A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
DENYING CONDITIONAL USE PERMIT 00-06
ASSESSOR'S PARCEL NUMBER 321-243-04
WHEREAS, Conditional Use Permit 00-06 was submitted by WFI, Inc., applicant, for
approval of a wireless t :ion facility consisting of seven panel antennas
located within a new 35-foot tall false "water tank" Ih related ground mounted
equipment (telephone, radio, and electrical) to be constructed on a developed residential
lot located in the Rural Residential C zone at 14305 Twin Peaks Road; and
WHEREAS, on March 13, 2001, the City Council held a duly advertised public
hearing to solicit from the public, both pro and con, relative to this application.
NOW, THEREFORE, the City Council does hereby
follows:
Section 1: The City Council finds that Conditional Use Permit 00-06 is Categorically
Exempt from the p ' ' =the California E QualityAct, pursuant to Section
15303(d), Class 3 exemption, in that it is the location of a small new facility providing a
utility extension to serve the surrounding area.
Section 2: The findings required by Section 17.48.070 of the Poway Municipal Code for
Conditional Use Permit 00-06 to add 1: tion facility located within a
new 35-foot-tall wooden false "water tank" developed residential lot at 14305
Twin Peaks Road in the RR-C : be made. The findings of the City Council are
as follows:
The proposed location, size, and design of the proposed t lions facility
would not be in accord with the purpose of the RR-C rural residential zone, the City
General Plan and the development policies of the City in that the RR-C zone is
intended for Iow density residential uses and any additional uses must be
complementary to, and exist in harmony with, the rural residential neighborhood. The
method of screening th by means of a 35-foot tall false "water tank" would
introduce a structure of a bulk and scale that is not screened from view and detracts
from the desired character of the surrounding area.
The location, size, and design of the t :ions facility would not be
compatible with and would adversely affect and be materially detrimental to adjacent
uses, buildings, and st ' that the bulk and scale of the new st d be
highly visible from Espola Road, a locally designated Scenic Highway in the Poway
General Plan and is not compatible with adjacent structures.

The design of the proposed tion facility is not in keeping with the
surrounding neighborhood because it prol: :hod of screening for seven panel
antennas that is of :~ scale that is incompatible with, and does not integrate
into, the surrounding rural residential neighborhood.
There are public facilities, services and utilities available to serve the
t :ions facility.
The proposed t :ions facility would be harmful to desirable neighborhood
characteristics because the method of screening the facility introduces a structure that
is too massive for the surrounding rural residential neighborhood and is not
complimentary in design to other in the neighborhood.
The project would not introduce a significant amount of additional traffic to the
surrounding street sy I would only require period' ' ' ~ and would not
be manned. Therefore, the generation of traffic would not adversely impact the
capacity and physical character of surrounding streets and/or the Circulation Element of
the General Plan.
The site for the proposed 1: :ion facility site is not suitable for the type and
intensity of use or development that is proposed because the method of screening the
ant Id result in a structure that is not complimentary to the rural character of
the immediate area.
The project is very limited in scope, and' hazardous materials or processes.
The project would be required to meet FCC req ' for high radio frequency (RF)
exposure. Therefore, there would not be significant harmful effects ul:
quality.
There are no other relevant negative impacts of the proposed use that cannot be
mitigated.
The impacts, as described above, and the proposed location, size, and design of the
proposed would be contrary to the adopted General Plan in that the proposed
screening for the t :ion facility is of a bulk and scale that is not suitable for
the rural location and that the use could be established with a more effective screen
consisting of I :1 scale.
The proposed conditional use would comply with each of the applicable p ' ' ~
Section 17.48.070 of the Poway Municipal Code in that the appropriate City permits
would be obtained.

Section 3: The City Council hereby denies Conditional Use Permit 00-06 for the
installation of t facility consisting of seven panel antennas to
be located within a new 35-foot-tall and 20 foot wide wooden false "water tank" structure
and related ground mounted equipment (telephone, radio, and electrical) at 14305 Twin
Peaks Road in the Rural Residential C (RR-C) 3own on the plans dated January
15, 2001.
PASSED, ADOPTED and APPROVED by the City Council of the City of Poway,
State of California, this 13th day of March 2001.
