P-Ol-06 a RESOLUTION Of THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING ENVIRONMENTAL ASSESSMENT AND TENTATIVE PARCEL MAP TPM 00-08 ASSESSOR'S PARCEL NUMBER 320-220-01 WHEREAS, Tentative Parcel Map 00-08, hereinafter "Map", submitted by Ted Tchang/Tech Business Park LLC, Applicant, to subdivide a 4.83-acre parcel into two parcels, one of 1.97 acres and one of 2.857 acres, at the southeast corner of Kirkham Way and Tech Center Court, within the South Poway Planned Community Zone came before City Council for public hearing and action on February 6, 2001; and WHEREAS, the City Council has road and considered the agenda roport for the proposed project and has considered other evidence presented at the public hearing; and NOW, THEREFORE, the City Council does hereby follows: Section 1: The City Council finds that the proposed project is categorically exempt from the California E Iai Quality Act (CEQA) pursuant to Section 15315, Class 15 Exemption, because it consists of a minor division of industrial property into two lots within an urbanized area that is in with the South Poway Specific Plan, the light industrial land use designation and the Poway General Plan, and is on a parcel that does not have an average slope greater than 20 percent. Section 2: The findings, in accordance with the State Subdivision Map Act (G I Code Section 66410 et. seq.) for Tentative Parcel Map 00-08, are made as follows: The Map is consistent with the General Plan in that it is the subdivision of an approved lot designated for light industrial use located within the South Poway Planned Community zone. The site is physically suitable for the type of development in that the design of the approved tentative parcel map is in with the South Poway Specific Plan Development Standards. The site is physically suitable for the density of the development approved in that the site is a level parcel. The design of the parcel map is not likely to cause substantial Iai damage and avoidable injury to h ~1 wildlife or their Resolution No. P-01-06 Page 2 habitat in that the site has been graded and is surrounded by existing development. Eo The approved map is not likely to cause serious public health problems in that City water, sewer, and drainage system improvements presently serve the site. The design of the tentative parcel map will not conflict with any easement acquired by the public at large, now of record, 1' through or use of the property within the subdivision. Section 3: The findings, in accordance with G for the public imp are made as follows: Code Section 66020 The design and improvements of the proposed development are consistent with all elements of the Poway General Plan as well as City ordinances because all necessary services and facilities are in place or will be constructed to serve the project. B. Onsite and offsite drainage imp are in place or will be constructed to handle the surf ~:. C. Onsite and offsite drainage imp are in place or will be constructed to handle the surf 7. D. Fire hydrants are in place and will be constructed to serve the development and provide fire protection. Water and sewer fees will be paid. Onsite and offsite improvements will be made to provide water and to the development. Access to the site will be provided in accordance with City standards and ~ency access. Section 4: The City Council hereby approves Tentative Parcel Map 00-08 to create two parcels, one of 1.97 acres and one of 2.857 acres, as shown on the tentative parcel map dated November 1, 2000 on 4.83 acres located at the southeast corner of Kirkham Way and Tech Center Court, subject to the following conditions: Within thirty (30) days of tentative parcel map approval, the applicant shall submit in writing to the City that all conditions of approval have been read and understood. A revised project drawing shall be submitted to the Development Services Department, Planning Division, which reflects any and all changes which have resulted from the public hearing. Resolution No. P- 01-06 Page 3 This approval is based on the existing site conditions represented on the approved tentative parcel map. If actual conditions vary from representations, the approved map must be changed to reflect the actual conditions. Any substantial changes to the approved tentative parcel map, prior to parcel map approval, must be approved by the Director of Development S :t may require approval of the City Council. Approval of this request shall not waive compliance with any sections of the Zoning Ordinance and all other applicable City ordinances in effect at the time of building permit issuance. Prior to recordation of the parcel map, unless other timing is indicated, the applicant/subdivider shall comply with the following conditions: Submittal of a parcel map to the City for review and approval. The parcel map shall conform to City standards and procedures, the City Subdivision Ordinance, the Subdivision Map Act, the Land Surveyors Act, and the Resolution of Approval as approved by the City Council, and shall be in substantial with the approved tentative parcel map. ^ppropriate map review fee shall be paid at time of submittal. All property corners shall be led. If property corners are not set prior to parcel map approval, appropriate lation security shall be submitted to the City. A 5.00-foot general utility easement, southerly of and contiguous with the existing 10.00-foot general utility easement along the subdivision's frontage on Kirkham Way, shall be dedicated to the City. ^ certificate on the parcel map shall make said dedication. Each parcel shall be provided with potable (domestic) line, irrigation (reclaimed) line and sewer lateral. The improvement plans for TTM 86-02R(2) and TTM 85-04-02 indicate that the proposed Parcel 1 does not have an existing sewer lateral from the public sewer main and, therefore, a sewer lateral shall be :1 prior to ' f building occupancy. Also, the proposed Parcel 2 shall have an irrigation (reclaimed) water service line to be ,1 within its frontage on Kirkham Way prior t i building occupancy. The new sewer lateral and irrigation (reclaimed) lines shall be shown, as a change, on the improvement plans of TTM 86-02R and TTM 85-04-02. ^ California registered civil engineer shall prepare the construction change to the plans. Resolution No. P-01-06 Page 4 Provide the City with a photomylar copy of the recorded parcel map within 30 days of its recordation in the office of the San Diego County Recorder. Section 5: The approval of the tentative parcel map expires on February 6, 2003, at 5:00 p.m. The parcel map 3 to this conditionally approved tentative parcel map shall be filed with the City so that the City may approve the parcel map before this approval expires, unless prior to 90 days of the expiration of the tentative parcel map a request for a time extension is submitted to the Development Services Department, and a time extension is granted for the City Council prior to the expiration date. Section 6: Pursuant to G t Code Section 66020, the 90-day approval period in which the applicant may protest the imposition of any fees, dedications, reservations, or exactions imposed pursuant to this approval shall begin on February 6, 2001.
