A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY
SUSPENDING RESOLUTION NO. P~00-19
WHEREAS, h the City Council adopted Resolution No. P-00-19
approving the mitigated negative declaration and Tentative Parcel Map No. 99-04 for
Assessor's Parcel No. 273-100-04; and
WHEREAS, on October 6, 2000, Judge Judith McConnell, Judge of the Superior
Court ordered said Resolution vacated and set aside and activity pursuant thereto
suspended upon receipt of the Peremptory Writ of Mandate; and
WHEREAS, the Peremptory Writ of Mand

WHEREAS, the City intends to appeal the order of the Court and for that reason
the resolution of approval should not be rescinded but should be suspended during
appeal.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF POWAY as follows:
1. By order of the San Diego Superior Court, Resolution No. P-00-19 is
hereby suspended, shall have no further force or effect during the appeal of San Diego
Superior Court Case No. GIC746770, and activity pursuant thereto shall be suspended
in accordance with the order of the Court.
2. This Resolution shall take effect upon its adoption by this Council.
