Res P-00-80 RESOLUTION NO. P- 00-80 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING ENVIRONMENTAL ASSESSMENT AND TENTATIVE TRACT MAP NO. TTM 99-01R ASSESSOR'S PARCEL NUMBER 314-192-38, 39, 68 WHEREAS, E ,~ l and Tentative Tract Map No. 99-01R (hereinafter "Map") was submitted by applicants Robert Lamagno, Louise Kronus, and James and Kathryn Kent, came before City Council for a public hearing on August 15, 2000, August 29, 2000, September 26, 2000, and October 3, 2000; and WHEREAS, the map application requests approval to subdivide a 6.69 gross-acre property located within the 14400 block of Midland Road into 14 new lots. The subject site is within the RS-4 and RR-C zones; and WHEREAS, the proposed map project' <tension and improvement of two new public roads within the subdivision, the dedication and construction of a public recreational trail segment, and th and recordation of a biological conservation easement to coincide with the d' =the existing oak dp Jland along the south sides of Lots 9, 10, 11 and 12, as well as for the p ~ the large sycamore tree located on the north subdivision boundary; and WHEREAS, the projecl Id (E Initial Study and proposed Mitigated Negative C ), the map application, and the City Council public headng has been duly noticed in accordance with the req : the California G l Code and the requirements of the California E Quality Act (CEQA); and WHEREAS, the City Council has read and considered the agenda report for the proposed project and has considered other evidence presented at the public hearing; and NOW, THEREFORE, the City Council does hereby follows: Section 1: The City Council has considered the E Initial Study (ELS), Mitigated Negative C (MND) and associated Mitigation Monitoring Program shown as Exhibit A of this resolution for Tentative Tract Map 99-01R. Resolution No. P-O0-80 Page 2 The findings in accordance with the State Subdivision Map Act (G Code Section 66410 et. seq.) for Tentative Tract Map 99-01R are made as follows: The map ' ' l with the General Plan in that the lots ara being craated as residential building Jance with the Residential Single-Family and Rural Residential land use and zoning provisions. The site is physically suitable for the type of development proposed in that the property is fiat and located within the geographic center of the city which is I to transportation, goods and services. The City Council hereby approves Tentative Tract Map 99-01R for the subdivision of a 6.69 gross-acre parcel into 14 lots located in the 14400 block of Midland Road, immediately south of Outlook Road, within the Residential Single-Family 4 and Rural Residential C zones, subject to the following conditions: Within 30 days after Tentative Tract Map approval, the applicant shall submit to the City, in writing, that all conditions of approval have been read and understood. This approval is based on the existing site conditions represented on the approved Tentative Tract Map. If actual conditions vary from rep the approved map must be changed to reflect the actual conditions. Any substantial changes to the approved Tentative Tract Map, prior to Final Map recordation, must be approved by the Director of Development Services and may require approval of the City Council. C. Prior to recordation of the Final Map, the applicant shall complete the following: Within 30 days after I ~ 3 approval, the applicant shall apply for a Letter of Availability (LOA) 1~e availability, and post with the City a non-refundable fee equal to 20% of the appropriate fee in effect at the time the LOA is issued. The Final Map, together with the supporting data and d · lion, shall be submitted to Engineering Division for review and approval. The appropriate map checking fee shall be paid. The Final Map shall conform to City standards and procedures, the City Subdivision Ordinance, the Subdivision Map Act, and the Land Surveyors' Act. o Resolution No. P- 00-80 Page 4 For the purpose of determining the location of any landscape easements adjacent to Midland Road, an acoustical study shall be conducted to the satisfaction of the Director of Development Services, to determine the required height, location and design for I for Lots 1, 2, 3 and 14 to ensure that the noise levels of the exterior backyards and interiors of the homes located adjacent to Midland Road will not exceed the noise limits contained in the Poway General Plan and Building Code. Said trail shall follow the alignment of the public sewer line easement on the north side of Rattlesnake Creek. The fencing shall include a five-foot-high chain link fence located on the property line, including a rear yard gate for Lot 9, Lot 10 and APN 314-192-68. Upon dedication of the required the builder of Di Roma Estates shall complete this work and shall be reimbursed to the satisfaction of the Director of Development Services. The open space easement shall be recorded with the County Recorder's Office as a covenant on the title/grant deeds of each lot and on the Final Map. Prior to issuance of an ad clearing permit or grading permit, the applicant shall comply with the following: The applicant and the project biologist shall confer with the California Department of Fish and Game to confirm that no permit will be required from that agency. If a permit is required, any necessary CEQA review shall be completed. A landscape plan prepared by a licensed Landscape Architect shall be submitted for separate plan check to the Planning Division of the Development Services Department for review and approval by the City Council. Payment of the required plan check fees shall be required at the time of submittal. The plan shall show the following: Landscaping for the Midland Road frontage between the noise wall and the back of the sidewalk. The biologist shall direct the installation of protective devices around protected trees, those mature individual trees located along the south side of Outlook Road, the mature California sycamore tree located at the northwest corner of Lot 7, the large California peppers near the Oak Woodland, and the Riparian Oak Woodland area on the south side of Lots 9, 10, 11 and 12. The biologist shall author a "limits of clearing plan," then monitor and report to the Planning Division of the Development Services Department, tl~ ~ the protected areas prior to start of work and each week thereafter through the completion of the grading process. The project biologist and the engineer of work shall plot the existing trees, their species and d the grading plan. The existing trees located along the north property boundary with Outlook Road shall be protected in place and retained. The large California sycamore located at the northwest corner of Lot 7 shall be staked at the drip line, fenced and protected during construction. Special care shall be taken to ensure that this tree is not damaged. The large California pepper trees located on the south side of Lots 9, 10, 11 and 12 shall be protected in place and retained. The artifacts shall be stored at a City facility until an appropriate curation facility is identified and approved by the Poway City Council. A grading plan for the development of the lots, prepared on Mylar at a scale of 1"=20', shall be submitted to the Development Services Department - Engineering Division for review and approval. Resolution No. P-00-80 Page 10 A soils/geological report shall be prepared by an engineer licensed by the State of California to perform such work, and shall be submitted with the grading plan. A drainage study using the 100-year storm frequency criteria shall be submitted with the grading plan. The drainage system shall be capable of handling and disposing all surface water within the subdivision and all sud' flowing onto the subdivision from adjacent lands. Said system shall include all required to propedy handle the drainage. C ,1 f~ driveways are not permitted. The drainage study shall address the hydraulics of the adjacent Rattlesnake Creek, including the :1 velocity of flow, and indicate the amount of runoff contribution to the creek from the proposed subdivision. Section 5: The approval of the Tentative Parcel Map expires on October 3, 2002, at 5:00 p.m. The Parcel Map ' ,1 to this conditionally approved Tentative Parcel Map shall be filed with the City so that the City may approve the parcel map before this approval expires, unless within 60 days of the expiration of the Tentative Parcel Map a request for a time extension is submitted to the Development Services Department and a time extension is granted.
