A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING DEVELOPMENT REVIEW 01-14
ASSESSOR'S PARCEL NUMBER: 275-461-12
WHEREAS, DR 01-14 submitted by JRS Architecture, Applicant, requests the
approval of a Development Review Application t :a two-story, 5,475-square-foot,
additional office building on a portion of a developed site located at 15644 Pomerado Road,
within the C Office (CO) zone; and
WHEREAS, on May 21,2002, the City Council held a duly advertised public hearing
to solicit from the public, both pro and con, relative to this application.
NOW, THEREFORE, the City Council does hereby
follows:
Section 1: The City Council finds that the project is exempt from the California
E Quality Act (CEQA), as a Class 1 Categorical Exemption, pursuant to
Section 15301(e)(2) of CEQA Guidelines, since the project involves the negligible
expansion of an existing facility/use. The project qualifies for the exemption since it
involves less than 10,000 square feet of additional area, all pub1 :1 facilities are
available, and the project site is not in · ly sensitive area.
Section 2: The finding Jance with Section 17.52 of the Poway Municipal Code,
for DR 01-14 are made as follows:
The project is consistent with the Poway General Plan in that the project involves the
construction of a medical office building which is a consistent use with the C
Office (CO) General Plan land use designation.
The project will not have an adverse health, safety, or aesthetic impact upon adjoining
properties in that the development of the project is in full compliance with all City
development standards.
That the project is in compliance with the Zoning Ordinance in that the project complies with
all City development standards of the CO zone, including those relating to building
setbacks, building heights, lot coverage, and parking.
That the development encourages the orderly and h 31: ~ structures
and property within the City as the adjacent properties along Pomerado Road consist of
:1 compatible office uses.
Section 3: The findings, pursuant to G I Code Section 66020 for the public
imp for DR 01-14, are to be made as follows:

The design and imp Ithe proposed develop ~ all
elements of the Poway General Plan, as well as City ordinances, because all
necessary :t facilities will be available to serve this project. The payment
of fees toward public improvements is needed as a result of the proposed
development to protect the public health, safety and welfare as identified below:
1. The project requires payment of drainage, sewer, and traffic mitigation fees,
which are assessed on a pro-rata basis to finance and provide public
inf 3rovements to p Ie and healthy I for the
residents of the City.
Section 4: The City Council hereby approves DR 01-14 to construct a two-story, 5,475-
square-foot, additional office building on a portion of a developed site located at 15644
Pomerado Road, within the C Office (CO) zone, as shown on the plans dated
March 6, 2002, subject to the following conditions:
Approval of DR 01-14 shall apply only to the subject project and shall not waive
compliance with all " : the Zoning Ord :1 all other applicable City
ordinances in effect at the time of building permit issuance.
Within 30 days of the date of this approval, the applicant shall submit in writing that
all conditions of approval have been read and understood.
The conditions of DR 01-14 shall remain in effect for the life of the subject project
and shall run with the land and be binding upon fui heirs,
and 1 ~ : the current property owner.
Priori the applicant shall obtain a Building Permit. Prior1
of a Building Permit, the applicant shall comply with the following:
The site shall be developed in accordance with the approved plans on file in
the Development Services Department and the conditions contained herein.
The applicant shall comply with the latest adopted Uniform Building Code,
National Electric Code, and all other applicable codes and ordinances in
effect at the time of electrical/building permit issuance.
Complete landscape documents shall be submitted to and
approved bythe Planning Division. Landscape plan check f :luired
upon submittal of the plans. Plans shall be prepared in accordance with the
City of Poway Guide to Landscape Requirements (latest edition) and include
the following:

properties and streets as required by the Planning Division.

be provided and be separated from veh by a six-inch high,

All new parking spaces proposed for the rear portion of the site shall
be double striped. The minimum d' for standard sized
parking stalls shall be 8.5' x 18.5'. The parking lot design shall comply
with the Americans with Disabilities Act, for accessible spaces with
one ale space.
The project site has been previously graded per San Diego County Grading
Plan No. L-8543. If th teration to the site grading, no City grading
permit is required prior to building permit issuance. But, if there is a change
in grading that would ~thwork excavation of two feet
fill of more than one foot, and/or exceeding 50 cubic yards, then a grading
permit, issued by the City, is required prior to start of grading work.
If applicable, prior to grading permit' precise grading plan together
with erosion control plan, storm water pollution prevention plan, and
geotechnical reports of the project site shall be submitted to the City for
review and approval. Grading of the project shall I: Jance with the
Uniform Building Code, City Grading Ordinance, and City Storm Water
Management and Discharge Control Ordinance. Plan checking and
inspection fees shall be paid to the City, a grading security shall be posted,
and a preconst ",.:l shall be held between the City Inspector and
the applicant, the applicant's contractor and engineers prior to grading permit
issuance.
The building plans shall depict the specific exterior building colors and
mat I with the project plans dated March 6, 2002, and project
mat ;)le board.
School impact fees shall be paid atth ' 31ished at thetime of building
permit issuance. Please contact the Poway Unified School District for

The following development fees shall be paid to the Engineering Division.

required to comply with the standards of the City of Poway.

Prior to issuance of a certificate of occupancy, a record drawing of the

If medical gases are planned to be used in this building, they shall be
installed to meet req of Uniform Fire Code Article 74-

The addition of on-site fire hydrants is required. The location of the
hydrants shall be determined by the City Fire Marshal.
Fire sprinkler riser(s) shall be located within ten (10) feet of an extedor
exit man door or shall be located inside an enclosed closet with an
ex1 door. Door shall be labeled with a sign indicating
"Fire Sprinkler Riser." When the closet method is chosen, applicant
shall provide 36 inches of from the standpipe or attached
additional risers, accessible by a 3'-0" man door.

Section 5: The approval of DR 01-14 shall expire on May 21,2004 at 5:00 p

which the applicant may protest the imposition of any fees, dedications, or
