ORDINANCE NO. 556
AN ORDINANCE OF THE CITY OF POWAY, CALIFORNIA,
VACATING THE MINI -PARK EASEMENT IN LOT 2,
CITY OF POWAY, TRACT NO. 00-01, MAP NO. 14230
WHEREAS, the City Council desires to vacate the Mini -Park Easement in
a portion of Lot 2 of City of Poway Tract No. 00 -01, Map No. 14230, pursuant to
the requirements of Section 16.16.110 of the Poway Municipal Code; and
WHEREAS, the Poway Redevelopment Agency, in its effort to provide a
centralized car storage facility offsite from the Poway Road car dealership
corridor has purchased said Lot 2 of Map No. 14230, located in the South Poway
Business Park; and
WHEREAS, the offsite car storage facility would eliminate the need for car
deliveries along Poway Road and nearby residential streets; and
WHEREAS, such elimination of car deliveries provides the general public
the benefit of a safer and better traffic circulation along Poway Road and nearby
residential streets and further, the reduction of noise level from car transport
carriers; and
WHEREAS, in order to provide for adequate car storage area, the Mini -
Park Easement in said Lot 2 needs to be vacated.
NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF POWAY
DOES ORDAIN AS FOLLOWS:
1. The vacation is made pursuant to Section 16.16.110 of the Poway
Municipal Code (PMC).
2. The City hereby finds that the vacation is to permit the property to be
used for a valid public purpose (Section 16.16.110 Al, PMC).
3. The City hereby declares that the Mini -Park Easement, labeled and
shown on the final map of City of Poway Tract No. 00 -01, Map No.
14230, as "Portion of Lot 2 dedicated hereon as an easement to the
City of Poway maintained by the property owner or a property
maintenance association for public mini -park purposes" is hereby
vacated.

EFFECTIVE DATE: This Ordinance shall take effect and be in force thirty (30)
days after the date of its passage; and before the expiration of fifteen (15) days
after its passage, it shall be pub;ished once with the names and members voting
for and against the same in the Poway News Chieftain, a newspaper of general
circulation published in the City of Poway.
Introduced and first read at a regular meeting of the City Council of the
City of Poway held this 9th day of April 2002, and thereafter PASSED AND
ADOPTED at a regular meeting of said City Council held this 23rd day of April
2002, by the following roll call vote.
