Res P-01-18RESOLUTION NO. p-01-18 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING TEMPORARY USE PERMIT 01-16 WHEREAS, Temporary Use Permit 01-16; Poway Chamber of C applicant, requests approval to hold the Annual Poway Spring Fest 2001 Street Fair on Midland Road, April 22, 2001 from 10:00 a.m. to 4:00 p.m. WHEREAS, on April 17, 2001, the City Council considered the al: item. NOW, THEREFORE, the City Council does hereby follows: Section 1: Pursuant to the procedures of the City of Poway implementing the California E Iai Quality Act of 1970, the al: ~ -1 project is categorically exempt under the provision of the California E Iai Quality Act (CEQA), Class 4, Section 15304(e) and Class 11, Section 15311(c) in that the event is temporary in nature and will have no permanent effects on th l. Section 2: The proposed use is in accordance with the purposes and standards of Section 17.26.030.A of the Poway Municipal Code. Section 3: The City Council hereby approved Temporary Use Permit 01-16, Annual Poway Spring Fest 2001 Street Fair, to be held on Midland Road between Poway Road and Hilleary Place on April 22, 2001 from 10:00 a.m. to 4:00 p.m., subject to the following conditions: The event and related offsite parking shall be conducted as shown on the site plan and application on file in the Development Services Department, Planning Division. This permit is valid during the hours of 10:00 a.m. to 4:00 p.m. on April 22, 2001, after which time the site shall be restored to its original condition. The barricades can be placed at 5:00 a.m. and shall be removed by 7:00 p.m. on April 22, 2001. Approval of this activity shall not excuse compliance with all otb I the Zoning Ordinance and all other applicable State, County, and City ordinances presently in effect. Contact the Development Services Department, Planning Division, regarding the temporary sign ordinance prior to the installation of any sign. Vendor's licenses shall be obtained from the City of Poway Customer Services Department for all temporary sales locations. Notify, in writing, Midland Road b the U.S. Post Office, the Silver Oaks Apartment property manager, and residents affected by the road closure. The notices shall be mailed or hand delivered. The notice shall include the details of the date and time of the event, and the area of the road to be closed. The applicant shall have designated at all times, and at specific locations, to provide liaison with representatives of the City's Safety and Sheriff's Departments. Resolution No. P- 01-18 Page 3 G. During the event, the applicant shall comply with the following: 1. Portable restrooms shall be provided at a ratio of one to every 500 people. H. The applicant shall comply with the following to the satisfaction of the Traffic Engineer: 1. Provide a traffic control plan from a p traffic control service detailing all signs and notifications to be used. Plan must address traffic signal impacts on Poway Road and Midland, and Midland Road and Hilleary Place. I. The applicant shall comply with the following to the satisfaction of the Fire Marshal: 1. Prior to and during the event, emergency vehicle access to any street, building, fire hydrant, or fire sprinkler system shall not be blocked. 2. During the event, all compressed gas cylinders shall be secured. 3. During the event, any booth in which food is cooked shall have a 2A10BC fire extinguisher. 4. Permits shall be obtained prior to the event for any canopy that is over 400 square feet. Section 4: This approval shall become null and void on April 22, 2001, at 7:00 p.m., at which time the site shall have been restored to its original condition.
