A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING TENTATIVE PARCEL MAP TPM 01-02 AND RESCINDING
RESOLUTION NO. P- 98-51
ASSESSOR'S PARCEL NUMBER 321-271-34
WHEREAS, Tentative Parcel Map 98-10, submitted by Don Mechling,
Applicant, to subdivide a 8.7-acre parcel into two parcels, one of 4.5 acres and
one of 4.2 acres, south of Millards Ranch Lane and west of Dos Amigos Road
within the Rural Residential A zone was approved for a period of two years by
the City Council on September 15, 1998, and expired on September 15, 2000;
and
WHEREAS, Tentative Parcel Map 01-02, hereinafter "Map", submitted by
Don Mechling, Applicant, to subdivide a 8.7-acre parcel into two parcels, one of
4.5 acres and one of 4.2 acres, south of Millards Ranch Lane and west of Dos
Amigos Road within the Rural Residential A zone came before City Council for
public hearing and action on July 31,2001; and
WHEREAS, the City Council has read and considered the agenda report
for the proposed project and has considered other evidence presented at the
public hearing; and
NOW, THEREFORE, the City Council does hereby
follows:
Section 1: The City Council finds that the proposed project has been
adequately addressed in, and is within the scope of, the Mitigated Negative
Declaration (MND) certified in with TPM 98-10 dated September 15,

Section 2: The findings, in accordance with the State Subdivision Map Act
(G t Code Section 66410 et. seq.) for Tentative Parcel Map 01-02, are
made as follows:

zoning standards and Rural Residential ^ General Plan designation
standards.
The site is physically suitable for this type of development in that the site is
located with : predominantly rural residential development/uses.

The site is physically suitable for the density of the development in that the
overall slope of the property is 12.2 percent, which is within the City of
Poway standards for parcel maps.
The design of the parcel map is not likely to cause substantial
Iai damage, and avoidable injury to humans and wildlife or
their habitat in that the majority of the site has been previously disturbed
by residential development and agricultural activities and the conditions of
approval assure that any impacts associated with the project will be
mitigated to a level of insignificance.
The approved map is not likely to public health problems in
that City water service is available to the site and the County

The design of the tentative parcel map will not conflict with any easement
acquired by the public at large, now of record, 1' through or use of
the property within the subdivision in that the development of single family

Section 3: The findings, in accordance with G

The design and improvements of the proposed development are
consistent with all elements of the Poway General Plan as well as City
Ordinances because all necessary services and facilities are in place or
will be -I to serve the project. The following improvements are
necessary to protect the public health, safety, and welfare:

Section 4: The City Council hereby approves Tentative Parcel Map 01-02 to
subdivide an 8.7-acre parcel into two parcels, one of 4.5 acres and one of 4.2
acres, south of Millards Ranch Lane and west of Dos Amigos Road within the
Rural Residential A zone, as shown on the Tentative Parcel Map dated June 4,
2001, subject to the following conditions:

Within 30 days of the date of this approval (1) the applicant shall submit in
writing that all conditions of approval have been read and understood;
The site shall be developed in accordance with the approved Tentative
Parcel Map on file in the Development Services Department.
Approval of this request shall not ;)liance with all : the
Zoning Ordinance and all other applicable City Ordinances in effect at the
time of building permit issuance.
Prior to any use of the project site or business activity being :1
thereon, all conditions of approval contained herein shall be completed to
the sat : the Director of Development Services.
The archaeological, biological and riparian areas within the existing open
space easement shall not be disturbed with mechanical equipment nor be
used for agricultural purp y other purpose other than retention of
the open space. Periodic weed abatement on the periphery is allowable
subject to approval of the Development Services Department.
The approval of this Tentative Parcel Map shall expire at the end of two
years if either a parcel map has not been approved and recorded, or a
time extension has not been sought by July 31,2003.

Obtain a 1603 permit from the Department of Fish and Game, if
necessary, for the creek crossing.

