Res P-02-08RESOLUTION NO. P- 02-08 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING VARIANCE 02-01 ASSESSOR'S PARCEL NUMBER 277-170-11 WHEREAS, Variance 02-01, submitted by David Davis, Old Coach Realty, requests approval of Variance 02-01 to allow a reduced front yard setback of 24 feet when a 40-foot front yard setback is required in the zone. The subject property is located within The Heritage Golf Community, west of Old Coach Road and addressed as 14425 Cypress Point (Lot 68). The parcel is located in the Planned Community (PC) zone; and WHEREAS, on March 19, 2002, the City Council held a duly advertised public hearing to solicit from the public, both pro and con, relative to this application. NOW, THEREFORE, the City Council does hereby follows: Section 1: The City Council finds that Variance 02-01 request is Categorically Exempt from the p ' ' Ithe California E QualityAct, pursuant to Section 15305, Class 5 exemption, in that the request is a minor alteration to a land use limitation. Section 2: The findings, in accordance with Section 17.50.050 of the Poway Municipal Code to approve Variance 02-01, to reduce the front yard setback from 40 feet to 24 feet for the property located at 14425 Cypress Point within the PC mown on the site plan dated February 13, 2002, are made as follows: That there are special 3plicable to the property and because of this the strict application of the zoning ordinance deprives the property of privileges enjoyed by other properties in the vicinity with the identical zoning classification. The special include the fact the subject lots were graded with irregular shaped pads to p:ural features at the rear of the lots and the lots were designed to follow the natural contours. Granting the Variance is necessary for the preservation and enjoyment of rights enjoyed by other property in th ' ' :y and not afforded to the property for which the V ~ht because of the steep terrain that restricts the amount of developable area on the site. Granting the Variance would not be materially detrimental to the public health, safety, or welfare in the vicinity in that the project will be well separated from other homes in the area and necessary utilities will be available for the site. Section 3: The City Council hereby approves Variance 02-01, subject to the following conditions: A= Within 30 days of approval the applicant shall submit in writing that all conditions of approval have been read and understood. A Minor Development Review permit (MDRA) is required prior to the development of the lot. Section 4: The approval of Variance 02-01 shall expire on Mamh 19, 2004 unless the applicant and/or property owner applies for and obtains approval of a Minor Development Review permit.
