P- 01-0g A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING MINOR DEVELOPMENT REVIEW 94-38R ASSESSOR'S PARCEL NUMBER 321-270-55 WHEREAS, the applicant, Elwood Norris proposes to complete additional grading on a 40-acre property located at 16101 Blue Crystal Trail within the Rural Residential A zone; and WHEREAS, on February 27, 2001, the City Council considered the request. NOW, THEREFORE, the City Council does hereby follows: Section l: The project is found to be Categorically Exempt under the p ' ' I the California E Iai Quality Act pursuant to Sections 15304, Class 4 exemption, as it is a minor alteration to land resulting from the extension of a new landscape area. Section 2: The finding tance with Section 17.52 of the Poway Municipal Code for Minor Development Review 94-38R, are made as follows: That the approved project is consistent with the General Plan as it proposes the additional grading on a lot developed with a single-family residence that is designated for rural residential use. Therefore, the proposed use respects the interdependence of land :1 aesthetics to the benefit of the City. B= That the approved project will not have an adverse aesthetic, health, safety, or architecturally related impact upon adjoining properties as the grading has been designed to I~ : with residential development in the area. C= That the project does not detract from the maintenance of the public health, safety and general welfare, and property throughout the City. That the approved development encourages the orderly and h app :si :1 property within the City, as the neighboring properties consist of rural residential estate lots with similarly spaced home sites. Therefore, the proposed development respects the public concerns for the aesthetics of developments. Eo Since the proposal will not negatively affect the views of adjacent property owners in any significant manner, the proposal does not have an ad :hetic, health, safety or architecturally related impact upon existing adjoining properties, orthe City in general. Resolution No. P- 0].-09 Page 2 Fo The proposed development will comply with all of the provisions of the Zoning Ord' :1 the General Plan. Section 3: The City Council hereby approves Minor Development Review 94-38R, a request to complete additional grading on a 40-acre property located at 16101 Blue Crystal Trail, pursuant to the grading plan dated January 16, 2001, subject to the following conditions: Within 30 days of approval, the applicant shall submit in writing that all conditions of approval have been read and understood. The applicant shall comply with the following conditions prior to grading permit issuance: The grading and retaining wall design for this application shall be formally incorporated into the previously approved grading plans, and reviewed and approved by the Engineering Division. The applicant shall pay plan check fees for review of the grading and retaining wall. The site shall be developed in substantial with the approved grading and development plans, and in accordance with the Uniform Building Code, City Grading Ordinance, and City Storm Water Management and Discharge Control Ordinance. Erosion control, including but not limited to desiltation basins, shall be installed and -t throughout the construction of the project. The developer shall make provisions to insure proper maintenance of all erosion control devices. Prior to start of any work within City-held easements or right-of-way, a Right- of Way permit shall be obtained from the Engineering Division of the Development Services Department. All appropriate fees shall be paid prior to permit issuance. Drainage facilities, slope landscaping and p :1 utilities shall b -1, completed, and inspected by the Engineering Inspector. The applicant shall provide for a drainage system capable of handling and disposing of all surface water originating within the project and all surface water that may flow onto the project from adjacent lands. Said drainage system shall include any :1 st :luired by the Director Resolution No. P-0:].-09 Page 3 of Development $ City Engineer to properly handle the drainage and shall be designed so as to prevent ponding of surface water that would create a public hazard 8. All proposed utilities within the project site shall be installed underground. The developer shall repair any and all damages to the p J by activity from this project, to the satisfaction of the City Engineer. 10. Record drawings, signed by the engineer of work, shall be submitted to Development Services, per section 16.52.130B of the grading ordinance. Record drawings shall be submitted ' to allow the City adequate time 1' :1 approval prior to release of grading securities. 11, Rough grading of the lot is to be completed and meet the approval of the City inspector and shall include submittal of the following: A certification of line and grade for each lot, prepared by the engineer of work. b. A final soil compaction report for each lot f :1 approval by the City. 12. The height of the retaining walls shall not exceed 6 feet, minimum 5-foot landscape planter shall be provided between the walls. 13. A landscape and irrigation plan shall be submitted to the Planning Division :1 approval by the Director of Development Services. The plan shall address landscape screening of both of the proposed retaining walls and the manufactured slopes. The landscaping shall consists primarily of fast growing evergreen shrubbery that will effectively screen the walls and slopes within a one year period. The landscaping material shall b color to the surrounding natural habitat. 14. The retaining walls shall be constructed of earth toned colored blocks. Section 4: The approval of MDRA 94-38R shall expire on February 27, 2003, at 5:00 p.m. unless prior to that time a Grading Permit has been issued.
