A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA,
ADOPTING THE FIVE-YEAR TRANSNET LOCAL STREET AND ROAD PROGRAM
OF PROJECTS FOR FISCAL YEARS 2003 THROUGH 2007
WHEREAS, on November 3, 1987, th : : San Diego County approved the
San Diego Transportation Improvement Program Ord ri Expenditure Plan; and
WHEREAS, the Ordinance provides that the SANDAG C shall
approve a multi-year program of projects submitted by local jurisdictions identifying
those transportation projects eligible to use transportation sales tax (TransNet) funds;
and
WHEREAS, the City of Poway was provided with an estimate of annual TransNet
local street and road revenues for fiscal years 2003 through 2007; and
WHEREAS, the City of Poway has held a public hearing in accordance with
Section 5(A) of the Ordinance;
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Poway
as follows:
Section 1: Pursuant to Section 8 of the TransNet Ordinance, the City of Poway
certifies that the required minimum annual level of local d ~' "y funds to be
expended for street and road purposes will be met throughout the six-year period
consistent with M of Effort Requirements adopted by the SANDAG
C June 24, 1988.
Section 2: Pursuant to Section 9 of the TransNe! Ordinance, the City of Poway
certifies that TransNet funds programmed in the Six-Year Program of Projects, shown
as Exhibit A do not replace private developer funding which has been or will be
committed for any project.
Section 3: Pursuant to Section 16 of the TransNet Ordinance, the City of Poway
certifies that each project of $250,000 or more will be clearly designated during
Ih TransNet project funding identification signs.

Section 4: The City of Poway does hereby certify that all other applicable
· ' ! the TransNet Ordinance have been met.
Section 5: The City of Poway agrees to hold harmless and defend the SANDAG
C against challenges related to local TransNet funded projects within the City
of Poway.
