A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA,
APPROVING CONDITIONAL USE PERMIT 01-11
ASSESSOR'S PARCEL NUMBER 275-460-65
WHEREAS, Conditional Use Permit 01-01 was submitted by the City of Poway,
Applicant and Richard Just, Owner, to establish a temporary City fire fighter/paramedic
service facility in the medical office building located at 15525 Pomerado Road, Suite B-3
within the C Office zone; and
WHEREAS, on September 18, 2001, the City Council held a duly advertised public
hearing to solicit comments from the public, both pro and con, relative to this application;
and
NOW, THEREFORE, the City Council does hereby
follows:
Section 1: The City Council finds that Conditional Use Permit 01-11 is Categorically
Exempt from the p ' ' :the California E QualityAct, pursuant to Section
15301, Class 1 exemption, in that the use will be locating within an existing medical office
facility where adequate parking is available to serve the use.
Section 2: The findings, in accordance with Section 17.48.070 of the Poway Municipal
Code for CUP 01-11 to allow a temporary City fire fighter/paramedic service facility to be
established within the existing medical office building located at 15525 Pomerado Road,
Suite B-3, are made as follows:
The fire fightedparamedic service facility will be locating within an existing medical
office building. The use is a public facility, which is allowed in the C
Off' 'Ih the approval of a Conditional Use Permit. Therefore, the proposed
location size, design and operating ch :the proposed ~
with the title and purpose of Section 17.48.070 of the Poway Municipal Code, the
purpose of the zone in which the site is located, the City General Plan, and the
development policies and standards of the City.
The fire fighter/paramedic facility will be locating within an existing medical office
building where the surrounding land uses include miscell :lical offices and
an outpatient surgery center. Therefore, the location, size, design and operating
characteristics of the proposed use will be compatible with and will not adversely
affect, or be materially detrimental to adjacent uses, buildings, or structures.
There will be no significant increase in the scale, bulk or coverage of site
improvements, since the use will be occupying existing medical office facilities and
minor tenant modifications will be required. Therefore, the harmony in scale, bulk,
coverage and density of the project is consistent with adjacent uses.

The fire fighter/paramedic facility will occupy an existing medical off' :1 will

will respond to 3 to 4 calls per day (within a 24-hour period) compared with 85
average daily trips that would be generated by a medical office that used the 1,700-
square-foot tenant space. Therefore, the generation of traffic will not adversely
impact the capacity and physical character of surrounding streets and/or the
Circulation Element of the General Plan.
The fire fighter/paramedic facility will occupy existing medical office space where
adequate parking facilities are provided. Therefore, the site is suitable for the type
and intensity of use or development that is proposed.

and the conditions under which it would be operated or maintained will not be

Plan; and
That the proposed conditional use will comply with each of the applicable provisions
of Section 17.48.070 of the Poway Municipal Code.
Section 3: The City Council hereby approves CUP 01-11 to establish a temporary City
fire fighter/paramedic service facility in medical office building located at 15525 Pomerado
Road in the C Off' ~own on the plans dated August 8, 2001, subject
to the following conditions:
Approval of this CUP request shall apply only to the subject project and shall not

Within 30 days of the date of this approval, the property owners shall execute a

The use conditionally granted by this approval shall not be conducted in such a
manner as to interfere with the reasonable use and enjoyment of surrounding
use.
The conditions of CUP 01-11 shall remain in effect for the life of the subject fire
fighter/paramedic facility.
CUP 01-11 may be subject 1 determined by the Director of Development
Services for compliance with the conditions of approval and to add
that may have been raised during the prior year.
Prior to establishment of the use, a Building Permit shall be obtained. Prior to

The applicant shall comply with the latest adopted Uniform Building Code,
National Electric Code, and all other applicable codes and ordinances in
effect at the time of electrical/building permit issuance.
Prior to obtaining a final inspection on the building permits, the applicant shall

The site shall be developed in accordance with the approved plan on file in
the Development Services Department and the condit' :1 herein.
A final inspection from the appropriate City Departments will be required.
Upon establishment of the fire fighter/paramedic facility, pursuant to the approval of
CUP 01-11, the following shall apply:

on before the ambulance is at the Pomerado Road and Monte Vista Road

Section 4: The approval of CUP 01-11 shall expire on September 18, 2003 at 5:00 p.m.
unless, prior to that time, a Building Permit has been issued and construction on the
