A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA,
ACCEPTING THE RELINQUISHMENT OF HIGHWAY RIGHT-OF-WAY
FROM CAL TRANS, AND WAIVING THE APPEAL PERIOD OF THE
90-DAY NOTICE OF INTENTION TO RELINQUISH HIGHWAY RIGHT-OF-WAY
WHEREAS, on August 7, 1998, the California Department of Transportation
(CAL TRANS) offered to the City of Poway (City) the sale of a surplus land, excepting that
portion for Park and Ride No. 52 right-of-way, located at the southwest corner of the
intersection of Twin Peaks Road and Community Road; and
WHEREAS, the City purchased the abovementioned land per the Director's Deed
recorded in the office of the Recorder of San Diego County on March 19, 1999, as
Document No. 1999-178415 of Official Records; and
WHEREAS, on February 3, 2000, CAL TRANS notified and offered to the City of
their intent to relinquish Park and Ride No. 52 (Property), more particularly described in
Exhibit "A," titled "Relinquishment R31094," and depicted on Exhibit "B," titled
"Relinquishment R31094 Exhibit Plat"; and
WHEREAS, relinquishment of the Property shall be processed through the
California Transportation Commission (CTC) pursuant to Section 73 of the State Streets
and Highways Code; and
WHEREAS, prior to relinquishment, the State of California would normally give the
City 90 days' notice of intention to relinquish which would delay said relinquishment; and
WHEREAS, CAL TRANS has assigned a zero dollar valuation of the Property and
that the City has no monetary obligation of its acceptance of the relinquishment.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway
as follows:
1. The relinquishment of the right-of-way is made pursuant to Section 73 of the
State Streets and Highways Code.
2. The City Council hereby waives the 90-day Notice of Intention to relinquish
a highway right-of-way.
3. The City Council hereby accepts the relinquishment with all the rights, title
and interest to that property described in Exhibit "A," titled "Relinquishment
R31094," and depicted on Exhibit "B," titled "Relinquishment R31094 Exhibit
Map".

4. The City Clerk of the City of Poway is hereby directed to cause a certified
copy of this resolution to be recorded in the Office of the Recorder of San
Diego County.
PASSED, ADOPTED, AND APPROVED by the City Council of the City of Poway,
California, at a regular meeting this 21st day of March 2000.

That portion of the Southeast Quarter of the Northwest Quarter of Section 12,
Township 14 South, Range 2 West, San Bernardino Meridian, as conveyed to the State
of California in Parcel 1 of Final Order of Condemnation, Superior Court Case No.
335424, recorded July 16, 1973 as File No. 73-195642 of Official Records of San Diego
County known as Caltrans Park and Ride Lot No. 52 ("Park and Ride Map No. 52 on file
in the Caltrans District 11 Right of Way Engineering Office"), more particularly
described as follows:
COMMENCING at the Southeasterly terminus of course (4) as described in a deed to
the American Housing Guild-San Diego recorded Feb. 28, 1975 as File/Page 75-
046873 of Official Records of San Diego County, State of California, said Southeasterly
terminus being on the Westerly line of Comml.:iiily Road per said deed;
thence (1) along said Westerly line N.00029'54"E., 42.86 feet to the beginning of a 1851
foot radius curve to the right;
thence (2) Northerly along said curve and said Westerly line through a central angle of
00055'35" a distance of 29.93 feet to the POINT OF BEGINNING;
thence (3) N.89030'06'W., 78.45 feet;
thence (4) N.00029'54"E., 140.00 feet;
thence (5) S.89030'06"E., 70.00 feet;
