A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING MINOR DEVELOPMENT REVIEW 00-81
ASSESSOR'S PARCEL NUMBER 278-170-16 (a portion)
WHEREAS, the applicant, Vision Homes proposes t :a 5,703-square-foot,
single-story residence on the property located at 14032 Lake Poway Road within the Rural
Residential C zone; and
WHEREAS, on January 30, 2001, the City Council held a duly advertised public
hearing to consider the request, relative to this application.
NOW, THEREFORE, the City Council does hereby
follows:
Section 1: Notice is further given that pursuant to G I Code Section
66020(d)(1 ), the 90-day period to protest the imposition of any fee, ded
or other exaction described in this letter or begins on the date of this approval and any
such protest must I; that complies with G t Code Section 66020. In
addition to the appeal requirements pursuant to the G l Code a written appeal of
this decision pursuant to the Poway Municipal Code must also be filed.
Section 2: The project is found to be Categorically Exempt under the p ' ' Ithe
California E Iai Quality Act pursuant to Sections 15303, Class 3 exemption, as it
is the development of a single-family residence.
Pursuant to the City of Poway Habitat Conservation Plan, a biological survey was prepared
for the property for Tentative Tract Map 99-03. Project grading will impact coastal sage
scrub habitat. The City finds that in accordance with the Poway Habitat C Plan
the required findings for approval of the proposed mitigation for the removal of habitat for
MDRA 00-81 are as follows:
The mitigation is consistent with and furthers the implementing objectives of the
Poway Habitat Conservation Plan in that the developer proposes to mitigate
removed habitat at a 2:1 ratio through off-site dedication of comparable undisturbed
and unencumbered habitat or payment of a mitigation in-lieu fee.
The mitigation habitat is required to be located within the Mitigation Area to enhance
the long-term viability and function of the preserve system.
The mitigation will be to the long-term benefit of the covered species and their
habitats in that the dedication of I' l over undisturbed habitat
or payment of a habitat mitigation in-lieu fee will p ' ~]ful addition to

the assembly of a viable regional system of int
habitat linkages, buffers and wildlife corridors.

The mitigation shall foster the incremental implementation of the Poway Habitat
Conservation Plan in an effective and efficient manner in that any off-site
conservation area is required to be within an identified Mitigation Area within the
City.
The mitigation will not result in a negative fiscal impact with regard to th
implementation of the Poway Habitat Conservation Plan.
Section 3: The findings in accordance with Section 17.52 of the Poway Municipal Code
for Minor Development Review 00-81 are made as follows:
That the approved project is consistent with the General Plan as it proposes the
· of a single-family residence on property that is designated for rural
residential use. Therefore, the proposed use respects the interdependence of land
:~ aesthetics to the benefit of the City.

That the approved project will not have an adverse aesthetic, health, safety, or
amhitecturally related impact upon adjoining properties as the residence has been

That the project does not detract from the maintenance of the public health, safety
and general welfare, and property throughout the City.

consist of rural residential estate lots with similarly spaced home sites. Therefore,
the proposed development respects the public concerns for the aesthetics of
developments.
Since the proposal will not negatively affect the views of adjacent property owners
or affect the building mass seen by surrounding properties in any significant
manner, the proposal does not have an adverse aesthetic, health, safety or
architecturally related impact upon existing adjoining properties, or the City in
general.

Section 4: The findings pursuant to G l Code Section 66020 for the public
imp :1 development fees needed as a result of the proposed development to
protect the public health, safety and welfare are made as follows:
The design and imp :the proposed development l with all
elements of the Poway General Plan, as well as City ordinances, because all
necessary services and facilities will be available to serve this project. The
construction of public improvements is needed as a result of the proposed
development to protect the public health, safety and welfare as identified below:

the impact of one new home on the use of public facilities; namely, publicly

affordable housing in-lieu fees is required in order to provide funds

The construction of recreational trail improvements along the Lake Poway Road
frontage is required in order to provide a linkage in th :y trail system that
exists in the area and provide an alternative mode of transportation and reduction of
the ;lie occupancy vehicles.
Section 5: The City Council hereby approves Minor Development Review 00-81, a
request to construct a 5,703 square foot, single-story residence on the property located at
14032 Lake Poway Road pursuant to the plans dated July 13, 2000 (building plans), and
September 22, 2000 (grading plans), subject to the following conditions:
Within 30 days of approval, the applicant shall submit in writing that all conditions of
approval have been read and understood.
The applicant shall comply with the following conditions prior to grading permit
issuance:
A grading plan shall be prepared on City of Poway standard 3mm, 24"x36"
Mylar, with a scale of 1"=20" or larger. The grading plan shall show the
following:
Driveways, in compliance with the specifications provided in Section
17.08.170D of the Poway Municipal Code, and including minimum
structural sections together with their elevations and grades.

