P-00-9 1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING HILLSIDE/RIDGELINE MINOR DEVELOPMENT REVIEW 00-19 ASSESSOR'S PARCEL NUMBER 277-010-09 WHEREAS, Hillside/Ridgeline Minor Development Review 00-19, submitted by Chris Thompson, requests approval to construct a 7,606-square-foot, two-story residence on a vacant 14-acre property located on Cheyenne Trail within the Rural Residential A zone; and WHEREAS, on November 28, 2000, the City Council held a hearing to solicit comments from the public, both pro and con, relative to this application. NOW, THEREFORE, the City Council does hereby follows: ,1: The project is found to be Categorically Exempt under the p ' ' I the Califomia E Quality Act pursuant to Sections 15303, as it is the development of a single family residence. Pursuant to the City of Poway Habitat C Plan, a biological survey was prepared for the property which reported that the project grading and fuel management would impact approximately 1.82 acres of Coastal Sage Scrub. The City finds that, in accordance with the Poway Habitat C Plan, the required findings for approval of the proposed mitigation for the removal of coastal sage scrub habitat for MDRA 00-19 are as follows: The mitigation is consistent with and furthers the implementing objectives of the Poway Habitat Conservation Plan in that the developer proposes to mitigate removed coastal sage scrub habitat at a 1:1 ratio through on-site or off-site dedication of comparable undisturbed and unencumbered habitat or payment of a mitigation in-lieu fee. If habitat is dedicated, the mitigation habitat is required to be located within the Mitigation Area to enhance the long-term viability and function of the preserve system. The mitigation will be to the long-term benefit of the covered species and their habitats in that the dedication of I over undisturbed habitat or payment of a habitat mitigation in-lieu fee will promote a meaningful addition to the assembly of a viable regional system of .'ted natural habitat habitat linkages, buffers and wildlife corridors. o Resolution No. P-00-93. Page 2 The mitigation shall foster the ' ~ impl' of the Poway Habitat Conservation Plan in an effective and efficient manner in that any off-site conservation area is required to be within an identified Mitigation Area within the City. o The mitigation will not result in a negative fiscal impact with regard to th implementation of the Poway Habitat Conservation Plan. The finding lance with Section 17.52 of the Poway Municipal Code for Minor Development Review 00-19, are made as follows: That the approved project is consistent with the General Plan as it proposes the of a single family residence on property that is designated for rural residential use. That the approved project will not have an adverse aesthetic, health, safety, or architecturally related impact upon adjoining properties as the residence has been designed to I; I with adopted development standards and is in character with surrounding development. That the approved development is in compliance with the Zoning and Grading Ordinances as it complies with the property development standards of the RR-A zone. The construction of public improvements is needed as a result of the proposed development to protect the public health, safety and welfare as identified below: The project requires payment of water, traffic mitigation, park, drainage, and affordable housing in-lieu fees which are assessed on a pro-rata basis to finance and provide publ ~ure iml; ,~ich p and healthy l for the residents of the City and provides funds to allow the construction of the City's fair shars of affordable housing for the region. Page 3 Access to site will be provided in accordance with City standards and insure adeq ~]ency access, The City Council hereby approves Minor Development Review 00-19, a request for approval to construct a 7,606-square-foot, two-story residence on the property known as Assessors Parcel Number 277-010-09 and located on Cheyenne Trail, subject to the following conditions: Within 30 days of approval, the applicant shall submit in writing that all conditions of approval have been read and understood. The applicant shall comply with the following conditions prior to grading permit issuance: The grading plan shall be prepared on City of Poway standard 3mm, 24" x 36" mylar, with a scale of 1" = 20' or larger. A grading plan submittal checklist is available atthe Engineering Division front counter. The grading plan shall show the following: C= e= f= g= All new slopes with 2:1 (horizontal to vertical) slope. Driveways, in compliance with the specifications provided in Section 17.08.170D of the Poway Municipal Code, and including minimum structural sections together with their elevations and grades. A separate erosion control plan for prevention of sediment run-off during construction. All utilities (proposed and existing), together with their appurtenances and associated easements. Encroachments are not permitted upon any easement without an approved encroachment agreementJpermit. L : all utility boxes, cleady identified in coordination with the respective