Ord 789ORDINANCE NO. 789 AN ORDINANCE OF THE CITY OF POWAY, CALIFORNIA, AMENDING CHAPTER 4 OF THE SOUTH POWAY SPECIFIC PLAN PERTAINING TO OUTDOOR LIGHTING REGULATIONS (SPECIFIC PLAN AMENDMENT 16 -001) WHEREAS, Chapter 17.47 (Specific Plan Regulations) of Title 17 (Zoning Development Code) of the Poway Municipal Code provides the requirements for the preparation and adoption of Specific Plans in accordance with Title 7, Division 1, Chapter 3, Article 8 (Section 65450, et seq.) of the California Government Code (Article 8, Specific Plan); and WHEREAS, the City Council desires to promote outdoor lighting design that provides for public safety, utility, and productivity while conserving energy and resources and minimizing light spill -over, glare and sky glow for the benefit of the public and astronomical research at Palomar Observatory; and WHEREAS, the outdoor lighting regulations have not been evaluated since original establishment in 1997 and are in need of an update; -and WHEREAS, on February 2, 2016, the City Council held a duly advertised public hearing to solicit comments from the public, both pro and con, relative to this Ordinance. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF POWAY DOES ORDAIN AS FOLLOWS: Section 1: This project is exempt from the provisions of the California Environmental Quality Act (CEQA), pursuant to Section 15061(b)(3) of the CEQA Guidelines, because it involves updated City regulations for outdoor lighting, which are similar to existing regulations and result in no additional light sources; therefore, there is no possibility of an effect on the environment. Section 2: Chapter 4, Section IV(E)(1)(b) of the South Poway Specific Plan is amended to read as follows: Security lighting shall comply with Chapters 17.10 and 17.42 of the Poway Municipal Code. Section 3: Chapter 4, Section IV(E)(3)(a) of the South Poway Specific Plan is amended to read as follows: Lighting for parking areas shall be shielded and comply with Chapters 17.10 and 17.42 of the Poway Municipal Code. EFFECTIVE DATE: This Ordinance shall take effect and be in force thirty (30) days after its adoption. CERTIFICATION /PUBLICATION: The City Clerk shall certify the adoption of this Ordinance and cause it, or a summary of it, to be published with the names of the City Council members voting for and against the same in the Poway News Chieftain, a newspaper of general circulation in the City of Poway within 15 days after its adoption and shall post a certified copy of this Ordinance in the Office of the City Clerk in accordance with Government Code § 36933.
