COVENANT REGARDING REAL PROPERTY
Thomas A. Knothe and Margaret L. Knothe, Husband and Wife, as Joint
Tenants, Owners, ("OWNERS" hereinafter) are th I land described in Exhibit
"A", which is attached hereto and made a part hereof and which ' y known as
Assessor's Parcel Number 275-342-12 ("PROPERTY hereinafter). In consideration of
approval of a building permit to construct a 676 square foot detached garage on the
referenced property, at 13724 Sagewood Drive, Poway, California, by the City of Poway
("CITY" hereinafter), OWNERS hereby agree that no portion of the detached garage
shall ever be rented or leased, as a separate unit and kitchen facilities shall never be
installed.
This Covenant shall run with the land and be binding upon and inure to the
benefit of the ful encumbrances, heirs, personal
representatives, 1 :1 assigns of the respective parties.
In the event that building permits are never obtained t : the proposed
addition at the request of the OWNERS, the CITY shall expunge this Covenant from the
record title of the PROPERTY.
If either party is required to ' to enforce the p ' ' !this Covenant,
the prevailing party shall be entitled to full reimbursement of all costs, including
reasonable attorneys' fees, from the other party. The CITY may assign to persons
impacted by the perf =this Covenant the right to enforce this Covenant against
OWNERS.
