COVENANT ON REAL PROPERTY
Harmony Grove Partners, LLP, Owners ("OWNER" hereinafter) is th ; real
property described in Exhibit A which is attached hereto and made a part hereof and
which ' ly known as Assessor's Parcel Number 320-220-03 located at 11906
Tech Center Court, Poway, CA ("PROPERTY" hereinafter). In consideration of the
approval of Development Review (DR 99-22) and approved building permits to
construct a 206,415 square foot industrial building subject to the. conditions listed below
and on file in the Poway Planning Division, notice is hereby given that the property is
burdened by the terms and conditions which :1 as follows. Said
conditions are binding upon future property owners.
Pursuant to the South Poway Specific Plan Development Standards a total of
413 parking spaces are required for the development (Based on a 206,415
square foot building - 1 space per 500 square feet of floor area). The approved
site plan for the project on file in the Poway Development Services Department
and date stamped January 19, 2000, demonstrates that all of the required
parking can b :lated on-site. Upon consideration of the anticipated
parking demand of Disguise, Inc., it was determined that on an interim basis the
installation of 64 of the required parking stalls (in the truck loading area) could be
deferred until such time that demand demonstrates the need for the additional
parking.
Pursuant to the South Poway Specific Plan Development Standards, should the

The percentage of building area improved as office space shall not
exceed forty (40) percent of the total building area. Further, tenants of the
property shall be limited to Light Industrial uses as defined and listed in the
current City of Poway South Poway Specific Plan Development Standards.
The property is subject to the conditions contained in the DR 99-22 approval
dated April 7, 2000, on file in the Development Services Department-Planning
Division, 13325 Civic Center Drive, Poway, California.