A separate erosion control plan for prevention of sediment run-off

All new slopes with a 2:1 (horizontal to vertical) slope.
Tops and toes of graded slopes shall be shown with a minimum
five foot setback from open space areas and property lines.

slopes, unless waived by the Planning Division and/or Engineering

A soils/geological report shall be prepared by an engineer licensed by the
State of California to perform such work, and shall be submitted with the
grading plan.
A drainage study, using the 100-year storm frequency criteria, shall be
submitted with the grading plan. The drainage system shall be capable of
handling and disposing all surface water within the project site and all
surf flowing onto the project site from adjacent lands. Said system
shall include all easements required to properly handle the drainage.
Concentrated fl driveways are not permitted.
The applicant shall pay all applicable engineering, plan checking, permit, and
inspection fees.
A Storm Water Pollution Prevention Program (SWPPP) that effectively
eliminates runoff into the storm drain system shall be
implemented. The SWPPP shall include, but not be limited to, an effective
method of hillside erosion and sediment control, a material storage site,
to protect construction material from being exposed to storm
runoff, protection of all storm drain inlets, on-site concrete truck wash and
lrol, and otb ~ Best Management Practices to effectively
eliminate pollutants from entering the storm drain system. The applicant
shall certify the SWPPP prior to the approval of the grading plan and
improvement plans. The SWPPP may be incorporated with the erosion

control plan, but shall be under separate cover from the grading and
improvement plans.
Grading securities in the form of a performance bond and a cash deposit, or
a letter of credit, shall be posted with the City.
The revised landscape plans for the underlying Tentative Tract Map 99-03
shall be submitted f :1 approval by the Director of Development
Services. The required recreational trail shall be included on the landscape
plans. The trail shall be designed in accordance with the trail standards
listed in the City of Poway Guide to Landscape Requirements.
Grading or brush clearing activity in coastal sage scrub habitat shall not
occur during the period of February 15 through August 15, which is the
nesting season for the California Gnatcatcher.
Mitigation for the removal of coastal sage scrub habitat shall be completed in
compliance with the Poway Subarea Habitat Conservation Plan (PSHCP)
prior I = a grading and/or administral' ~ permit. It shall
be accomplished by eighter purchase of off-site comparable habitat within
the PSHCP Mitigation Area or payment of the required mitigation in lieu fees

The applicant shall comply with the City of Poway Guide to Landscape
M' as it relates to fire management zones. The required brush
management zones shall be depicted on the project grading plan.
The applicant shall comply with the following conditions prior to issuance of the
building permit.
The site shall be developed in accordance with the approved site plans on
file in the Development Services Department and the conditions contained
herein. Grading shall b Jance with the Uniform Building Code, the
City Grading Ordinance, the approved grading plan, the approved soils
report, and grading p 3table to the City.
Erosion control, including but not limited to desiltation basins, shall be
installed and maintained by the developer throughout the duration of the
construction period.
Rough grading of the lot is to be completed and meet the approval of the City
inspector and shall include submittal of the following:

A certification of line and grade for each lot, prepared by the engineer
of work.
b. A final soil compaction report for each lot f :1 approval by
the City.
The building plans shall depict the exterior colors and materials to the

School impact fees shall be paid at the rate established at the time of
building permit issuance. Please contact the Poway School District for

The site shall be developed in accordance with the approved site plans on
file in the Development Services Department and the conditions contained
herein.
Prior to start of any work within City-held easements or right-of-way, a Right-
of Way permit shall be obtained from the Engineering Division of the
Development Services Department. All appropriate fees shall be paid prior
to permit issuance.
An affordable housing fee of $4,500 shall be paid to the Planning Division.

Record drawings, signed by the engineer of work, shall be submitted to
Development Services prior to a request of occupancy, per Section
16.52.130B of the grading ordinance. Record drawings shall be submitted in
a manner to allow the City adequate time for review and approval prior to

entrances.
