 1: The City Council finds that the previously issued Negative Declaration, dated May 21, 1996, adequately addresses th :this project. Se Resolution No. P-99-51 is hereby rescinded. Sec The findings in accordance with the State Subdivision Map Act (G Code Section 66410 et. seq.)for the extension of the approval of Tentative Parcel Map 96- 01 (TE-2), are made as follows: The Map is consistent with the General Plan in that it proposes to create three parcels from a property designated for rural residential use. The design and imp :luired of the Tentative Parcel Map : with all applicable general and specific plans; in that the approved parcel sizes and configurations adhere to the development standards for the Rural Residential B (High Valley) zone. Resolution No. P- 00-69 Page 2 The site is physically suitable for the type of development and the density proposed; in that the site is large enough to provide three parcels, each relatively regular in shape and with d ,lich are in keeping with the Rural Residential B (High Valley) development standards. The design of the subdivision is not likely I ~stantial Iai damage and avoidable injury to h ~ wildlife or other habitat in that the site is developed as an avocado grove and h -I · ded by similarly developed properties. The Tentative Parcel Map is not likely t public health problems, as City 31e to the property, and conditions of approval for the project require certification from the County Health Department, that the septic sy ' ' :3 the new homes will be adequate. The design of the Tentative Parcel Map will not conflict with any easement by the public at large, now of record, 1' through or use of the property within the proposed subdivision. Access to the site will be provided in accordance with City standards and :teq ,~ency access, Section 5: The City Council hereby approves Tentative Parcel Map 96-01 (TE-2), a request for a one year t' ~ a previously approved Tentative Parcel Map, for the proper~y located 450 feet east of the int I Eastvale Road and Canyon Pass, in the RR-B (High Valley) zone, as shown on the Tentative Parcel Map dated April 19, 1996. The project is approved subject to the following conditions: Resolution No. P-00-69 Page 3, Within thirty (30) days after Tentative Pamel Map approval, the applicant shall submit in writing, to the City, that all conditions of approval have been read and understood. The applicant shall comply with the condit' 37. :1 in Resolution No. P-96- This approval is based on the existing site conditions represented on the approved Tentative Pamel Map. If actual conditions vary from representations, the approved Map must be changed to reflect the actual conditions. Any substantial changes to the approved Tentative Parcel Map, prior to parcel map recordation, must be approved by the Director of Development S :1 may require approval of the City Council. The applicants shall participate in a ful I district, prior to building permit· -I/or the sale of the existing home, for the upgrading of the water system in the High Valley area with the enlargement of the Skyridge Reservoir. S~ The approval of a one-year 1' :Tentative Parcel Map 96-01 expires on May 21,2001, at 5:00 p.m. The parcel map ' ~ to this conditionally approved Tentative Parcel Map shall be filed with the City, so that the City may approve the parcel map prior to expiration of this approval, unless within 60 days prior to the expiration of the Tentative Parcel Map a request for a time extension is submitted to the Development Services Department, and a ~' is granted. Section 7: Pursuant to G : Code Section 66020, the 90 day approval period in which the applicant may protest the imposition of any fees, dedications, reservations, or exactions imposed pursuant to this approval shall begin on August 29, 2000.