Retain the existing rock outcroppings (not within the existing open
space easement on the north part of Parcel 1) on the final map and
grading plan. The proposed dwellings shall be designed and sited so
as to avoid disturbance of the rock outcroppings.
A Master Plan of the existing on-site trees shall be provided to the
Development Services Department prior to the issuance of building
permits and prior to grading, to determine which trees shall be
retained.
Grading of the subject property shall I~ Jance with the Uniform
Building Code, City Grading Ordinance, approved grading plan and
geotechnical report, and accepted grading practices.
A grading plan for the development of the property, prepared on a
standard sheet of Mylar and drawn at a scale of 1" = 20", shall be
submitted to the City's Engineering Division, for review and approval
prior to issuance of a grading permit and start of grading operation.
Rough grading of the site must be completed and shall meet the City
Engineering Inspector's approval prior to ' I a building permit.
Grading plan is to address th I any previously done permit
grading.
A pre-blast survey of the surrounding property shall be conducted to
the ' ' of the City Engineer prior to any rock blasting. A
blasting permit shall be obtained from the Engineering Division prior to
any rock blasting. Seismic recordings shall be taken for all blasting
and blasting shall occur only at locations and levels approved by the
City Engineer.
Non-supervised gineered fill is especially not allowed. Rock
disposal areas shall be graded in compliance with City-approved soils
investigations and :tations and grading plans.
A drainage system capable of handling and disposing of all surface
water originating within the project, and all surface waters that may
flow onto the project from adjacent lands, shall be required. Said
drainage system shall include any and structures as
required by the City Engineer to properly handle the drainage.
A soils report shall be prepared by a qualified engineer licensed by the
State of California to perform such work. Copies of the report shall be
submitted with the grading plan.

A final compaction report shall be submitted and approved prior to

Erosion control, including but not limited to desiltation basins, shall be
installed and :1 from October 15th to April 15th. An erosion
control plan shall be prepared by the project Civil Engineer and shall
be submitted as part of the grading plan. The developer shall make
provisions to insure the proper of all erosion control
devices throughout their intended life.
Prior to final map approval, the applicant shall:

All and/or right-of-way dedications to the City that is/are
within the limits of a subdivision shall be made on the parcel map. All

shall be posted prior to parcel map approval.

building permit, the applicant shall:
1. Pay an Affordable Housing In-Lieu Fee to the Development Services
Department per City Ordinance prior to building permit issuance.
2. Low volume plumbing fixtures and Iow water usage irrigation shall be

3. A Minor Development Review shall be accomplished prior to the

4. A certification of line and grade, prepared by the project Civil Engineer,
shall be submitted prior to ' : building permits.

5. The following development fees shall be paid to the Development
Services Department prior to building permit issuance for each
residence. These fees are currently in effect and are subject to
change without prior notice.

Fire hydrantJs shall be installed at locations determined by the City Fire
Marshal. A water system analysis shall be prepared to establish the
prop :1 location of the public water system. Applicant shall pay to
the City the cost of preparing the analysis prior to submittal of
improvement plans.
Public water main lines and appurtenances that will be installed at
locations other than within public streets shall have an easement, a
minimum of 20-feet wide for each line, dedicated to the City of Poway.
Multiple parallel facilities will require additional easement width for on-site
facilities.
Each parcel shall be provided with its own (~ line and
sewage system. Leach field layout or seepage pit layout for the residence
sewage disposal system shall be submitted to the City's Development
Services Department for review and approval by the City Engineer prior to
obtaining a septic system installation permit from the County of San
Diego, Department of Health. If a septic system installation permit had
been obtained without a City approval layout, one shall be submitted prior
to installation of leach lines.
A right-of-way permit shall be obtained from the City's Development
Services Department for any work to be done within the public right-of-way
or any City-held easement. Said work shall include, but is not limited to,
construction of driveway approach, sewer lateral installation,
line installation, and street construction.
The parcel map shall conform to City standards and procedures, City
subdivision ordinance, Subdivision Map Act, and Land Surveyors Act.

Provide a soume of water (fire hydrants) within 500 feet of the proposed
(Parcel I O.K.)
P. Provide an "all weather surface" driveway, consistent with the
requirements of the Poway Municipal Code.
Provide a fire department turn around to service the residence, where
driveways exceed 150 feet.
R. Comply with the City of Poway Guide to Landscape M as it
relates to fuel management zones.
Section 5: The approval of this Tentative Parcel Map expires on July 31, 2003,
at 5:00 p.m. The parcel map ~ ~3 to this conditionally approved tentative
parcel map shall be filed with the City so that the City may approve the parcel
map before this approval expires, unless prior to 90 days of the expiration of the
tentative parcel map a request for a time extension is submitted to the
Development Services Department, and a time extension is granted for the City
Council prior to the expiration date.
Section 6: Pursuant to G I Code Section 66020, the 90-day approval
period in which the applicant may protest the imposition of any fees, dedications,
reservations, or exactions imposed pursuant to this approval shall begin on
July 31,2001.
