P- 03-49 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POVVAY, CALIFORNIA APPROVING TEMPORARY USE PERMIT 03-50 TO HOLD THE ANNUAL POWAY DAYS EVENTS WHEREAS, Temporary Use Permit 03-50; City of Poway Community Services and the Poway Chamber of C Applicants, requests approval to hold the Annual Poway Days events from Monday, September 1, 2003, through Tuesday, September 30, 2003. WHEREAS, on August 19, 2003, the City Council considered the above- referenced item. NOW, THEREFORE, the City Council does hereby follows: Section 1: The City Council finds that Temporary Use Permit 03-50 is Categorically Exempt (Class 4) from the California E Quality Act (CEQA), pursuant to Section 15304(e) of the CEQA Guidelines, as the event is temporary in nature and will have no permanent effects on th Section 2: The proposed use is in accordance with the purposes and standards of Section 17.26.03QA of the Poway Municipal Code. Section 3: The City Council hereby approves Temporary Use Permit 03-50 for the Annual Poway Days events that take place from Monday, September 1, 2003, through Tuesday, September 30, 2003, subject to the following conditions: The event and related off-site parking shall be conducted as shown on the site plan and application on file in the Development Services Department. This permit is valid during the hours of the scheduled events from Monday September 1, 2003, through Tuesday, September 30, 2003, after which time the sites shall be restored to their original condition. Approval of this activity shall not excuse compliance with all oth ~ the Zoning Ordinance and all other applicable State, County, and City Ordinances presently in effect. D. Prior to all events, the applicants shall comply with the following: The following City of Poway departments shall be contacted for appropriate permits, coordination, and inspections: Public Works, Community Services, Development Services (including the Building, Traffic Engineering, and Planning Divisions), Safety Services, and the Resolution No. P- 03-49 Page 2 Sheriff's Department. The San Diego County Health Department shall also be contacted. An ' bond indemnifying the City from possible liability in an amount not less than $1 million for events that utilize City property shall be provided to the Development Services Department, Planning Division, by Friday, August 29, 2003. Signs shall be posted on Poway Road giving the particulars of dates and times of closure one week prior to the Poway Days Heritage Parade. All signage shall be in ' with the temporary signage provisions of the Poway Municipal Code. Contact the Development Services Department, Planning Division, regarding the temporary Sign Ordinance prior to the installation of any sign. Obtain a permit from the Fire Department for any canopy that is over 400 square feet. During all events, the applicants shall comply with following: Prior to and during all events, emergency vehicle access to any street, fire lane, building, fire hydrant, or fire sprinkler system shall not be blocked. Provide one 2A:10BC rated fire extinguisher at booths where cooking is done. 3. Secure any compressed gas cylinders from falling over. 4. Obtain a permit from the Fire Department for the Pig in the Pit Barbecue. In all unpaved parking areas, temporary markers shall be provided to delineate parking areas and aisles, and to ensure that no parking occurs within 100 feet of any existing residential structure. A designated area for police, fire and paramedic units out of the main activity areas and adjacent to the south vehicle gate of the PVRA property shall be provided. A copy of the agreement with the adjacent property owner(s) for parking rights shall be provided to the Development Services Department, Planning Division prior to Friday, September 5, 2003. The applicants shall ensure that the event is in compliance with Chapter 6.24 of the Poway Municipal Code regulating the treatment of rodeo animals. H. At the all events, the applicants shall comply with the following: Public streets, off-street parking sites, and areas within and adjoining to the proposed area for the event, shall be cleared of debris, litter, temporary signs, and all other evidence of the event shall be removed upon its completion. Section 4: This approval shall become null and void on Wednesday, October 1, 2003, at 1:00 a.m., at which time the sites utilized shall have been restored to their original condition.
