Res 03-076 RESOLUTION NO. 03-076 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA, REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF SAN DIEGO CONSOLIDATE A SPECIAL MUNICIPAL ELECTION TO BE HELD ON MARCH 2, 2004 WITH THE STATEWlDE PRIMARY ELECTION TO BE HELD ON THE DATE PURSUANT TO §10403 OF THE ELECTIONS CODE WHEREAS, pursuant to authority provided by statute, a petition has been filed by Joseph Lucidi with the legislative body of the City of Poway, California, signed by more than fifteen percent of the number of registered voters of the City to submit a proposed Ordinance relating to changing the general plan and zoning designations of approximately twenty acres at the northwest corner of Highway 67 and Poway Road from Rural Residential to Automotive/General Commercial; and WHEREAS, the City Council of the City of Poway, California has called a Special Municipal Election to be held on March 2, 2004, for the purpose of the submitting to the voters the proposed Ordinance relating to whether the General Plan and Zoning Designations of Approximately Twenty Acres at the Northwest Corner of Highway 67 and Poway Road should be changed from Rural Residential to Automotive/General Commercial; and WHEREAS, it is desirable that the Special Municipal Election be consolidated with the Statewide Primary Election to be held on the same date and that within the city the precincts, polling places and election officers of the two elections be the same, and that the county election department of the County of San Diego canvass the returns of the Special Municipal Election and that the election be held in all respects as if there were only one election; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That pursuant to the provisions of §10002 of the Elections Code of the State of California, the Board of Supervisors of the County of San Diego is hereby requested to consent and agree to the consolidation of a Special Municipal Election on Tuesday, March 2, 2004, for the purpose of submitting the following proposed Ordinance: Resolution No. 03-076 Page 2 Shall an Ordinance be adopted which would change the YES General Plan and Zoning Designations of Approximately Twenty Acres at the Northwest Corner of Highway 67 and Poway Road from Rural Residential to Automotive/General NO Commercial SECTION 2. That the County Elections Department is authorized to canvass the returns of the Special Municipal Election. The election shall be held in all respects as if there were only one election and only one form of ballot shall be used. SECTION 3. That the Board of Supervisors ~s requested to issue instructions to the County Elections Department to take any and all steps necessary for the holding of the consolidated election. SECTION 4. That the City of Poway recognizes that additional costs will be incurred by the County for the conduct of this Special Election and agrees to reimburse the County for any and all actual costs out of funds received from the initiative proponent in accordance with City of Poway Ordinance No. 283, Section 3E SECTION 5. That the City Clerk is hereby directed to file a certified copy of this Resolution with the Board of Supervisors and the County Elections Department of the County of San Diego. SECTION 6. That the City Clerk shall certify the passage and adoption of this Resolution and enter it into the book of original resolutions.
