A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING MINOR DEVELOPMENT REVIEW 00-96
ASSESSOR'S PARCEL NUMBER 314-360-20
WHEREAS, the staff approval for Minor Development Review 00-96 was appealed
by the applicant, Archie Pavek. The application is a request to convert, to a single family
home, a 3,200-square-foot accessory 1.97-acre property located in the Rural
Residential C (RR-C) zone; and
WHEREAS, on December 5, 2000, the City Council held a duly advertised public
hearing to consider the merits of the appeal request, relative to this application.
NOW, THEREFORE, the City Council does hereby
follows:
Section 1: The project is found to be Categorically Exempt under the p ' ' Ithe
California E Iai Quality Act pursuant to Sections 15303, Class 3 exemption, as
it is the development of a single family residence.
Section 2: The findings in accordance with Section 17.52 of the Poway Municipal Code
for Minor Development Review 00-96 are made as follows:
That the approved project is consistent with the General Plan as it proposes the
construction of a single family residence on property that is designated for rural
residential use. Therefore, the proposed use respects the interdependence of land
:1 aesthetics to the benefit of the City.
That the approved project will not have an adverse aesthetic, health, safety, or
architecturally related impact upon adjoining properties as the residence will not
involve any additional exterior or significant grading. Therefore, the
proposed use does not conflict with the orderly and h appearance of
:1 property within the City along with associated facilities such as, but
not limited to signs, landscaping, parking areas and streets.
That the project' y a minor change to tl~ : an existing structure
and will otb lh all City ordinances. Therefore, the proposed use
does not detract from the of the public health, safety and general
welfare, and property throughout the City.
That the approved development encourages the orderly and h
apl: : structures and property within the City as the neighboring properties

the proposed development respects the public concerns for the aesthetics of
developments.
Since the proposal will not negatively affect the views of adjacent property owners
or affect the building mass seen by surrounding properties in any significant
manner, the proposal does not have an adverse aesthetic, health, safety or
architecturally related impact upon existing adjoining properties, or the City in
general.
The proposed development will comply with all of the provisions of the Zoning
Ord :1 the General Plan.
The findings pursuant to G I Code Section 66020 for the public
imp :1 development fees needed as a result of the proposed development to
protect the public health, safety and well' :le as follows:

The design and imp ~ the proposed development ~ with all
elements of the Poway General Plan, as well as City ordinances, because all
necessary services and facilities will be available to serve this project. The
construction of public improvements is needed as a result of the proposed
development to protect the public health, safety and welfare as identified below:
Th :traffic mitigation, water, and park fees is required in order to
mitigate the impact of one new home on the use of public facilities; namely,
publicly :1 streets, water systems, and park space.
The exaction of affordable housing in-lieu fees is required in order to provide
funds to allow the construction of the City's fair share of affordable housing
for the region.

required in order to provide access to the site for emergency vehicles and to
bring the property into ;h Nondedicated Rural Local Street
standards.
The City Council hereby approves Minor Development Review 00-96, a
request to convert, to a single family home, a 3,200-square-foot accessory structure on the
property located at 15045 Heath Drive, subject to the following conditions:
Within 30 days of approval, the applicant shall submit in writing that all conditions
of approval have been read and understood.

If grading is to exceed 50 cubic yards of earthwork, or if the cut is greater than two
feet in vertical depth and ¢ ' cut slope steeper than 2:1 (two horizontal
to one vertical) and the fill is more than one foot in vertical depth, then the applicant
shall apply for a grading permit and submit a grading plan 1' :1 approval
to the City's Development Services Department. If the above conditions do not
apply, then the applicant shall provide a certification from a State Registered Civil
Engineer indicating the quantity of earthwork involved and shall pay a $500
inspection fee prior to building permit issuance.
If a grading permit is required, the applicant shall comply with the following
conditions to grading permit issuance:
The grading plan shall be prepared on a City of Poway standard 3mm, 24"
x 36" mylar, with a scale of 1" = 20' scale or larger. The grading plan, along
with a grading permit application and applicable fees, shall be submitted to
the Engineering Division 1' :1 approval. A grading plan submittal
check list is available at the Engineering Division front counter. As a

A drainage study, using the 100-year storm frequency criteria, shall be
submitted with the grading plan. The drainage system shall be capable of
handling and disposing all surface water within the project site and all
surt' flowing onto the project site from adjacent lands. Said system
shall include all required to propedy handle the drainage.

The applicant shall pay all applicable engineering, plan checking, permit, and
inspection fees.
A Storm Water Pollution Prevention Program (SWPPP) that effectively

An affordable housing fee of $4,500 shall be paid to the Planning Division.
