AN ORDINANCE OF THE CITY OF POWAY, CALIFORNIA
ADDING CHAPTER 8.14 TO THE POWAY MUNICIPAL CODE
PERTAINING TO REGULATION OF WHOLESALE FOOD WAREHOUSES
WHEREAS, Wholesale Food Warehouses are not adequately regulated
by the State of California; and
WHEREAS, inadequate regulation of these warehouses may lead to
potentially hazardous food that is distributed throughout the City of Poway and
County of San Diego; and
WHEREAS, an effective regional Wholesale Food Warehouse permitting
and regulatory program re(; ~ a regulatory ordinance in the
City of Poway that parallels the County of San Diego, and cooperation between
the City of Poway and the County of San Diego to implement the ordinance; and
WHEREAS, the County of San Diego has enacted Ordinance No. 9525,
which establishes a mandatory permit program, a permit fee, and regulatory
req ~plicable to Wholesale Food Warehouses; and
WHEREAS, the City Council has determined a need for the three
Wholesale Food Warehouses located in Poway to be regulated with an
ordinance that parallels the County of San Diego ordinance; and
WHEREAS, the City of Poway has an agreement in place with the County
of San Diego that provides for certain services related to public health and
sanitation to be provided by the County within the City of Poway; and
WHEREAS, the City Council has also determined a need for the County of
San Diego to implement the permitting and regulatory program established by
this ord :1 include such in the existing agreement; and
WHEREAS, the San Diego County Department of E Health
and its Director shall be and is hereby authorized and empowered to make
inspections and issue permits to the -I/or operators of Wholesale Food
Warehouses that hold or distribute food at wholesale in the City of Poway.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF POWAY
HEREBY ORDAINS AS FOLLOWS:
Section 1. Chapter 8.14 is hereby added to the Poway Municipal Code
to read as follows:

8.14.010 A
The provisions of the San Diego County Code of Regulatory Ordinances
g permitting and regulation of Wholesale Food Warehouses, codified at
sections 61.212 through 61.256 of the San Diego County Code and any
subsequent revisions or to these sections, are incorporated into this
code by '
8.14.020
The County of San Diego, or any designee of the City Manager, shall
enforce the provisions of this chapter regarding Wholesale Food Warehouses
pursuant to an agreement with the City of Poway for the provision of certain
:ed to public health and sanitation by the County of San Diego within
the City of Poway. The City Manager is authorized to enter into any
supplemental or modified agreement with the County of San Diego, or any
designee of the City Manager, that may be required to effect this
purpose.
8.14.030 Fees
The County of San Diego shall retain all fees and charges collected by it in the
performance of its duties in regulating Wholesale Food Warehouse owners or
operators pursuant to section 8.14.010 hereof.
EFFECTIVE DATE: This Ordinance shall take effect and be in force thirty
(30) days after the date of this passage; and before the expiration of fifteen (15)
days after its passage, it shall be published once with the names and members
voting for and against the same in the Poway News Chieftain, a newspaper of
general circulation published in the City of Poway.

Introduced and first read at a regular meeting of the City Council of the
City of Poway, held this 29m day of July, and thereafter PASSED AND
ADOPTED at a reg ~ of said City Council held the 19th day of August,
2003, by the following roll call vote.
