AN ORDINANCE OF THE CITY OF POWAY, CALIFORNIA
AMENDING ZONING ORDINANCE 7358:
FINDINGS REQUIRED BEFORE ISSUANCE
OF A MAJOR USE PERMIT
THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA, DOES ORDAIN AS FOLLOWS:
Section 1. That Section 7358 of the City Zoning Ordinance establishes
necessary findings as a prerequisite to issuance of any major use permit. That
the language of that section, as adopted by reference from the County of San
Diego, has proven awkward to administer when compared to the evidence presented.
This ordinance is intended to more clearly define the issues relative to making
the findings supporting the issuance of a major use permit.
Section 2. Section 7358 of the City of Poway Zoning Ordinance is amended
to read as follows:
7358 FINDINGS REQUIRED.
No use permit will be granted or modified unless it shall be found:
1. That the location, size, design, and operating characteristics of the
proposed use will be compatible with and will not adversely affect or
be materially detrimental to adjacent uses, residents, buildings,
structures, or natural resources;
2. That the harmony in scale, bulk, coverage and density is consistent
with adjacent uses;
3. That there are available public facilities, services and utilities;
4. That will not be a harmful effect upon desirable neighborhood
characteristics;
5. That the generation of traffic will not adversely impact the surround-
ing streets and/or the City circulation element;
6. That the site is suitable for the type and intensity of use or develop-
ment which is proposed;
7. That there will not be significant harmful effects upon environmental
quality and natural resources;
8. That there are no other relevant negative impacts of the proposed use
that cannot be mitigated; and

9. That the impacts, as described above, and the location of the proposed
use will not adversely affect the City of Poway general plan for future
as well as present development.
Section 3. The City Council of the City of Poway hereby finds that this
amendment will not cause significant adverse impacts on the environment and
issues a negative declaration for this amendment.
Section 4. .This amendment shall be effective thirty (30) days after its
adoption and the City Clerk shall certify the adoption of this ordinance and
cause it to be published one time in the Poway Ne~s-Chieftain.
Introduced and first read at a regular meeting of the City Council of the
City of Poway held the 18th day of May, 1982, and thereafter PASSED AND ADOPTED
at a regular meeting of said City Council held the 25th day of May 1982, by
the following roll call vote:
