COVENANT REGARDING REAL PROPERTY
George W. Brooks, PROPERTY OWNER ("OWNER" hereinafter) and Beverly
Thomas, BUYER ("BUYER" hereinafter) are th :1 buyer of real property in escrow
at Continental E to close Fdday, September 30, 2000, and is herein described
in Exhibit A which is attached hereto and made a part hereof and which is commonly
known as Assessor's Pamel Number 316-070-34, ("PROPERTY" hereinafter). In
consideration of an approved building permit to remodel a 308 square foot portion of the
detached garage into a workshop, storage area, laundry room and bathroom by the City
of Poway ("CITY" hereinafter), OWNER and BUYER hereby agree to remove all other
imp ~lled without the benefit of permits, and to refrain from making any future
imp prior to obtaining I: Iing or leasing the garage as a separate unit.
This Covenant shall run with the land and be binding upon and inure to the benefit
of the future owners, encumbrancers, heirs, personal representatives,
:1 assigns of the respective parties.
If any party is required I to enfome the p ' ' =this Covenant, the
prevailing party shall be entitled to full reimbursement of all costs, including reasonable
attorneys' fees, from the other party. The CiTY may assign to persons impacted by the