utility companies, and approved by the City prior to any installation work. Tops and toes of graded slopes shall be shown with ' ' five foot setback from open space areas and property lines. Buildings shall be located at least five feet from tops and toes of slopes, unless waived by the Planning Division and/or Engineering Division. All proposed drainage imp If habitat impacts are mitigated on-site, the biological conservation easement shall be shown on the grading plan. Page 4 A soils/geological report shall be prepared by an engineer licensed by the State of California to perform such work, and shall be submitted with the grading plan. A drainage study using the 100-year storm frequency criteria shall be submitted with the grading plan. The drainage system shall be capable of handling and disposing all surface water within the project site and ail surl' flowing onto the project site from adjacent lands. Said system shall include all required to propedy handle the drainage. Concentrated t~ driveways are not permitted. The applicant shall pay all applicable engineering, plan checking, permit, and inspection fees. The applicant shall prepare a Storm Water Pollution Prevention Plan (SWPPP) that effectively addresses th the storm drain system. The SWPPP shall include, but not be limited to, an effective method of hillsid ~ sediment control, a material storage , to protect from being exposed to storm runoff, protection of all storm drain inlets, on-site concrete truck wash and :1 otb : Best Management Practices to effectively eliminate pollutants from entering the storm drain system. The applicant shall certify the SWPPP prior to approval of the grading plans. The SWPPP may be incorporated with the erosion control plan, but shall be under from the grading and improvement plans. Grading ' the form of a performance bond and a cash deposit, or a letter of credit shall be posted with the City. Grading or brush clearing activity in coastal sage scrub habitat shall not occur during the period of February 15 through August 15, which is the nesting season for the California Gnatcatcher. The limits of clearing and grading shall be clearly staked and delineated. Future grading of this hillside lot will require City Council approval. The applicant shall submit a Brush Management/Landscape Plan to the Planning Division and the Safety Services Department for review and approval. The plan shall be prepared in accordance with the City of Poway Guide to Landscape Req ' it relates to fire management zones. Resolution No. P- 00-9:]. Page 5 11. Project grading and brush management impacts to 1.82 acres of coastal sage scrub habitat shall be mitigated at a minimum 1:1 mitigation ratio in accordance with the Poway Habitat Plan. The illegal of approximately 2 acres of coastal sage scrub habitat cleared within the past few years for traffic detour purposes on the subject property shall also be mitigated at ' ' 1:1 mitigation ratio. The amount of illegally cleared habitat shall be quantified by the project engineer. If habitat impacts are mitigated on-site, the limits of clearing and grading shall be staked in the field. 12. The applicant shall provide to the Engineering Division evidence of a recorded document for a easement over the private roads within The Heritage subdivision for purposes of access, ingress, and egress to the subject lot. 13. The grading permit submittal shall include copies of letters of I: easement ¢ from adjacent property owners that all of the proposed utility imp slopes, and driveway grading. The applicant shall comply with the following conditions as required during grading operation: The site shall be developed in accordance with the approved site plans on file in the Development Services Department and the condit' :1 herein. Grading of lot shall be in accordance with the Uniform Building Code, the City Grading Ordinance, the approved grading plan, the approved soils report, and grading p 3table to the City. Erosion control including, but not limited to, desiltation basins, shall be installed and maintained by the developer from October 15 to April 15. The applicant shall comply with the latest adopted Uniform Building Code, Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code, Uniform Fire Code, and all other applicable codes and ord' effect at the time of building permit issuance. Payment of the Affordable Housing In-Lieu Fee in the amount of $4,500. Provide proof to the Planning Division of payment of school fees to the Poway Unified School District. A deed covenant shall be recorded on the property restricting the use of the area identified on the approved project floor plans dated June 21, 2000, as the first floor child's suite. Applicants shall pay to the City the cost of preparing the analysis prior to submittal. Improvement plans shall be submitted for approval by the Engineering Division. Plan check and inspection costs shall be paid by the developer. A private road agreement between the subject lot and the nearest public street, in a form satisfactory to the City Attorney, shall be executed by the property owner, per Municipal Code Section 12.20.060.
