A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA,
AMENDING THE CITY'S MASTER FEE SCHEDULE
TO INCLUDE AN ANNUAL RIGHT-OF-WAY PERMIT FEE
WHEREAS, California Government Code Section 66016, et. Seq., establishes
procedures for the adoption of fees for services provided by local government; and
WHEREAS, on May 4, 2010, the City Council adopted a Master Schedule of Fees;
and
WHEREAS, the City Council may find it necessary or desirable to amend the City's
Master Fee Schedule from time to time, as authorized by the California Government Code;
and
WHEREAS, the City Council finds it desirable to establish an Annual Right -of -Way
(AROW) Permit Fee, which will be charged to applicants that anticipate the need to obtain
several Right -of -Way Permits in a given year and apply for an AROW Permit; and
WHEREAS, the proposed new AROW Permit Fee represents the reasonable
administrative cost of processing and issuing the annual permit; and
WHEREAS, a duly noticed public hearing has been held, allowing for public
comment on the establishment of said fee.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as
follows:
Section 1: The City Council finds that this amendment to the Master Fee Schedule is
exempt from the California Environmental Quality Act (CEQA), pursuant to the provision of
Section 15273(a)(1) of CEQA Guidelines in that it involves the adoption of a fee to pay for
the processing of a new permit type.
Section 2: The City Council hereby establishes a flat fee of $654 for an AROW Permit,
which would be issued to applicants that anticipate applying for several Right -of -Way
Permits per year.

regular meeting this 6th day of October 2015.
