Res P-02-25RESOLUTION NO. P-02-25 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING A MODIFICATION TO COMPREHENSIVE SIGN PROGRAM 80-16M(4) AND RESCINDING RESOLUTION NOS. P-94-23 AND P-98-08 ASSESSOR'S PARCEL NUMBER 317-130-47 WHEREAS, on December 9, 1980, the San Diego County Administrator approved CSP 80-16 for the former K-Mart Center (located on the northeast corner of the intersection of Poway Road and Midland Road) approving a Comprehensive Sign Program and 23 wall signs for tenants within the center; and WHEREAS, on May 25, 1982, the City of Poway City Council denied a request for a modification to CSP 80-16 to allow the approved wall sign letter height to be increased from a ! 16 inches to 36 inches; and WHEREAS, on June 5, 1984, the City of Poway City Council approved a request for a modification to CSP 80-16 to allow minor deviations to letter styles and increase approved letter height for the tenant space having frontage along Poway Road; and WHEREAS, on April 19, 1994, the City of Poway City Council approved a request for a modification to CSP 80-16M(2) to allow new lettering styles and colors, allow an increase in I allow signage to advertise products and services, allow nationally recognized tenants to have letter styles and colors other than what was approved by CSP 80-16, and approve the installation of a I sign along the Poway Road frontage and along the Midland Road frontage; and WHEREAS, on February 10, 1998, the City of Poway City Council approved a request for a modification to CSP 80-16M(3) to allow an increase in wall sign letter size for uppercase letters to 6'6" for major tenants, and changed approved font styles; and WHEREAS, on March 29, 2002, a request was submitted by Steve Schultz/Motorsports Warehouse, applicant and New Plan Excel Realty Trust, Inc., owner, requesting approval for a modification to the Comprehensive Sign Program 80- 16M(4) for the center located at 13630 - 13656 Poway Road within the Automotive General C zone to allow vehicle dealers within the center to have signage that advertises the make of vehicles being sold, allow wall signage along the Midland Road frontage, and allow a variety of lettering styles subject to approval of the Director of Development Services; and WHEREAS, on May 21,2002, the City Council held a public hearing on a request to modify Comprehensive Sign Program 80-16M(4); and WHEREAS, the City Council has read and considered the Agenda Report for the proposed project and has considered other evidence presented at the Public Hearing. Resolution No. P-02-25 Page 2 NOW, THEREFORE, the City Council does hereby follows: Section 1: The Comprehensive Sign Program is Categorically Exempt from the California E Iai Quality Act pursuant to Section 15311 (Class 11), in that it is for the placement of minor st ¥ to (appurtenant to) existing facilities. Section 2: The required findings in compliance with Section 17.40.180 of the Poway Municipal Code, for CSP 80-16M(4) are made as follows: The same background color will be used on all signs in that proposed signs will be mounted directly on the wall of the buildings. Not more than three different colors for sign lettering would be allowed in that, in addition to white, sign colors would be limited to primary red, primary yellow and primary blue. The color of returns is medium bronze. Wall signs will be compatible in that they will be constructed of acrylic face channel letters. D. The channel letters signs are required to be internally illuminated signs. Different colors for tenant Iogos will be allowed subject to the approval of the Director of Development Services. Section 3: The City Council hereby approves the Modification of Comprehensive Sign Program 80-16M(4)for the center located at 13630-13656 Poway Road within the A General C zone, subject to the following conditions: Within 30 days after the Comprehensive Sign Program approval, the applicant shall submit in writing to the City that all conditions of approval have been read and understood. B= Prior to installing a sign the applicant shall obtain a Sign Permit from the Planning Division and any necessary Building Division permits. All wall signs shall be channel letter style, mounted directly to the wall with no background to the sign. In addition to white, sign colors shall be limited to primary red, primary yellow, and primary blue. The color of sign returns shall be medium bronze. These allowable colors apply to all signage, not only channel letters, except for tenant Iogos. Tenants that are part of a chain of stores with a nationally recognized sign design, may ul ' :her than the approved colors. E. Wall signs shall be ' ~ of acrylic face channel letters. Different colors for tenant Iogos may be allowed subject tothe approval of the Director of Development Services pursuant to an individual Sign Permit for the use. Tenants that are part of a chain of stores with a nationally recognized sign design, may ut ' :her than the approved colors. A tenant that is a new vehicle dealer may have signage that advertises the make of vehicles being sold. The vehicle dealer is permitted one (1) sign for each make of vehicle sold. A tenant having frontage along Midland Road may install wall signage along the Midland Road elevation. The size of the sign shall comply with the req of Chapter 17.40 of the Poway Municipal Code. Lettering or font style of sign copy shall be approved as part of the individual sign permit. Resolution Nos. P-94-23 and P-98-08 are hereby rescinded. The sign criteria approved by Comprehensive Sign Program 80-16M(3), except as amended by conditions contained in this Resolution, shall apply to sign design for th center as shown in Exhibits A, B, C, D and E. All signs, including any freestanding signs, within the center shall conform to this Comprehensive Sign Program, as well as sign criteria and design guidelines in the Poway Road Specific Plan and the general sign provisions of the Poway Municipal Code. Approval of this request shall not waive compliance with Chapter 17.40 of the Zoning Code and all other applicable City ordinances in effect at the time of Sign Permit issuance.
