Muntazir Mehdi and Nazira Mehdi ( "OWNER" hereinafter), are the owners of real property
commonly known as 12343 Spyglass Terrace ( "PROPERTY hereinafter) and more fully described as:
Parcel 1 of Parcel Map No. 18833, in the City of Poway, County of San Diego, State of
California, filed in the office of the County Recorder of San Diego County, November 1,
2001 as File No. 2001- 0796393 of Official Records.
Pursuant to Poway Municipal Code Section 17.08.180(B)6 and in consideration of approval by
the City of Poway ( "CITY" hereinafter) of Building Permit B14 -1228, a request to construct an
attached, two -story addition with a basement level at the above - referenced property, OWNER hereby
agrees that no portion of the attached, two -story addition with a basement shall ever have complete
kitchen facilities installed and will not be rented or leased as a separate unit; additionally the
residence shall be subject to periodic inspections, at the discretion of the City, by City staff to verify
that the floor plan remains open and integrated to function as one single - family residence, and that
not more than one kitchen exists within the residence.
This Covenant shall run with the land and be binding upon and inure to the benefit of future
owners, encumbrances, successors, heirs, personal representatives, transferees and assigns of the
respective parties.
In the event that a Building Permit is never obtained to construct the proposed attached two
story addition with a basement at the request of the OWNER, the CITY shall expunge this Covenant
from the record title of the PROPERTY.
If either party is required to incur costs to enforce the provisions of this Covenant, the
prevailing party shall be entitled to full reimbursement of all costs, including reasonable attorneys'
fees, from the other party.
