A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA, APPROVING
SEWAGE TRANSPORTATION AGREEMENTS BETWEEN
THE CITY OF POWAYAND THE CITY OF SAN DIEGO
WHEREAS, the City of San Diego owns, operates and maintains the Metropolitan
Sewerage System (the "Metro System") for the purpose of treating and disposing of
sewage for San Diego and certain other municipalities and districts within the San Diego
region, including the City of Poway, under the terms and conditions of a Regional
Wastewater Disposal Agreement; and
WHEREAS, San Diego also owns, operates and maintains the San Diego Municipal
Sewerage System (the "San Diego Sewerage System") for the purpose of collecting and
transporting sewage to the Metro System for ultimate treatment at the Point Loma
Wastewater Treatment Plant, a regional wastewater treatement facility, owned by the City
of San Diego; and
WHEREAS, due to the location of Poway's sewerage system it is necessary that
Poway use a portion of the San Diego Sewerage System to transport its sewage to the
Metro System; and
WHEREAS, Poway owns, operates, and maintains the City of Poway Municipal
Sewerage System (the "Poway Sewerage System") for the purpose of collecting and
transporting sewage within Poway to the San Diego Sewerage System for ultimate
transportation to, and treatement by, the Metro System; and
WHEREAS, due to the location of some facilities of the San Diego Sewerage
System it is necessary that San Diego use a portion of the Poway Sewerage System to
transport its sewage to the San Diego Sewerage System; and
WHEREAS, it is necessary for Poway and San Diego to agree upon the use of the
other's sewerage facilities for continuous and efficient transporation of effluence from their
jurisdictions to the Metro System, as well as to establish terms and conditions for the use of
the San Diego Sewerage System, by Poway, and the Poway Sewerage System by San
Diego, through (1)that certain Sewage Transportation Agreement Between the City of San
Diego and the City of Poway for City of San Diego Use of Poway Wastewater Collection
System (the"San Diego Sewage Transportation Agreement"), and (2)that certain Sewage
Transportation Agreement: City of San Diego and City of Poway (the "Poway Sewage
Transportation Agreement").
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as
follows:

Section 1. The foregoing recitals are true and correct and are findings made by
the City Council.
Section 2. The San Diego Sewage Transportation Agreement, as presented at
this meeting, is hereby approved. The Mayor, the City Manager or, in the absence of the
City Manager, the Assistant City Manager is hereby authorized to execute the San Diego
Sewage Transportation Agreement substantially in the form as presented at this meeting
with such changes as may be approved by the Mayor, the City Manager, or the Assistant
City Manager. The City Clerk is hereby authorized to attest the signature of the Mayor,the
City Manager, or the Assistant City Manager, to the San Diego Sewage Transporation
Agreement.
Section 3. The Poway Sewage Transportation Agreement, as presented at this
meeting, is hereby approved. The Mayor, the City Manager or, in the absence of the City
Manager, the Assistant City Manager is hereby authorized to execute the Poway Sewage
Transportation Agreement substantially in the form as presented at this meeting with such
changes as may be approved by the Mayor, the City Manager, or the Assistant City
Manager. The City Clerk is hereby authorized to attest the signature of the Mayor, the City
Manager, or the Assistant City Manager, to the Poway Sewage Transporation Agreement.
PASSED, ADOPTED AND APPROVED by the City Council of the City of Poway
at a regular meeting this 2nd day of August, 2016.
