ITEM I (701-04 #579/1160-01 ) ORDINANCE NO. 579/SECOND READING SPEED LIMITS ON KIRKHAM ROAD AND WAY Mayor Cafagna opened the public hearing and read the title of Ordinance No. 579, "An Ordinance of the City of Poway, California, Amending Section 10.32.010 of the Poway Municipal Code to Set Speed Limits on Kirkham Road and Kirkham Way." This item was continued from June 3, 2003, Item #3. C 3er Goldby stated that although he had missed the First Reading, he had reviewed the item and was prepared to participate in the vote. ITEM 2.1 (203-02) OLD COACH RANCH ESTATES TENTATIVE PARCEL MAP 02-03 APPLICANT: SHAW CHENG Mayor Cafagna opened the public hearing. This is a request for approval of a Tentative Parcel Map to subdivide a 167-acre site into four lots located in the northwest section of the City of Poway with access from Olympic Point and Augusta Court in the Heritage II Development. APNs: 277-011-06, 276-070-16 and 276-071- 12. This item was continued from the Council meeting of June 10, 2003, Item #7 and staff is requesting the item be continued again to the Council meeting of June 24, 2003, in order 1 :~ate technical revisions to the map. ITEM 3 203-01 ENVIRONMENTAL ASSESSMENT TENTATIVE TRACT MAP 01-03 APPLICANT: ELWOOD NORRIS Mayor Cafagna opened the public hearing. Staff report by City Manager Bowersox. This is a request to subdivide a 76.9-acre hillside property into 8 residential lots each with ' ' lot size of 4 net acres. APN: 321-270-54, 58, 59 and 63. Th present wishing to speak. Motion by Deputy Mayor Rexford, seconded by C 3er Higginson, to close the public hearing and adopt Planning Resolution No. P-03-31, entitled, "A Resolution of the City Council, of the City of Poway, California, Approving a Mitigated Negative Declaration and Tentative Tract Map 01-03 Assessor's Parcel Numbers 321-270-54, 58, 59 and 63." Introduction by City Manager Bowersox. Staff report by Development Services Director Fritz. This is a request to subdivide a 4.13-acre property located at 13709 Twin Peaks Road into 12 residential lots. APN: 314-192-65. The following people were present wishing to speak: Karen Boynton, 14548 Budwin Lane, spoke in support. Dee Fleischman, 14428 Midland Road, expressed her views on wall design, road design, traffic, EIR and pine trees. Michael Crowley, 14575 Budwin Lane, spoke in opposition. Bob Lamagno, Saber Springs, Applicant, responded to q the Council. Motion by C 3er Higginson, seconded by Deputy Mayor Rexford, to close the public hearing and adopt Planning Resolution No. P-03-32, entitled, "A Resolution of the City Council of the City of Poway, California, Approving a Mitigated Negative Declaration and Tentative Tract Map 02-03 Assessor's Parcel Number 314-192-65" with the amendment to include notification to all Budwin Lane residents, east and west side of any future development of the "A Street" lots. Motion carried 3-1 with C 3er Goldby voting "no" and C 3er Emery absent. ITEM 5 (203-13/1002-01 R) ENVIRONMENTAL ASSESSMENT 03-04 ACQUISITION OF PROPERTY .46 ACRES EAST SIDE OF YORK AVENUE SOUTH OF AUBREY STREET WILLIAM AND MELISSA HOLGREN Mayor Cafagna opened the public hearing. Staff report by City Manager Bowersox. On October 30, 2001, the Council authorized staff to negotiate terms for the acquisition of available flood-prone parcels located within the 100-Year Floodway of Rattlesnake Creek. Staff has conducted site due diligence on the subject parcels known as APNs 314-201-12 and 314-201-13 and negotiated the terms of sale in an effort to pursue the development of potential future open space and/or other recreational uses within the Paguay Redevelopment Project Area. Motion carried 4-0 with C 3er Emery absent. Mayor Cafagna requested Item #2 be heard here. ITEM 2 (205-02) FISCAL YEARS 2003-2004 & 2004-2005 COMPREHENSIVE FINANCIAL PLAN Mayor Cafagna opened the public hearing. City Manager Bowersox provided a brief overview of the staff report. This is the second of three scheduled public hearings regarding the City of Poway Comprehensive Financial Program. It presents the Proposed Comprehensive Financial Program for the periods of FY 2003-04 and FY 2004-05. The report also includes a 5-year fiscal forecast for the General Fund through FY 2007-08. The proposed plan is again a two-year plan, incorporating two separate fiscal year budgets and establishing separate appropriations for each year. The first year of the proposed Comprehensive Financial Programs :Is a Redevelopment/Housing Services operating budget of $6,383,930. For FY 2004-05, the proposed operating budget is reduced to $5,669,260 due to the transfer of the Poinsettia Mobilehome Park operations. Administrative Services Director Shafer provided Council with a presentation covering the 5-Year Fiscal Forecast for the General responded to questions. City Attorney Eckis stated that he had prepared a memorandum to the Mayor and Council as previously requested regarding their participation in Initiative Proceedings. MAYOR AND CITY COUNCIL.INITIATED ITEMS 16. C 3er Goldby requested, but did not receive, Council to have staff d to hire a person to remove yard sale and other signs throughout the City and bill the resident having the sale. 16A. C 3er Goldby requested and received Council to implement the Safe Ride Program for the Fourth of July Weekend at a cost not to exceed $600. (1180-12) 19A. Mayor Cafagna stated he and the Regional G Task Force would be meeting with State Senators Ducheny, Morrow and Alpert to express their :h AB 361 (Kehoe) which had passed through the Assembly.
