Ord 788ORDINANCE NO. 788 AN ORDINANCE OF THE CITY OF POWAY, CALIFORNIA, AMENDING CHAPTERS 17.08, 17.10, AND 17.42 OF TITLE 17 OF THE POWAY MUNICIPAL CODE PERTAINING TO OUTDOOR LIGHTING REGULATIONS (ZONING ORDINANCE AMENDMENT 15 -004) WHEREAS, the City Council desires to promote outdoor lighting design that provides for public safety, utility, and productivity while conserving energy and resources and minimizing light spill -over, glare and sky glow for the benefit of the public and astronomical research at Palomar Observatory; and WHEREAS, the outdoor lighting regulations contained in the Poway Municipal Code have not been evaluated since original establishment in 1997 and are in need of an update; and WHEREAS, on February 2, 2016, the City Council held a duly advertised public hearing to solicit comments from the public, both pro and con, relative to this Ordinance. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF POWAY DOES ORDAIN AS FOLLOWS: Section 1: This project is exempt from the provisions of the California Environmental Quality Act (CEQA), pursuant to section 15061(b)(3) of the CEQA Guidelines, because it involves updated City regulations for outdoor lighting, which are similar to existing regulations and result in no additional light sources; therefore, there is no possibility of an effect on the environment. Section 2: Subsection (L)(2) of section 17.08.220 of the Poway Municipal Code is hereby repealed. Section 3: Subsection (L)(2) is hereby added to section 17.08.220 of the Poway Municipal Code to read as follows: All lighting used in parking lots, for security purposes or similar safety - related uses, shall be low pressure sodium, narrow spectrum amber Low Emitting Diode (LED), or other energy efficient light which does not exceed a Correlated Color Temperature (CCT) of 3,000 kelvin and 4,050 lumen except where the City Council has issued an exemption permit to allow alternative lighting. The City Council may issue such exemption permits where the Council finds that unusual circumstances dictate the use of brighter lighting for safety reasons. Section 4: Subsection (H)(3) of section 17.10.150 of the Poway Municipal Code is hereby repealed. Section 5: Subsection (H)(3) is hereby added to section 17.10.150 of the Poway Municipal Code to read as follows: Ordinance No. 788 Page 2 During the hours from 11:00 p.m. until dawn, all exterior lighting shall be low pressure sodium, narrow spectrum amber Low Emitting Diode (LED), or other energy efficient light which does not exceed a Correlated Color Temperature (CCT) of 3,000 kelvin and 4,050 lumen except where the City Council has issued an exemption permit to allow alternative lighting. The City Council may issue such exemption permits where the Council finds that unusual circumstances dictate the use of brighter lighting for safety reasons. Section 6: Section 17.42.060(E) of the Poway Municipal Code is hereby repealed. Section 7: Section 17.42.060(E) is hereby added to the Poway Municipal Code to read as follows: All parking facilities shall have lighting in accordance with the current City standards. The lighting shall be designed and installed so as to confine direct rays to the site. Freestanding light posts located on projects which contain less than 15 acres shall be no taller than 18 feet. On projects which are 15 acres or larger in size freestanding light posts not exceeding 30 feet in height may be permitted; provided, that the property is located in an area which is already lighted by street lights or adjacent development. Parking lot lights shall be directed away from all property lines and shall comply with PMC 17.08.220(L) and 17.10.150(H). Section 8: This Ordinance shall be codified. EFFECTIVE DATE: This Ordinance shall take effect and be in force thirty (30) days after its adoption. CERTIFICATION /PUBLICATION: The City Clerk shall certify the adoption of this Ordinance and cause it, or a summary of it, to be published with the names of the City Council members voting for and against the same in the Poway News Chieftain, a newspaper of general circulation in the City of Poway within 15 days after its adoption and shall post a certified copy of this Ordinance in the Office of the City Clerk in accordance with Government Code § 36933.
